33 S.F. 333 Section 1. Section 321.247, subsection 1, paragraphs a and 1 c, Code 2025, are amended to read as follows: 2 a. Incorporated areas may, upon approval of their governing 3 body, allow A local authority shall not prohibit the operation 4 of golf carts on city streets by persons possessing a valid 5 drivers license. However, a golf cart shall not be operated 6 upon on a city street which is a primary road extension through 7 the city but shall be allowed to cross a city street which is a 8 primary road extension through the city. 9 c. Golf carts operated on city streets shall be equipped 10 with adequate brakes and shall meet any other safety 11 requirements imposed by the governing body of the local 12 authority . 13 EXPLANATION 14 The inclusion of this explanation does not constitute agreement with 15 the explanations substance by the members of the general assembly. 16 Under current law, incorporated areas are authorized to 17 allow the operation of golf carts on city streets by persons 18 possessing a valid drivers license. However, a golf cart is 19 prohibited from being operated on a city street which is a 20 primary road extension through the city but is allowed to cross 21 such a primary road extension. Golf carts are not subject to 22 the vehicle registration requirements under Code chapter 321 23 (motor vehicles and law of the road). 24 This bill prohibits local authorities from prohibiting the 25 operation of golf carts on city streets by persons possessing a 26 valid drivers license. 27 The restrictions on the operation of a golf cart on city 28 streets under current law remain applicable, including that 29 golf carts must be equipped with a slow moving vehicle sign and 30 a bicycle safety flag, must be operated only from sunrise to 31 sunset, and must be equipped with adequate brakes and meet any 32 other safety requirements imposed by the local authority. 33 -1- LSB 2719XS (3) 91 th/ns 1/ 1
