| 3 | 3 | H.F. 540 Section 1. Section 321I.14, subsection 3, paragraph b, Code 1 2025, is amended to read as follows: 2 b. Paragraph a does not apply to a person who operates an 3 all-terrain vehicle as part of a farm operation as defined in 4 section 352.2 , or a person who operates an all-terrain vehicle 5 modified to carry no more than one additional person so long 6 as the modification is an aftermarket product or original 7 equipment manufacturer product that is both specifically 8 designed to carry a person as a passenger on the type of 9 all-terrain vehicle to which the product is secured and is 10 manufactured for commercial sale . 11 EXPLANATION 12 The inclusion of this explanation does not constitute agreement with 13 the explanations substance by the members of the general assembly. 14 Under current law, a person is prohibited from operating an 15 all-terrain vehicle (ATV) with more persons on the ATV than 16 the ATV was designed to carry, unless the person is operating 17 an ATV as part of a farm operation. A person who violates 18 this provision commits a simple misdemeanor punishable by a 19 scheduled fine of $135. 20 This bill provides an exception to the ATV passenger limit 21 for a person operating an ATV that is modified to carry no 22 more than one additional person so long as the modification 23 is an aftermarket product or original equipment manufacturer 24 product that is both specifically designed to carry a person as 25 a passenger on the type of ATV to which the product is secured 26 and is manufactured for commercial sale. 27 -1- LSB 2598YH (2) 91 th/ns 1/ 1 |
