1 AN ACT concerning public aid.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Public Aid Code is amended by
5 changing Section 10-10.1 as follows:
6 (305 ILCS 5/10-10.1) (from Ch. 23, par. 10-10.1)
7 Sec. 10-10.1. Public Aid Collection Fee. In all cases
8 instituted by the the Illinois Department on behalf of a child
9 or spouse, other than one receiving a grant of financial aid
10 under Article IV, on whose behalf an application has been made
11 and approved for child support enforcement services as
12 provided by Section 10-1, the court shall impose a collection
13 fee on the individual who owes a child or spouse support
14 obligation in an amount equal to 10% of the amount so owed as
15 long as such collection is required by federal law, which fee
16 shall be in addition to the support obligation. The imposition
17 of such fee shall be in accordance with provisions of Title IV,
18 Part D, of the Social Security Act and regulations duly
19 promulgated thereunder. The fee shall be payable to the clerk
20 of the circuit court for transmittal to the Illinois
21 Department and shall continue until child support enforcement
22 services are terminated by the Department.
