4343 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

4747 SECTION 1. The purpose of this Act is to propose an amendment to article V, sections 1 and 2, of the Constitution of the State of Hawaii to provide that, beginning with the 2026 general election, the minimum state residency requirement for a candidate for governor or lieutenant governor shall be raised from five years to thirty years. SECTION 2. Article V, section 1, of the Constitution of the State of Hawaii is amended to read as follows: "ESTABLISHMENT OF THE EXECUTIVE Section 1. The executive power of the State shall be vested in a governor. The governor shall be elected by the qualified voters of this State at a general election. The person receiving the highest number of votes shall be the governor. In case of a tie vote, the selection of the governor shall be determined as provided by law. The term of office of the governor shall begin at noon on the first Monday in December next following the governor's election and end at noon on the first Monday in December, four years thereafter. No person shall be elected to the office of governor for more than two consecutive full terms. [No] Beginning with the general election of 2026, no person shall be eligible for the office of governor unless the person shall be a qualified voter, have attained the age of thirty years and have been a resident of this State for [five] thirty years immediately preceding the person's election. The governor shall not hold any other office or employment of profit under the State or the United States during the governor's term of office." SECTION 3. Article V, section 2, of the Constitution of the State of Hawaii is amended to read as follows: "LIEUTENANT GOVERNOR Section 2. There shall be a lieutenant governor who shall have the same qualifications, including state residency qualifications, as the governor. The lieutenant governor shall be elected at the same time, for the same term and in the same manner as the governor; provided that the votes cast in the general election for the nominee for governor shall be deemed cast for the nominee for lieutenant governor of the same political party. No person shall be elected to the office of lieutenant governor for more than two consecutive full terms. The lieutenant governor shall perform such duties as may be provided by law." SECTION 4. The question to be printed on the ballot shall be as follows: "Beginning with the 2026 general election, shall the minimum state residency requirement for a candidate for governor or lieutenant governor be raised from five years to thirty years?" SECTION 5. Constitutional material to be repealed is bracketed and stricken. New constitutional material is underscored. SECTION 6.
