  H.F. _____   Section 1. NEW SECTION . 103A.8D Energy benchmarking 1   requirements. 2   For purposes of this section, energy benchmarking means 3   requiring a decrease in the average energy use of a property or 4   requiring the average energy use of a property to be less than 5   the average energy use of a similarly situated property. The 6   commissioner shall not require energy benchmarking requirements 7   for a private property. 8   Sec. 2. Section 331.301, Code 2023, is amended by adding the 9   following new subsection: 10   NEW SUBSECTION   . 22. For purposes of this subsection, 11   energy benchmarking means requiring a decrease in the average 12   energy use of a property or requiring the average energy 13   use of a property to be less than the average energy use of 14   a similarly situated property. A county shall not adopt 15   or enforce an ordinance, motion, resolution, or amendment 16   to require energy benchmarking requirements for a private 17   property. 18   Sec. 3. Section 414.1, subsection 1, Code 2023, is amended 19   by adding the following new paragraph: 20   NEW PARAGRAPH   . g. For purposes of this paragraph, energy 21   benchmarking means requiring a decrease in the average energy 22   use of a property or requiring the average energy use of a 23   property to be less than the average energy use of a similarly 24   situated property. A city shall not adopt or enforce an 25   ordinance, motion, resolution, or amendment to require energy 26   benchmarking requirements for a private property. 27   EXPLANATION 28   The inclusion of this explanation does not constitute agreement with 29   the explanations substance by the members of the general assembly. 30   This bill prohibits the state building code commissioner, 31   counties, and cities from requiring energy benchmarking 32   requirements for a private property.
