4747 PART I SECTION 1. The director of finance is authorized to issue general obligation reimbursable bonds in the sum of $70,000,000 or so much thereof as may be necessary and the same sum or so much thereof as may be necessary is appropriated for fiscal year 2024-2025 for the purpose of the following capital improvement project for the sixth senatorial district: 1. Lahaina Bypass Road, Maui A. Plans, land acquisition, design, construction, and equipment for an extension of the Lahaina bypass road from North Keawe street to beyond Puukolii road. Plans $ 1,000 Land acquisition $ 1,000 Design $ 1,000 Construction $69,996,000 Equipment $ 1,000 Total funding $70,000,000 SECTION 2. The sum appropriated for the capital improvement project shall be expended by the department of transportation for the purposes of this part. PART II SECTION 3. The director of finance is authorized to issue general obligation bonds in the sum of $62,500,000 or so much thereof as may be necessary and the same sum or so much thereof as may be necessary is appropriated for fiscal year 2024-2025 for the purpose of capital improvement projects for the sixth senatorial district, as follows: 1. The director of finance is authorized to issue general obligation bonds in the sum of $18,674,000 or so much thereof as may be necessary and the same sum or so much thereof as may be necessary is appropriated for fiscal year 2024-2025 for the purpose of capital improvement projects for the sixth senatorial district as follows: 1. Mala Boat Ramp A. Design and construction for maintenance dredging, including dredging of accumulated material at boat ramp and entrance channel and movement of dredged material for upland unrestricted use. Design $ 200,000 Construction $1,000,000 Total funding $1,200,000 B. Design and construction for Mala boat ramp access road resurfacing and drainage improvements, including resurfacing of asphalt access road, extension of asphalt to shoulders, striping, new concrete pavement at boat ramp turnaround, reconstruction of boat wash down, and drainage improvements. Design $ 300,000 Construction $1,800,000 Total funding $2,100,000 C. Design and construction for sinkhole repair, including excavation of sinkholes, backfilling with structural fill, new asphalt pavement, and striping. Design $100,000 Construction $500,000 Total funding $600,000 2. Flood Mitigation and Greenbelt Fire Prevention A. Construction for an R-1 water reservoir at Kulanihakoi and Waipuilani and retention and detention ponds in Kihei. Construction $14,500,000 Total funding $14,500,000 3. Rock Wall Repairs and Storm Mitigation A. Plans, design, and construction for rock wall repairs and storm mitigation at TMK 3-9-001-012-0000. The sums appropriated for the respective capital projects set forth in section 5 shall be expended by the department of land and natural resources for the purposes of this part. PART IV SECTION 7. The director of finance is authorized to issue general obligation reimbursable bonds in the sum of $3,200,000 or so much thereof as may be necessary and the same sum or so much thereof as may be necessary is appropriated for fiscal year 2024-2025 for the purpose of the following capital improvement project for the sixth senatorial district: 1. Axis Deer Fencing, Maui A. Construction for fencing of property to prevent the migration of axis deer in Kihei. Construction $3,200,000 Total funding $3,200,000 SECTION 8. The sum appropriated for the respective capital project set forth in section 7 shall be expended by the department of health for the purposes of this part. PART V SECTION 9. There is appropriated out of federal moneys received by the State of Hawaii the sum of $10,000,000 or so much thereof as may be necessary for fiscal year 2024-2025 for plans, design, construction, and equipment for an R-1 water reservoir. The sum appropriated shall be expended by the department of health for the purposes of this part. SECTION 10. There is appropriated out of the general revenues of the State of Hawaii the sum of $2,500,000 or so much thereof as may be necessary for fiscal year 2024-2025 for plans, design, construction, and equipment for an R-1 water reservoir. The sum appropriated shall be expended by the department of health for the purposes of this part; provided that no moneys appropriated by this section shall be expended unless the county of Maui provides matching moneys on a dollar-for-dollar basis. SECTION 11. There is appropriated out of federal moneys received by the State of Hawaii the sum of $100,000 or so much thereof as may be necessary for fiscal year 2024-2025 for the rehabilitation of Kulanihakoi stream, including installation of irrigation from the R-1 water reservoir and planting of vegetation to trap sediment. The sum appropriated shall be expended by the department of health for the purposes of this part. SECTION 12. There is appropriated out of federal moneys received by the State of Hawaii the sum of $130,000 or so much thereof as may be necessary for fiscal year 2024-2025 for the rehabilitation of Waipuilani stream, including installation of irrigation from the R-1 water reservoir and planting of vegetation to trap sediment. The sum appropriated shall be expended by the clean water branch of the department of health for the purposes of this part. PART VI SECTION 13. The appropriations made by this Act shall not lapse at the end of the fiscal year for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2026, shall lapse as of that date. SECTION 14. In accordance with section 9 of article VII of the Hawaii State Constitution and sections 37-91 and 37-93, Hawaii Revised Statutes, the legislature has determined that the appropriations contained in Act 164, Regular Session of 2023, and this Act will cause the state general fund expenditure ceiling for fiscal year 2024-2025 to be exceeded by $ or per cent. This current declaration takes into account general fund appropriations authorized for fiscal year 2024-2025 in Act 164, Regular Session of 2023, and this Act only. The reasons for exceeding the general fund expenditure ceiling are that: (1) The appropriation made in this Act is necessary to serve the public interest; and (2) The appropriation made in this Act meets the needs addressed by this Act.
