11	11	1 AN ACT concerning public aid.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Illinois Public Aid Code is amended by
15	15	5 changing Section 5-16.1 as follows:
16	16	6 (305 ILCS 5/5-16.1) (from Ch. 23, par. 5-16.1)
17	17	7 Sec. 5-16.1. Case Management Services. The The Illinois
18	18	8 Department may develop, implement and evaluate a Case
19	19	9 Management Services Program which provides services consistent
20	20	10 with the provisions of this Section, and the Inter-Agency
21	21	11 Agreement between the Department of Healthcare and Family
22	22	12 Services (formerly Department of Public Aid) and the
23	23	13 Department of Public Health, for a targeted population on a
24	24	14 less than Statewide basis in the State of Illinois. The
25	25	15 purpose of this Case Management Services Program shall be to
26	26	16 assist eligible participants in gaining access to needed
27	27	17 medical, social, educational and other services thereby
28	28	18 reducing the likelihood of long-term welfare dependency. The
29	29	19 Case Management Services Program shall have the following
30	30	20 characteristics:
31	31	21 (a) It shall be conducted for a period of no less than
32	32	22 5 consecutive fiscal years in one urban area containing a
33	33	23 high proportion, as determined by Department of Healthcare

69	69	2 records, of Medicaid eligible pregnant or parenting girls
70	70	3 under 17 years of age at the time of the initial assessment
71	71	4 and in one rural area containing a high proportion, as
72	72	5 determined by Department of Healthcare and Family Services
73	73	6 and Department of Public Health records, of Medicaid
74	74	7 eligible pregnant or parenting girls under 17 years of age
75	75	8 at the time of the initial assessment.
76	76	9 (b) Providers participating in the program shall be
77	77	10 paid an amount per patient per month, to be set by the
78	78	11 Illinois Department, for the case management services
79	79	12 provided.
80	80	13 (c) Providers eligible to participate in the program
81	81	14 shall be nurses or social workers, licensed to practice in
82	82	15 Illinois, who comply with the rules and regulations
83	83	16 established by the Illinois Department and the
84	84	17 Inter-Agency Agreement between the Department of
85	85	18 Healthcare and Family Services (formerly Department of
86	86	19 Public Aid) and the Department of Public Health. The
87	87	20 Illinois Department may terminate a provider's
88	88	21 participation in the program if the provider is determined
89	89	22 to have failed to comply with any applicable program
90	90	23 standard or procedure established by the Illinois
91	91	24 Department.
92	92	25 (d) Each eligible participant in an area where the
93	93	26 Case Management Services Program is being conducted may

104	104	1 voluntarily designate a case manager, of her own choosing
105	105	2 to assume responsibility for her care.
106	106	3 (e) A participant may change her designated case
107	107	4 manager provided that she informs the Illinois Department
108	108	5 by the 20th day of the month in order for the change to be
109	109	6 effective in the following month.
110	110	7 (f) The Illinois Department shall, by rule, establish
111	111	8 procedures for providing case management services when the
112	112	9 designated source becomes unavailable or wishes to
113	113	10 withdraw from any obligation as case management services
114	114	11 provider.
115	115	12 (g) In accordance with rules adopted by the Illinois
116	116	13 Department, a participant may discontinue participation in
117	117	14 the program upon timely notice to the Illinois Department,
118	118	15 in which case the participant shall remain eligible for
119	119	16 assistance under all applicable provisions of Article V of
120	120	17 this Code.
121	121	18 The Illinois Department shall take any necessary steps to
122	122	19 obtain authorization or waiver under federal law to implement
123	123	20 a Case Management Services Program. Participation shall be
124	124	21 voluntary for the provider and the recipient.
