Any moneys and premiums collected by the department 23 for workers compensation shall be segregated into a separate 24 workers compensation fund in the state treasury to be used 25 for payment of state employees workers compensation claims 26 and administrative costs. Notwithstanding section 8.33 , 27 unencumbered or unobligated moneys remaining in this workers 28 compensation fund at the end of the fiscal year shall not 29 revert but shall remain available for expenditure for purposes 30 of the fund in subsequent fiscal years. 31 Sec. 2. REVOLVING FUNDS DEPARTMENT OF ADMINISTRATIVE 32 SERVICES. There is appropriated to the department of 33 administrative services for the fiscal year beginning July 34 1, 2024, and ending June 30, 2025, from the revolving funds 35 -2- SF 2433 (2) 90 sc/ns/mb 2/ 19 S.F. 2433 designated in chapter 8A and from internal service funds 1 created by the department such amounts as the department deems 2 necessary for the operation of the department consistent with 3 the requirements of chapter 8A . 4 Sec. 3. STATE EMPLOYEE HEALTH INSURANCE ADMINISTRATION 5 CHARGE DEPARTMENT OF ADMINISTRATIVE SERVICES. For the 6 fiscal year beginning July 1, 2024, and ending June 30, 2025, 7 the monthly per contract administrative charge which may be 8 assessed by the department of administrative services shall be 9 $2.00 per contract on all health insurance plans administered 10 by the department. 11 Sec. 4. AUDITOR OF STATE. 12 1. The department shall make all of the following 7 information available to the public as part of the departments 8 development efforts to revise the departments internet site: 9 (1) The number of inspections of health facilities 10 conducted by the department annually by type of service 11 provider and type of inspection. 12 (2) The total annual operations budget for the department 13 that is associated with health facilities regulation, including 14 general fund appropriations and federal contract dollars 15 received by type of service provider inspected. 16 (3) The total number of full-time equivalent positions 17 in the department that are associated with health facilities 18 regulation, to include the number of full-time equivalent 19 positions serving in a supervisory capacity, and serving as 20 surveyors, inspectors, or monitors in the field by type of 21 service provider inspected. 22 (4) Identification of state and federal survey trends, 23 cited regulations, the scope and severity of deficiencies 24 identified, and federal and state fines assessed and collected 25 concerning nursing and assisted living facilities and programs. 26 c. It is the intent of the general assembly that the 27 department continuously solicit input from health facilities 28 regulated by the department to assess and improve the 29 departments level of collaboration and to identify new 30 opportunities for cooperation. 31 5. EMPLOYMENT APPEAL BOARD 32 a. However, 16 the fee can be taxed as a cost and paid by the losing party, 17 except in cases where it would impose an undue hardship or be 18 unjust under the circumstances. The moneys generated by the 19 filing fee allowed under this paragraph are appropriated to 20 the department to be used for purposes of administering the 21 division of workers compensation. 22 c. Notwithstanding section 8.33, moneys appropriated in 23 this subsection that remain unencumbered or unobligated at the 24 close of the fiscal year shall not revert but shall remain 25 available for expenditure for the purposes designated until the 26 close of the succeeding fiscal year. 27 10. APPROPRIATION REALLOCATION 34 Notwithstanding section 8.39 , the department of inspections, 35 -8- SF 2433 (2) 90 sc/ns/mb 8/ 19 S.F. 2433 appeals, and licensing, in consultation with the department of 1 management, may reallocate moneys appropriated in this section 2 as necessary to best fulfill the needs of the department 3 provided for in the appropriation. However, the department of 4 inspections, appeals, and licensing shall not reallocate moneys 5 appropriated for labor services or the division of workers 6 compensation. 7 Sec. 8. DEPARTMENT OF INSPECTIONS, APPEALS, AND LICENSING 8 LICENSE OR REGISTRATION FEES. 9 1. For the fiscal year beginning July 1, 2024, and ending 10 June 30, 2025, the department of inspections, appeals, and 11 licensing shall collect any license or registration fees or 12 electronic transaction fees generated during the fiscal year 13 as a result of licensing and registration activities under 14 chapters 99B , 137C , 137D , and 137F . 15 2. From the fees collected by the department under this 16 section on behalf of a municipal corporation with which 17 the department has an agreement pursuant to section 137F.3 , 18 through a statewide electronic licensing system operated by 19 the department, notwithstanding section 137F.6, subsection 2 , 20 the department shall remit the amount of those fees to the 21 municipal corporation for whom the fees were collected less 22 any electronic transaction fees collected by the department to 23 enable electronic payment. 24 3. From the fees collected by the department under this 25 section, other than those fees described in subsection 2, 26 the department shall deposit the amount of $800,000 into the 27 general fund of the state prior to June 30, 2025. 28 4. From the fees collected by the department under this 29 section, other than those fees described in subsections 2 and 30 3, the department shall retain the remainder of the fees for 31 the purposes of enforcing the provisions of chapters 99B , 137C , 32 137D , and 137F . Notwithstanding section 8.33 , moneys retained 33 by the department pursuant to this subsection that remain 34 unencumbered or unobligated at the close of the fiscal year 35 -9- SF 2433 (2) 90 sc/ns/mb 9/ 19 S.F. 2433 shall not revert but shall remain available for expenditure 1 for the purposes of enforcing the provisions of chapters 99B , 2 137C , 137D , and 137F during the succeeding fiscal year. The 3 department shall provide an annual report to the department 4 of management and the legislative services agency on fees 5 billed and collected and expenditures from the moneys retained 6 by the department in a format determined by the department 7 of management in consultation with the legislative services 8 agency. 9 Sec. 9. HOUSING TRUST FUND APPROPRIATION DEPARTMENT OF 10 INSPECTIONS, APPEALS, AND LICENSING.
