Section 232.102A, subsection 2, Code 2025, is 1 amended to read as follows: 2 2. Family interactions shall continue regardless of a 3 parents failure to comply with the requirements of a court 4 order or the department , provided there is no finding by 5 a court or the department that such interaction would be 6 detrimental to the child unless a court finds that substantial 7 evidence exists that the family interactions, whether 8 supervised or unsupervised, would pose a serious risk of 9 physical or emotional harm to the child . 10 EXPLANATION 11 The inclusion of this explanation does not constitute agreement with 12 the explanations substance by the members of the general assembly. 13 This bill relates to family interactions (interactions) 14 during an ongoing child in need of assistance (CINA) 15 proceeding. 16 Under current law, interactions during an ongoing CINA 17 proceeding must continue unless a court or the department of 18 health and human services finds that the interactions would 19 be detrimental to a child. The bill requires interactions to 20 continue unless a court finds substantial evidence exists that 21 the interactions, whether supervised or unsupervised, would 22 pose a serious risk of physical or emotional harm to the child. 23 -1- LSB 1691SV (2) 91 dg/ko 1/ 1
