3- S.F. 93 Section 1. Section 35B.3, Code 2025, is amended to read as 1 follows: 2 35B.3 County commission of veteran affairs. 3 1. The county commission of veteran affairs shall consist 4 of either three or five persons, as determined by the board 5 of supervisors, all of whom shall be veterans one of the 6 following: 7 a. A veteran as defined in section 35.1 . 8 b. An Iowa resident who is a current member of the Iowa 9 national guard or an Iowa unit of the reserve forces of the 10 United States, whose service is satisfactory according to a 11 letter of recommendation from the commander of the persons 12 current unit. 13 c. An Iowa resident who is a former member of the Iowa 14 national guard or an Iowa unit of the reserve forces of the 15 United States and was discharged under honorable conditions as 16 evidenced by the persons certificate of release or discharge 17 from active duty, commonly referred to as a DD214, or a letter 18 of recommendation from the commander of the persons last unit. 19 2. If possible, each member of the commission shall be 20 a veteran of have served in a different military branch. 21 However, this qualification does not preclude membership to a 22 veteran who served in more than one branch of the military. 23 Sec. 2. Section 35B.6, subsection 1, paragraph a, Code 2025, 24 is amended to read as follows: 25 a. The members of the commission shall qualify by taking 26 the usual oath of office. The commission shall organize by 27 selecting one of the commission members as chairperson and 28 one as secretary. The commission, subject to the annual 29 approval of the board of supervisors, shall employ an executive 30 director or administrator who shall have the power to employ 31 other necessary employees to carry out the provisions of this 32 chapter , including administrative or clerical assistants, but 33 no member of the commission shall be so employed. If possible, each member of the commission shall be 20 a veteran of have served in a different military branch. 21 However, this qualification does not preclude membership to a 22 veteran who served in more than one branch of the military. 23 EXPLANATION 24 The inclusion of this explanation does not constitute agreement with 25 the explanations substance by the members of the general assembly. 26 Under current law, only a veteran as defined in Code section 27 35.1 can serve on a county commission of veteran affairs. 28 This bill allows an Iowa resident who is a current or former 29 member of the Iowa national guard or an Iowa unit of the 30 reserve forces of the United States whose service is or was 31 satisfactory according to a letter of recommendation from the 32 persons most recent unit commander or who was discharged 33 under honorable conditions to serve on a county commission of 34 veteran affairs. 5- S.F. 93 director or administrator as a county veterans service officer 1 of a veterans service organization recognized pursuant to 38 2 C.F.R. 14.628(c) for the purposes of assisting veterans and 3 their dependents in obtaining federal and state benefits. The 4 commission shall recommend the compensation of the executive 5 director or administrator and all employees of the county 6 veteran affairs office to the board of supervisors. The 7 board of supervisors shall consider the recommendation and 8 shall determine and approve the compensation of the executive 9 director or administrator and all employees of the county 10 veteran affairs office. The executive director must possess 11 the same qualifications as provided in section 35B.3 for 12 commission members shall be a veteran as defined in section 13 35.1 . However, this qualification requirement shall not apply 14 to a person employed as an executive director prior to July 1, 15 1989. 16 -2- SF 93 (2) 91 sc/js/mb 2/ 2
