A BILL FOR AN ACT

 

 

relating to THE DEPARTMENT OF LABOR AND INDUSTRIAL RELATIONS RULES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 

      SECTION 1.  Section 371-9, Hawaii Revised Statutes, is amended by amending subsections (a) and (b) to read as follows:      "(a)  Any employer, employee, or other person who wilfully violates any lawful rule of the department for which no penalty is otherwise provided shall be fined [no more than $500,] five per cent of their yearly income, or imprisoned [no] not more than six months, or both, for each offense.      (b)  Any person who, after twenty-one days written notice and the opportunity to be heard by the director, is found to have violated any lawful rule of the department for which no penalty is otherwise provided, shall be fined [no more than $500 for each offense.] five per cent of their yearly income."      SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.      SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.      SECTION 4.  This Act shall take effect upon its approval.
