35	35	REQUESTING CONGRESS TO PROPOSE TO AMEND THE UNITED STATES CONSTITUTION TO AUTHORIZE THE STATE OF HAWAII TO ENACT LAWS TO AUTHORIZE ONLY HAWAII RESIDENTS TO PURCHASE RESIDENTIAL REAL PROPERTIES IN THE STATE.

43	43	WHEREAS, Hawaii, as an island state, has a scarcity of land; and WHEREAS, among available lands, only a fraction may be used for residential purposes; and WHEREAS, purchases of residential real properties by nonresidents significantly raise the market prices of homes, making it difficult for Hawaii residents to purchase homes of their own; and WHEREAS, a state law that would authorize only Hawaii residents to purchase residential real properties in the State would significantly decrease the prices of homes; and WHEREAS, such a state law would face legal challenges based on the probable violation of the Constitution of the United States; and WHEREAS, pursuant to Article V of the Constitution of the United States, the United States Congress has the power, through a two-thirds majority vote in each of its houses, to propose that states ratify amendments to that Constitution; now, therefore, BE IT RESOLVED by the House of Representatives of the Thirty-second Legislature of the State of Hawaii, Regular Session of 2024, that the United States Congress is requested to propose to the states the ratification of an amendment to the Constitution of the United States to authorize the State of Hawaii to enact laws to authorize only Hawaii residents to purchase residential real properties in the State; and BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Majority Leader of the United States Senate, Speaker of the United States House of Representatives, and members of Hawaii's congressional delegation.
