  H.F. 2077   DIVISION I 1   SHORT TITLE 2   Section 1. SHORT TITLE. This Act shall be known and may be 3   cited as the Combating Terrorist Sympathizers Act. 4   DIVISION II 5   DECERTIFICATION OF STUDENT ORGANIZATIONS  STUDENT 6   INELIGIBILITY FOR FINANCIAL AID  PUBLIC INSTITUTIONS OF 7   HIGHER EDUCATION 8   Sec. 2. NEW SECTION   . 261J.1 Definitions. 9   As used in this chapter: 10   1. Public institution of higher education means a community 11   college established under chapter 260C or an institution of 12   higher learning governed by the state board of regents. 13   2. Student organization means a group officially 14   recognized at or officially registered by a public institution 15   of higher education, or a group seeking such official 16   recognition or official registration, comprised of students who 17   are admitted and in attendance at the public institution of 18   higher education. 19   Sec. 3. NEW SECTION   . 261J.2 Cancellation of student 20   organization recognition or registration. 21   1. The attorney general shall provide notice to a public 22   institution of higher education and to the state board of 23   regents or the board of directors of a community college, as 24   applicable, within fifteen days after a student organization 25   registered or recognized by the public institution of higher 26   education endorses or promotes any of the following: 27   a. Terrorism.   28   b. The actions of any organization that is designated by 29   the United States secretary of state as a foreign terrorist 30   organization. 31   2. Notwithstanding chapter 261H, a public institution of 32   higher education shall cancel the recognition or registration 33   of a student organization that endorses or promotes any of the 34   following within thirty days after the endorsement or promotion 35   -1-   LSB 5230YH (7) 90   jda/jh   1/ 6    

  H.F. 2077   occurs: 1   a. Terrorism. 2   b. The actions of any organization that is designated by 3   the United States secretary of state as a foreign terrorist 4   organization. 5   3. If a public institution of higher education fails to 6   comply with subsection 2, the attorney general shall bring an 7   action against the public institution of higher education for 8   a writ of mandamus to compel the public institution of higher 9   education to comply with subsection 2. 10   Sec. 4. NEW SECTION   . 261J.3 Students who endorse or 11   promote terrorism or terrorist organizations ineligible for state 12   financial aid. 13   1. The attorney general shall provide notice to a public 14   institution of higher education, the department of education, 15   and to the state board of regents or the board of directors of 16   a community college, as applicable, within fifteen days after a 17   student who attends the public institution of higher education 18   endorses or promotes any of the following: 19   a. Terrorism. 20   b. The actions of any organization that is designated by 21   the United States secretary of state as a foreign terrorist 22   organization. 23   2. A student shall not be eligible to receive any financial 24   aid provided by the public institution of higher education, or 25   any state financial aid, including any financial aid provided 26   under chapter 256, subchapter VII, part 4, in the succeeding 27   fiscal year, or in any subsequent fiscal years, if the attorney 28   general determines that the student has endorsed or promoted 29   any of the following: 30   a. Terrorism. 31   b. The actions of any organization that is designated by 32   the United States secretary of state as a foreign terrorist 33   organization. 34   3.   H.F. 2077   pursuant to subsection 2, the department of education shall 1   provide notice to the student of the students ineligibility. 2   DIVISION III 3   STUDENTS ENROLLED IN PRIVATE INSTITUTIONS OF HIGHER EDUCATION 4    INELIGIBILITY UNDER IOWA TUITION GRANTS PROGRAM 5   Sec. 5. Section 256.184, Code 2024, is amended to read as 6   follows: 7   256.184 Who qualified. 8   A   Subject to section 256.191A, a tuition grant may be awarded 9   to a resident of Iowa who is admitted and in attendance as 10   a full-time or part-time resident student at an accredited 11   private institution and who establishes financial need. 12   Sec. 6. Section 256.191, subsection 1, Code 2024, is amended 13   to read as follows: 14   1. Students qualified. A   Subject to section 256.191A, 15   a tuition grant from moneys appropriated under section 16   256.194, subsection 2 , may be awarded to a resident of Iowa 17   who is admitted and in attendance as a full-time or part-time 18   resident student at an eligible institution and who establishes 19   financial need. 20   Sec. 7. NEW SECTION   . 256.191A Students who endorse or 21   promote terrorism or terrorist organizations ineligible. 22   1. The attorney general shall provide notice to the 23   department of education and an accredited private institution 24   or an eligible institution within fifteen days after a student 25   who attends the accredited private institution or eligible 26   institution endorses or promotes any of the following: 27   a. Terrorism. 28   b. The actions of any organization that is designated by 29   the United States secretary of state as a foreign terrorist 30   organization. 31   2. Notwithstanding any other provision of this subpart to 32   the contrary, a student shall not be eligible to receive grants 33   under this subpart in the succeeding fiscal year, or in any 34   subsequent fiscal years, if the attorney general determines 35   -3-   LSB 5230YH (7) 90   jda/jh   3/ 6

The actions of any organization that is designated by 3   the United States secretary of state as a foreign terrorist 4   organization. 5   3. If a student is ineligible to receive grants under 6   this subpart pursuant to subsection 2, the department of 7   education shall provide notice to the student of the students 8   ineligibility. 9   DIVISION IV 10   EFFECTIVE DATE 11   Sec. 8. EFFECTIVE DATE. This Act, being deemed of immediate 12   importance, takes effect upon enactment. 13   EXPLANATION 14   The inclusion of this explanation does not constitute agreement with 15   the explanations substance by the members of the general assembly. 16   This bill relates to higher education, including requiring 17   the cancellation of the recognition or registration of public 18   institution of higher education student organizations that 19   support or endorse terrorism or certain specified terrorist 20   organizations, prohibiting students enrolled in institutions of 21   higher education who support or endorse terrorism or certain 22   specified terrorist organizations from receiving certain 23   specified forms of financial aid, and modifying the duties of 24   the attorney general. 25   DIVISION I  SHORT TITLE. The bill shall be known and may 26   be cited as the Combating Terrorist Sympathizers Act. 27   DIVISION II  DECERTIFICATION OF STUDENT ORGANIZATIONS    28   PUBLIC INSTITUTIONS OF HIGHER EDUCATION.   H.F. 2077   The division requires a public institution of higher 1   education to cancel the recognition or registration of a 2   student organization that endorses or promotes violence, 3   terrorism, or the actions of any foreign terrorist organization 4   within 30 days after the endorsement or promotion occurs. 5   The division provides that if a public institution of higher 6   education fails to comply with this provision, the attorney 7   general shall bring an action against the public institution of 8   higher education for a writ of mandamus to compel the public 9   institution of higher education to comply. 10   The division requires the attorney general to provide notice 11   to a public institution of higher education, the department of 12   education, and to the state board of regents or the board of 13   directors of a community college, as applicable, within 15 days 14   after a student endorses or promotes terrorism or the actions 15   of any foreign terrorist organization.
