There is appropriated from the general fund of the state 4   to the department of justice for the fiscal year beginning July 5   1, 2024, and ending June 30, 2025, the following amounts, or 6   so much thereof as is necessary, to be used for the purposes 7   designated: 8   a. FTEs 228.00 18   As a condition of receiving the appropriation provided 19   in this lettered paragraph, the department of justice shall 20   maintain a record of the estimated time incurred representing 21   each agency or department. 22   The general office of attorney general may temporarily 23   exceed and draw more than the amount appropriated in this 24   lettered paragraph and incur a negative cash balance as long 25   as there are receivables equal to or greater than the negative 26   balances and the amount appropriated in this lettered paragraph 27   is not exceeded at the close of the fiscal year. 28   b.   S.F. 2434   in section 915.94 may be used to provide salary and support 1   of not more than 24.00 full-time equivalent positions and to 2   provide maintenance for the victim compensation functions 3   of the department of justice. In addition to the full-time 4   equivalent positions authorized pursuant to this paragraph, 5   7.00 full-time equivalent positions are authorized and shall 6   be used by the department of justice to employ one accountant 7   and four program planners. The department of justice may 8   employ the additional 7.00 full-time equivalent positions 9   authorized pursuant to this paragraph that are in excess of the 10   number of full-time equivalent positions authorized only if 11   the department of justice receives sufficient federal moneys 12   to maintain employment for the additional full-time equivalent 13   positions during the current fiscal year. The department 14   of justice shall only employ the additional 7.00 full-time 15   equivalent positions in succeeding fiscal years if sufficient 16   federal moneys are received during each of those succeeding 17   fiscal years. 18   The department of justice shall transfer at least $150,000 19   from the victim compensation fund established in section 915.94 20   to the victim assistance grant program established in section 21   13.31. 22   Notwithstanding section 8.33, moneys appropriated in this 23   lettered paragraph that remain unencumbered or unobligated at 24   the close of the fiscal year shall not revert but shall remain 25   available for expenditure for the purposes designated until the 26   close of the succeeding fiscal year. 27   c. The department of justice, in submitting budget 34   estimates for the fiscal year beginning July 1, 2025, pursuant 35   -2-   LSB 5005SV (1) 90   as/ns 2/ 20  

  S.F. 2434   to section 8.23, shall include a report of funding from sources 1   other than amounts appropriated directly from the general fund 2   of the state to the department of justice or to the office of 3   consumer advocate. These funding sources shall include but 4   are not limited to reimbursements from other state agencies, 5   commissions, boards, or similar entities, and reimbursements 6   from special funds or internal accounts within the department 7   of justice. The department of justice shall also report actual 8   reimbursements for the fiscal year beginning July 1, 2023, 9   and actual and expected reimbursements for the fiscal year 10   beginning July 1, 2024. 11   b. The department of justice shall include the report 12   required under paragraph a, as well as information regarding 13   any revisions occurring as a result of reimbursements actually 14   received or expected at a later date, in a report to the 15   general assembly. The department of justice shall submit the 16   report on or before January 15, 2025. 17   3. a. The department of justice shall fully reimburse 18   the costs and necessary related expenses incurred by the Iowa 19   law enforcement academy to continue to employ one additional 20   instructor position who shall provide training for human 21   trafficking-related issues throughout the state. 22   b. The department of justice shall obtain the moneys 23   necessary to reimburse the Iowa law enforcement academy to 24   employ such an instructor from unrestricted moneys from either 25   the victim compensation fund established in section 915.94 or 26   the human trafficking victim fund established in section 915.95 27   or the human trafficking enforcement fund established in 2015 28   Iowa Acts, chapter 138, section 141. 29   Sec. 2. OFFICE OF CONSUMER ADVOCATE. There is appropriated 30   from the commerce revolving fund created in section 546.12 to 31   the office of consumer advocate of the department of justice 32   for the fiscal year beginning July 1, 2024, and ending June 30, 33   2025, the following amount, or so much thereof as is necessary, 34   to be used for the purposes designated: 35   -3-   LSB 5005SV (1) 90   as/ns 3/ 20

DEPARTMENT OF CORRECTIONS  ADMINISTRATION. 3   There is appropriated from the general fund of the state to the 4   department of corrections for the fiscal year beginning July 5   1, 2024, and ending June 30, 2025, the following amounts, or 6   so much thereof as is necessary, to be used for the purposes 7   designated: 8   1. For general administration, including salaries and the 9   adjustment of salaries throughout the department, support, 10   maintenance, employment of an education director to administer 11   a centralized education program for the correctional system, 12   and miscellaneous purposes: 13   . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 7,662,297 14   a. It is the intent of the general assembly that each 15   lease negotiated by the department of corrections with a 16   private corporation for the purpose of providing private 17   industry employment of inmates in a correctional institution 18   shall prohibit the private corporation from utilizing inmate 19   labor for partisan political purposes for any person seeking 20   election to public office in this state and that a violation 21   of this requirement shall result in a termination of the lease 22   agreement. 23   b. It is the intent of the general assembly that as a 24   condition of receiving the appropriation provided in this 25   subsection the department of corrections shall not enter into 26   a lease or contractual agreement pursuant to section 904.809 27   with a private corporation for the use of building space for 28   the purpose of providing inmate employment without providing 29   that the terms of the lease or contract establish safeguards to 30   restrict, to the greatest extent feasible, access by inmates 31   working for the private corporation to personal identifying 32   information of citizens. 33   c. Of the moneys appropriated in this subsection, $586,966 34   is allocated to employ 5.00 additional full-time equivalent 35   -6-   LSB 5005SV (1) 90   as/ns 6/ 20

  S.F. 2434   It is the intent of the general assembly that the seventh 1   judicial district department of correctional services maintains 2   the drug court operated by the district department. 3   h. For the eighth judicial district department of 4   correctional services: 5   . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 10,001,148 6   2. Each judicial district department of correctional 7   services, within the moneys available, shall continue programs 8   and plans established within that district to provide for 9   intensive supervision, sex offender treatment, diversion of 10   low-risk offenders to the least restrictive sanction available, 11   job development, and expanded use of intermediate criminal 12   sanctions. 13   3. Each judicial district department of correctional 14   services shall provide alternatives to prison consistent with 15   chapter 901B. The alternatives to prison shall ensure public 16   safety while providing maximum rehabilitation to the offender. 17   A judicial district department of correctional services may 18   also establish a day program. 19   4. The office of drug control policy of the department 20   of public safety shall consider federal grants made to the 21   department of corrections for the benefit of each of the eight 22   judicial district departments of correctional services as local 23   government grants, as defined pursuant to federal regulations. 24   5. The department of corrections shall continue to contract 25   with a judicial district department of correctional services to 26   provide for the rental of electronic monitoring equipment which 27   shall be available statewide.   28   6. The public safety assessment shall not be utilized in 29   pretrial hearings when determining whether to detain or release 30   a defendant before trial until such time the use of the public 31   safety assessment has been specifically authorized by the 32   general assembly. 33   Sec. 6. DEPARTMENT OF CORRECTIONS  REALLOCATION OF   34   APPROPRIATIONS. Notwithstanding section 8.39, within the 35   -9-   LSB 5005SV (1) 90   as/ns 9/ 20  

  S.F. 2434   moneys appropriated in this division of this Act to the 1   department of corrections, the department may reallocate the 2   moneys appropriated and allocated as necessary to best fulfill 3   the needs of the correctional institutions, administration 4   of the department, and the judicial district departments of 5   correctional services. However, in addition to complying with 6   the requirements of sections 904.116 and 905.8 and providing 7   notice to the legislative services agency, the department 8   of corrections shall also provide notice to the department 9   of management, prior to the effective date of the revision 10   or reallocation of an appropriation made pursuant to this 11   section. The department of corrections shall not reallocate an 12   appropriation or allocation for the purpose of eliminating any 13   program. 14   Sec. 7. INTENT  REPORTS. 15   1. The department of corrections, in cooperation with 16   townships, the Iowa cemetery associations, and other nonprofit 17   or governmental entities, may use inmate labor during the 18   fiscal year beginning July 1, 2024, to restore or preserve 19   rural cemeteries and historical landmarks. The department, in 20   cooperation with the counties, may also use inmate labor to 21   clean up roads, major water sources, and other water sources 22   around the state. 23   2. By January 15, 2025, the department shall provide an 24   annual status report regarding private-sector employment to 25   the general assembly. The report shall include the number 26   of offenders employed in the private sector, the combined 27   number of hours worked by the offenders, the total amount of 28   allowances, and the distribution of allowances pursuant to 29   section 904.702, including any moneys deposited in the general 30   fund of the state. 31   Sec. 8. ELECTRONIC MONITORING REPORT. The department of 32   corrections shall submit a report on electronic monitoring 33   to the general assembly by January 15, 2025. The report 34   shall specifically address the number of persons being 35   -10-   LSB 5005SV (1) 90   as/ns 10/ 20  

  S.F. 2434   electronically monitored and break down the number of persons 1   being electronically monitored by offense committed. The 2   report shall also include a comparison of any data from the 3   prior fiscal year with the current fiscal year. 4   Sec. 9. STATE AGENCY PURCHASES FROM PRISON INDUSTRIES. 5   1. As used in this section, unless the context otherwise 6   requires, state agency means the government of the state 7   of Iowa, including but not limited to all executive branch 8   departments, agencies, boards, bureaus, and commissions, the 9   judicial branch, the general assembly and all legislative 10   agencies, institutions within the purview of the state board of 11   regents, and any corporation whose primary function is to act 12   as an instrumentality of the state. 13   2. State agencies are encouraged to purchase products from 14   Iowa state industries, as defined in section 904.802, when 15   purchases are required and the products are available from 16   Iowa state industries. State agencies shall obtain bids from 17   Iowa state industries for purchases of office furniture during 18   the fiscal year beginning July 1, 2024, exceeding $5,000 or 19   in accordance with applicable administrative rules related to 20   purchases for the agency. 21   Sec. 10. IOWA LAW ENFORCEMENT ACADEMY. 22   1. There is appropriated from the general fund of the 23   state to the Iowa law enforcement academy for the fiscal year 24   beginning July 1, 2024, and ending June 30, 2025, the following 25   amount, or so much thereof as is necessary, to be used for the 26   purposes designated: 27   a.   S.F. 2434   and incur a negative cash balance as long as there are 1   receivables equal to or greater than the negative balance and 2   the amount appropriated in this subsection is not exceeded at 3   the close of the fiscal year. 4   2. The Iowa law enforcement academy may select at least 5   five automobiles of the department of public safety, division 6   of state patrol, prior to turning over the automobiles to 7   the department of administrative services to be disposed 8   of by public auction, and the Iowa law enforcement academy 9   may exchange any automobile owned by the academy for each 10   automobile selected if the selected automobile is used in 11   training law enforcement officers at the academy. However, any 12   automobile exchanged by the academy shall be substituted for 13   the selected vehicle of the department of public safety and 14   sold by public auction with the receipts being deposited in the 15   depreciation fund maintained pursuant to section 8A.365 to the 16   credit of the department of public safety, division of state 17   patrol. 18   3. The Iowa law enforcement academy shall provide training 19   for domestic abuse and human trafficking-related issues 20   throughout the state. The training shall be offered at no 21   cost to the attendees and the training shall not replace any 22   existing domestic abuse or human trafficking training offered 23   by the academy. 24   Sec. 11. STATE PUBLIC DEFENDER. 25   1. There is appropriated from the general fund of the state 26   to the office of the state public defender of the department 27   of inspections, appeals, and licensing for the fiscal year 28   beginning July 1, 2024, and ending June 30, 2025, the following 29   amounts, or so much thereof as is necessary, to be used for the 30   purposes designated: 31   a. The political subdivision may pay for all or a   5   portion of the candidates share of the costs.   6   EXPLANATION 7   The inclusion of this explanation does not constitute agreement with 8   the explanations substance by the members of the general assembly. 9   This bill relates to and makes appropriations to the justice 10   system. The bill is organized in divisions. 11   FY 2024-2025 APPROPRIATIONS. The bill makes appropriations 12   for FY 2024-2025 from the general fund of the state to the 13   departments of justice, corrections, public defense, public 14   safety, and homeland security and emergency management, and 15   the Iowa law enforcement academy, office of the state public 16   defender, and board of parole. 17   The bill appropriates moneys from the commerce revolving 18   fund to the office of consumer advocate of the department 19   of justice; from the gaming enforcement revolving fund to 20   the department of public safety; from the 911 emergency 21   communications fund to the department of homeland security 22   and emergency management; and from the consumer education and 23   litigation fund to the department of justice for farm mediation 24   services and for criminal prosecutions, criminal appeals, and 25   performing certain duties. 26   IOWA LAW ENFORCEMENT ACADEMY. For a basic training course 27   provided to a candidate sponsored by a political subdivision 28   and hired by the political subdivision, current law requires 29   the Iowa law enforcement academy to charge one-third of the 30   cost to the political subdivision, one-third to the candidate, 31   and the remainder to the state.
