4343 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

4747 SECTION 1. Chapter 481J, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows: "§481J- Removal of installed motor vehicle equipment and features prohibited. No manufacturer shall: (1) Remove any motor vehicle equipment from; (2) Disable any motor vehicle equipment in; or (3) Impair or hinder the use of any motor vehicle equipment in, any used motor vehicle for which the equipment or feature has already been paid." SECTION 2. Section 481J-1, Hawaii Revised Statutes, is amended by adding two new definitions to be appropriately inserted and to read as follows: ""Manufacturer" is defined in section 437-1.1. "Motor vehicle equipment" is defined in title 49 United States Code section 30102. "Motor vehicle equipment" includes driver assistance technology and any other software used in the operation of a motor vehicle." SECTION 3. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date. SECTION 4. New statutory material is underscored.
