4141 WHEREAS, public airports throughout the State lack a sufficient quantity of parking spaces; and WHEREAS, the proliferation of online car-sharing platforms, including Turo, Inc., has exacerbated the scarcity of available parking spaces at these airports; and WHEREAS, recognizing the need to regulate and address challenges arising from commercial activities at airports in the State, the Legislature enacted section 279L-11, Hawaii Revised Statutes, which authorizes the Department of Transportation to regulate the parking of peer-to-peer shared cars at state airports; and WHEREAS, section 19-14-3(i), Hawaii Administrative Rules, explicitly prohibits engaging in any business, service, or commercial activity, for a fee or gratuity, in or at a public airport, without the permission of the Director of Transportation; and WHEREAS, nevertheless, Turo, Inc.'s digital platform continues to feature advertisements for vehicles available for pick-up at airports throughout the State; now, therefore, BE IT RESOLVED by the Senate of the Thirty-second Legislature of the State of Hawaii, Regular Session of 2024, that Turo, Inc., is hereby strongly urged to immediately cease and desist listing on its digital platform the parking lot of any public airport in the State as a vehicle pick-up site, and to only resume this business practice once a comprehensive resolution has been reached through successful legislation regulating this action or a compromise has been achieved; and BE IT FURTHER RESOLVED that the Legislature is requested to require that Turo, Inc., conduct a cross-sectional observational study to gather data regarding Turo's business practices and impact on the local population's access to the services and parking stalls at airports throughout the State; and BE IT FURTHER RESOLVED that the Legislature is also requested to require that the cross-sectional observational study be conducted over the course of six months, during peak travel periods of the fiscal year, and assess the availability of parking stalls at airports throughout the State and gather important data points; and BE IT FURTHER RESOLVED that the Legislature supports and reaffirms the provisions of section 279L-11, Hawaii Revised Statutes, and recognizes the statute's importance in addressing challenges posed by the insufficient number of parking stalls at airports in the State; and BE IT FURTHER RESOLVED that Turo, Inc., is reminded that engaging in commercial activities in or at public airports in the State without the permission of the Director of Transportation violates section 19-14-3(i), Hawaii Administrative Rules, and may result in penalties imposed by the State; and BE IT FURTHER RESOLVED that, to the extent possible, the Airports Division of the Department of Transportation is requested to assess penalties on Turo, Inc., for any continued violation of section 279L-11, Hawaii Revised Statutes, and section 19-14-3(i), Hawaii Administrative Rules; and BE IT FURTHER RESOLVED that the Legislature is requested to collaborate with any relevant authorities to monitor Turo, Inc.'s compliance with state law and this measure; and BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Director of Transportation, Deputy Directors of the Airports Division of the Department of Transportation, and the Chief Executive Officer of Turo, Inc.
