  H.F. 2087   Section 1. Section 321J.20, Code 2024, is amended by adding 1   the following new subsection: 2   NEW SUBSECTION   . 6A. a. Notwithstanding section 321J.17 or 3   any other provision of this chapter to the contrary regarding 4   the length of time a person is required to maintain an ignition 5   interlock device on vehicles owned or operated by the person, 6   if an ignition interlock device detects a violation within 7   thirty days of the date the device would otherwise no longer be 8   required to be installed on vehicles owned or operated by the 9   person, as applicable, the department shall extend the period a 10   person is required to maintain an ignition interlock device for 11   an additional thirty days. The person is responsible for any 12   additional fees associated with the extension. 13   b. The provider of an ignition interlock device that detects 14   a violation under paragraph a shall report the violation to 15   the department prior to the date the device would otherwise 16   no longer be required to be installed on vehicles owned or 17   operated by the person, as applicable. 18   c. Nothing in this subsection shall limit the number 19   of subsequent extensions a person may receive following a 20   violation detected by an ignition interlock device. 21   d. For purposes of this subsection, violation means a 22   detection of a level of alcohol concentration beyond which 23   an ignition interlock device will not allow operation of the 24   motor vehicle in which it is installed, established under 25   rules adopted by the commissioner of public safety pursuant to 26   section 321J.4.   27   EXPLANATION 28   The inclusion of this explanation does not constitute agreement with 29   the explanations substance by the members of the general assembly. 30   Under current law, a person whose drivers license is 31   revoked under Code chapter 321J (operating while intoxicated 32   (OWI)) must install an ignition interlock device (IID) before 33   the department of transportation (DOT) can issue a temporary 34   restricted license, or reinstate a persons unrestricted 35   -1-   LSB 5418YH (3) 90   th/ns 1/ 2   

  H.F. 2087   drivers license if the person has one or more previous OWI 1   violations. 2   This bill requires an IID provider to report a violation, 3   as described in the bill, detected by the IID to the DOT if 4   the violation occurs within the last 30 days the person would 5   otherwise be required to maintain an IID on vehicles owned 6   or operated by the person. The DOT must then extend the 7   requirement for the person to maintain an IID for an additional 8   30 days. The person is responsible for any additional fees 9   associated with the extension. An IID provider must report a 10   violation to the DOT prior to the date the IID would otherwise 11   no longer be required to be installed on vehicles owned or 12   operated by the person. 13   The bill does not limit the number of subsequent extensions a 14   person may receive following a violation detected by an IID. 15   -2-   LSB 5418YH (3) 90   th/ns 2/ 2
