Section 709.9, Code 2025, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 3. A person who is eighteen years of age 3 or older commits a serious misdemeanor if the person knowingly 4 sends a picture or video, which the person knows or reasonably 5 should know is unsolicited and unwanted by the recipient, by 6 electronic means depicting any of the following: 7 a. Any persons genitals or pubic area. 8 b. Any person engaging in a sex act, as defined in section 9 702.17. 10 c. The covered genitals of a male person that are in a 11 discernibly turgid state. 12 EXPLANATION 13 The inclusion of this explanation does not constitute agreement with 14 the explanations substance by the members of the general assembly. 15 This bill relates to indecent exposure, including the 16 unlawful electronic transmission of sexually explicit visual 17 material. 18 The bill provides that a person who is 18 years of age or 19 older commits a serious misdemeanor if the person knowingly 20 sends a picture or video, which the person knows or reasonably 21 should know is unsolicited and unwanted by the recipient, by 22 electronic means depicting any of the following: any persons 23 genitals or pubic area; any person engaging in a sex act, as 24 defined in Code section 702.17; or the covered genitals of a 25 male person that are in a discernibly turgid state.
