33 H.F. 548 Section 1. NEW SECTION . 321H.3A Education program required 1 for certain recyclers. 2 1. Beginning January 1, 2027, a person shall not recycle 3 battery electric motor vehicles or plug-in hybrid electric 4 motor vehicles, as those terms are defined in section 321.116, 5 unless the person is an authorized vehicle recycler who 6 has successfully completed a vehicle high-voltage battery 7 safe handling and storage education program approved by the 8 department. An authorized vehicle recycler shall display a 9 program completion certificate next to the recyclers license 10 displayed as required by section 321H.5. 11 2. The department shall approve vehicle high-voltage 12 battery safe handling and storage education programs and such 13 programs shall award a program completion certificate to an 14 authorized vehicle recycler who successfully completes the 15 program. 16 3. The department shall adopt rules pursuant to chapter 17A 17 to administer this section. 18 EXPLANATION 19 The inclusion of this explanation does not constitute agreement with 20 the explanations substance by the members of the general assembly. 21 Under current law, a person must be licensed by the 22 department of transportation (DOT) as an authorized vehicle 23 recycler to, with respect to vehicles required to be 24 registered, sell certain used parts of more than six used 25 vehicles; dismantle, scrap, recycle, or salvage more than 26 six vehicles; or rebuild or restore for sale more than six 27 wrecked or salvage vehicles in a 12-month period; or with 28 respect to vehicles not currently registered, store more than 29 six vehicles or store damaged vehicles except where such 30 storage is incidental to the primary purpose of the repair of 31 vehicles for others. The licensing requirement does not apply 32 to persons who are educational institutions, licensed as new 33 vehicle dealers, engaged in a hobby not for profit, engaged 34 in the business of purchasing certain parts of vehicles only 35 -1- LSB 2291HV (2) 91 th/ns 1/ 2

55 H.F. 548 for sale as scrap metal, insurance companies, county mutual 1 insurance associations, or state mutual insurance associations. 2 A license issued to a person must be conspicuously displayed at 3 the persons principal place of business except during periods 4 when the license is surrendered for modifications. 5 This bill prohibits a person, beginning January 1, 2027, 6 from recycling battery electric motor vehicles or plug-in 7 hybrid electric motor vehicles unless the person is an 8 authorized vehicle recycler who has successfully completed 9 a vehicle high-voltage battery safe handling and storage 10 education program approved by the DOT and displays a program 11 completion certificate next to the recyclers license. The 12 DOT is required to approve such programs, which must award 13 a program completion certificate to an authorized vehicle 14 recycler who successfully completes the program. The DOT is 15 also required to adopt rules to administer the bill. 16 Battery electric motor vehicle means a motor vehicle 17 equipped with electrical drivetrain components and not 18 equipped with an internal combustion engine, that is propelled 19 exclusively by one or more electrical motors using electrical 20 energy stored in a battery or other energy storage device that 21 can be recharged by plugging into an electrical outlet or 22 electric vehicle charging station. Plug-in hybrid electric 23 motor vehicle means a motor vehicle equipped with electrical 24 drivetrain components, an internal combustion engine, and a 25 battery or other energy storage device that can be recharged by 26 plugging into an electrical outlet or electric vehicle charging 27 station. 28 By operation of law, a person convicted of violating the bill 29 is guilty of a serious misdemeanor. A serious misdemeanor is 30 punishable by confinement for no more than one year and a fine 31 of at least $430 but not more than $2,560. 32 -2- LSB 2291HV (2) 91 th/ns 2/ 2
