4343 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

4747 SECTION 1. The legislature finds that in some cases, owners are unable to pay outstanding tow, storage, or other charge, fee, or fine owed to a county in Hawaii for their abandoned vehicle. The purpose of this Act is to assist those who face financial hardship by waiver of payment for outstanding tow, storage, or charge, fee, or fine for an abandoned vehicle. SECTION 2. Chapter 290, Hawaii Revised Statutes, is amended by adding a new section to part III to be appropriately designated and to read as follows: "§290- Fees and fines; waiver. The director of finance of each county may waive payment of any outstanding tow, storage, or other charge, fee, or fine owed to the county in accordance with this chapter, for a period not to exceed one year after the subject charge, fee, or fine becomes due and payable; provided that this section shall not apply to any tow, storage, or other charge, fee, or fine incurred for a vehicle deemed to be a derelict vehicle pursuant to section 290-8." SECTION 3. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date. SECTION 4. New statutory material is underscored. SECTION 5. This Act shall take effect upon its approval. INTRODUCED BY: _____________________________
