1111 1 AN ACT concerning public aid.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Illinois Public Aid Code is amended by
1515 5 changing Section 5-16.1 as follows:
1616 6 (305 ILCS 5/5-16.1) (from Ch. 23, par. 5-16.1)
1717 7 Sec. 5-16.1. Case Management Services. The The Illinois
1818 8 Department may develop, implement and evaluate a Case
1919 9 Management Services Program which provides services consistent
2020 10 with the provisions of this Section, and the Inter-Agency
2121 11 Agreement between the Department of Healthcare and Family
2222 12 Services (formerly Department of Public Aid) and the
2323 13 Department of Public Health, for a targeted population on a
2424 14 less than Statewide basis in the State of Illinois. The
2525 15 purpose of this Case Management Services Program shall be to
2626 16 assist eligible participants in gaining access to needed
2727 17 medical, social, educational and other services thereby
2828 18 reducing the likelihood of long-term welfare dependency. The
2929 19 Case Management Services Program shall have the following
3030 20 characteristics:
3131 21 (a) It shall be conducted for a period of no less than
3232 22 5 consecutive fiscal years in one urban area containing a
3333 23 high proportion, as determined by Department of Healthcare

7171 4 and in one rural area containing a high proportion, as
7272 5 determined by Department of Healthcare and Family Services
7373 6 and Department of Public Health records, of Medicaid
7474 7 eligible pregnant or parenting girls under 17 years of age
7575 8 at the time of the initial assessment.
7676 9 (b) Providers participating in the program shall be
7777 10 paid an amount per patient per month, to be set by the
7878 11 Illinois Department, for the case management services
7979 12 provided.
8080 13 (c) Providers eligible to participate in the program
8181 14 shall be nurses or social workers, licensed to practice in
8282 15 Illinois, who comply with the rules and regulations
8383 16 established by the Illinois Department and the
8484 17 Inter-Agency Agreement between the Department of
8585 18 Healthcare and Family Services (formerly Department of
8686 19 Public Aid) and the Department of Public Health. The
8787 20 Illinois Department may terminate a provider's
8888 21 participation in the program if the provider is determined
8989 22 to have failed to comply with any applicable program
9090 23 standard or procedure established by the Illinois
9191 24 Department.
9292 25 (d) Each eligible participant in an area where the
9393 26 Case Management Services Program is being conducted may

104104 1 voluntarily designate a case manager, of her own choosing
105105 2 to assume responsibility for her care.
106106 3 (e) A participant may change her designated case
107107 4 manager provided that she informs the Illinois Department
108108 5 by the 20th day of the month in order for the change to be
109109 6 effective in the following month.
110110 7 (f) The Illinois Department shall, by rule, establish
111111 8 procedures for providing case management services when the
112112 9 designated source becomes unavailable or wishes to
113113 10 withdraw from any obligation as case management services
114114 11 provider.
115115 12 (g) In accordance with rules adopted by the Illinois
116116 13 Department, a participant may discontinue participation in
117117 14 the program upon timely notice to the Illinois Department,
118118 15 in which case the participant shall remain eligible for
119119 16 assistance under all applicable provisions of Article V of
120120 17 this Code.
121121 18 The Illinois Department shall take any necessary steps to
122122 19 obtain authorization or waiver under federal law to implement
123123 20 a Case Management Services Program. Participation shall be
124124 21 voluntary for the provider and the recipient.
