11	11	1 AN ACT concerning public aid.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Illinois Public Aid Code is amended by
15	15	5 changing Section 10-10.1 as follows:
16	16	6 (305 ILCS 5/10-10.1) (from Ch. 23, par. 10-10.1)
17	17	7 Sec. 10-10.1. Public Aid Collection Fee. In all cases
18	18	8 instituted by the the Illinois Department on behalf of a child
19	19	9 or spouse, other than one receiving a grant of financial aid
20	20	10 under Article IV, on whose behalf an application has been made
21	21	11 and approved for child support enforcement services as
22	22	12 provided by Section 10-1, the court shall impose a collection
23	23	13 fee on the individual who owes a child or spouse support
24	24	14 obligation in an amount equal to 10% of the amount so owed as
25	25	15 long as such collection is required by federal law, which fee
26	26	16 shall be in addition to the support obligation. The imposition
27	27	17 of such fee shall be in accordance with provisions of Title IV,
28	28	18 Part D, of the Social Security Act and regulations duly
29	29	19 promulgated thereunder. The fee shall be payable to the clerk
30	30	20 of the circuit court for transmittal to the Illinois
31	31	21 Department and shall continue until child support enforcement
32	32	22 services are terminated by the Department.
