  S.F. 384   Section 1. NEW SECTION . 327G.26 Closed crossing  required 1   notices. 2   1. A railway corporation shall provide notice of a railway 3   crossing closure for repairs or upgrades to the governmental 4   entity that has jurisdiction over the crossing not fewer than 5   thirty days prior to closing the crossing, unless the closure 6   could not reasonably be anticipated thirty days in advance 7   or occurs in the event of an emergency. The notice must 8   include an estimated date by which the repairs or upgrades 9   will be completed. A railway corporation shall also notify 10   the governmental entity as soon as practicable if the repairs 11   or upgrades will be completed after the initial estimated 12   completion date. 13   2. A railway corporation violating this section shall, upon 14   conviction, be guilty of a schedule one penalty under section 15   327C.5. 16   EXPLANATION 17   The inclusion of this explanation does not constitute agreement with 18   the explanations substance by the members of the general assembly. 19   Current law prohibits a railway corporation from closing 20   a railway crossing for more than 30 days for the purpose of 21   repairing or upgrading the crossing, and a corporation that 22   violates Code section 327G.25 is subject to a $100 fine. 23   This bill requires a railway corporation to provide notice 24   of a railway crossing closure for repairs or upgrades to the 25   governmental entity that has jurisdiction over the crossing not 26   fewer than 30 days prior to closing the crossing, unless the 27   closure could not reasonably be anticipated 30 days in advance 28   or in the event of an emergency. The notice must include 29   an estimated date by which the repairs or upgrades will be 30   completed. If the repairs or upgrades will be completed after 31   the initial estimated completion date, the railway corporation 32   is also required to notify the governmental entity as soon as 33   practicable.
