SENATE CONCURRENT

RESOLUTION

 

 

REQUESTING THE DEPARTMENT OF TRANSPORTATION TO ESTABLISH AND OPERATE A PERSONAL AIRCRAFT FIREWORKS INSPECTION PILOT PROGRAM.

 

 

      WHEREAS, fireworks-related offenses occur all too often within the State; and        WHEREAS, the use of illegal fireworks often causes devastating physical harm to residents; and        WHEREAS, of particular note is the recent mass casualty incident in Aliamanu on December 31, 2024, in which fireworks killed at least six people and injured dozens more; and        WHEREAS, the State must take action to prevent the illegal use of fireworks; and        WHEREAS, diminishing the incoming supply of illegal fireworks is key to preventing the use of those fireworks; and        WHEREAS, nefarious actors sometimes use private, non-commercial aircraft to import illegal fireworks into the State; now, therefore,        BE IT RESOLVED by the Senate of the Thirty-third Legislature of the State of Hawaii, Regular Session of 2025, the House of Representatives concurring, that the Department of Transportation is requested to establish and operate a personal aircraft fireworks inspection pilot program, commencing no later than June 1, 2025, and ending no sooner than January 1, 2026; and        BE IT FURTHER RESOLVED that in conducting the pilot program, the Department of Transportation is requested to coordinate with appropriate:        (1)  Federal, state, or county law enforcement agencies for the inspection of all personal aircraft entering the State and landing at any airport owned or controlled by the department, for the purpose of preventing the unauthorized transportation of fireworks and articles pyrotechnic into the State; and        (2)  Law enforcement agencies or county fire departments to dispose of prohibited fireworks and articles pyrotechnic pursuant to section 132D-26, Hawaii Revised Statutes; and        BE IT FURTHER RESOLVED that the Department of Transportation is requested to submit to the Legislature, no later than January 30, 2026, a report that includes:        (1)  An evaluation of the effectiveness of the pilot program;        (2)  A review of issues that affected the implementation of the pilot program; and        (3)  Any proposed legislation; and        BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Director of Transportation, the Director of Law Enforcement, the chiefs of the county police departments, and the chiefs of the county fire departments.
