3 | 3 | S.F. _____ H.F. _____ Section 1. Section 321E.29B, subsection 1, Code 2025, is 1 amended to read as follows: 2 1. Notwithstanding section 321E.8 , the department may issue 3 annual permits for the operation of vehicles or combinations 4 of vehicles transporting fluid milk products to or from a milk 5 plant, receiving station, or transfer station, exceeding the 6 weight limitation of section 321.463 but not exceeding a gross 7 weight of ninety-six one hundred thirty thousand pounds, on 8 primary roads and primary road extensions in cities. 9 Sec. 2. APPLICABILITY. This Act applies on and after 10 the effective date of this Act to fluid milk products annual 11 permits issued on or after that date and to such permits issued 12 prior to that date that are in effect on that date. 13 EXPLANATION 14 The inclusion of this explanation does not constitute agreement with 15 the explanations substance by the members of the general assembly. 16 Under current law, the department of transportation (DOT) 17 is authorized to issue annual permits for the operation 18 of vehicles or combinations of vehicles transporting fluid 19 milk products to or from a milk plant, receiving station, or 20 transfer station while exceeding the weight limitation of Code 21 section 321.463 but not exceeding 20,000 pounds per axle, and 22 not exceeding a gross weight of 96,000 pounds, on primary roads 23 and primary road extensions in cities. The fee for a fluid 24 milk products annual permit is $400. 25 This bill authorizes the DOT to issue fluid milk products 26 annual permits for vehicles not exceeding a gross weight of 27 130,000 pounds. The bill applies to fluid milk products annual 28 permits issued on or after the effective date of the bill and 29 to such permits issued prior to that date that are in effect on 30 that date.
