47- SECTION 1. Section 22-4, Hawaii Revised Statutes, is amended to read as follows: "§22-4 Permanent staffing. (a) Each house of the legislature may by appropriate rules provide for permanent professional staffing for each respective house. Persons appointed shall perform and observe [such] the duties and responsibilities as may be assigned to them, and they may be called to assist in the development and formulation of policy. Persons appointed by each respective house [may], if so determined, may serve as staff to committees during the interim and during regular sessions. They shall be appointed [and], removed, and compensated as provided for in the rules of the respective houses, and [the provisions of] chapter 76 shall not apply. The members of the permanent staff shall be entitled to every state employee benefit and privilege. (b) During the interim between regular sessions of the legislature, permanent staff of the legislature may be temporarily assigned to work in an executive or judicial branch agency, with the approval of the presiding officer of the legislative chamber that employs the employee and the legislator who appointed the employee, if any. The presiding officer of the legislative chamber that employs the employee shall execute a memorandum of understanding or agreement with the receiving executive or judicial branch agency head that includes the temporarily assigned legislative employee's duties, responsibilities, compensation, the agency that shall be responsible to pay the temporarily assigned employee's compensation while on temporary assignment, term of temporary assignment, and any other details deemed appropriate. For purposes of determining employment status, while on temporary assignment pursuant to this subsection, the temporarily assigned legislative employee's employment status shall remain as a permanent legislative employee whose employment is exempt from chapter 76." SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored. SECTION 3. This Act shall take effect on July 1, 2050.
