1313 1 AN ACT concerning employment.
1414 2 Be it enacted by the People of the State of Illinois,
1515 3 represented in the General Assembly:
1616 4 Section 1. Short title. This Act may be cited as the Wage
1717 5 Insurance Act.
1818 6 Section 5. Definitions. As used in this Act:
1919 7 "Department" means the Department of Employment Security.
2020 8 "Director" means the Director of Employment Security.
2121 9 "Employer" means (1) any person, partnership, corporation,
2222 10 association, or other business entity that employs one or more
2323 11 employees for each working day during each of 20 or more
2424 12 calendar workweeks; and (2) the State of Illinois and any
2525 13 other unit of local government.
2626 14 "Wage insurance benefits" means the benefits payable under
2727 15 this Act.
2828 16 "Tax" means the tax imposed under Section 25 of this Act.
2929 17 Section 10. Wage Insurance Program.
3030 18 (a) The Department shall establish and administer a Wage

3232 20 (b) The Department shall establish procedures and forms

7373 1 pertaining to an employee under this Act is confidential and
7474 2 not open to public inspection, other than to public employees
7575 3 in the performance of their official duties. However, the
7676 4 employee or an authorized representative of an employee may
7777 5 review the records or receive specific information from the
7878 6 records on the presentation of the signed authorization of the
7979 7 employee. An employer or the employer's duly authorized
8080 8 representative may review the records of an employee employed
8181 9 by the employer in connection with a pending claim. At the
8282 10 Department's discretion, other persons may review records when
8383 11 such persons are rendering assistance to the Department at any
8484 12 stage of the proceedings on any matter pertaining to the
8585 13 administration of this Act.
8686 14 An employer must keep at its place of business records of
8787 15 employment from which the information needed by the Department
8888 16 for purposes of this Act may be obtained. The records shall at
8989 17 all times be open to the inspection of the Department pursuant
9090 18 to rules adopted by the Department.
9191 19 (d) The Department shall develop and implement an outreach
9292 20 program to ensure that individuals who may be eligible to
9393 21 receive wage insurance benefits under this Act are made aware
9494 22 of these benefits. Outreach information shall explain, in an
9595 23 easy-to-understand format, eligibility requirements, the
9696 24 claims process, weekly benefit amounts, maximum benefits
9797 25 payable, notice requirements, reinstatement and
9898 26 nondiscrimination rights, confidentiality, and coordination of

109109 1 benefits under this Act and other laws, collective bargaining
110110 2 agreements, and employer policies. Outreach information shall
111111 3 be available in English and in languages other than English
112112 4 that are spoken as a primary language by a significant portion
113113 5 of the State's population, as determined by the Department.
114114 6 Section 15. Eligibility for benefits.
115115 7 (a) Benefits under this Act are payable to an individual
116116 8 who is a claimant under the Unemployment Insurance Act at the
117117 9 time the individual obtains reemployment and who is not
118118 10 employed by the employer from which the individual was last
119119 11 separated.
120120 12 (b) The Department may require that a claim for wage
121121 13 insurance benefits under this Act be supported by a
122122 14 certification of wages issued by the individual's employer.
123123 15 Section 20. Disqualification from benefits.
124124 16 (a) An individual is disqualified from wage insurance
125125 17 benefits under this Act if the individual willfully makes a
126126 18 false statement or misrepresentation regarding a material
127127 19 fact, or willfully fails to disclose a material fact, to
128128 20 obtain benefits.
129129 21 (b) A disqualification for wage insurance benefits is for
130130 22 a period of 2 years, and commences on the first day of the
131131 23 calendar week in which the individual filed a claim for

143143 1 benefits is liable to the Department for a penalty in an amount
144144 2 equal to 15% of the amount of benefits received by the
145145 3 individual.
146146 4 Section 25. Payroll tax.
147147 5 (a) There is imposed a tax upon employees in the amount of
148148 6 0.4% of wages as defined in Section 235 of the Unemployment
149149 7 Insurance Act. The Department shall by rule provide for the
150150 8 collection of this tax.
151151 9 (b) Moneys collected pursuant to subsection (a), and any
152152 10 accrued cash balances, shall be deposited into the Wage
153153 11 Insurance Fund for payment of benefits and the expenditures of
154154 12 the Department in carrying out the functions and duties of the
155155 13 Department under this Act.
156156 14 Section 30. Duration of benefits; amount of benefits.
157157 15 (a) Wage insurance benefits are payable for a maximum of 2
158158 16 years.
159159 17 (b) The first payment of wage insurance benefits shall be
160160 18 made to an employee within 2 weeks after the claim is filed.
161161 19 Subsequent payments shall be made twice a month thereafter.
162162 20 (c) Wage insurance benefits shall be paid in an amount
163163 21 sufficient to pay to the individual the difference between the
164164 22 wage received by the individual at the time of the separation
165165 23 from the employer by which the individual was employed
166166 24 immediately before becoming a claimant under this Act and the

177177 1 wages received by the individual from reemployment.
178178 2 (d) The Department shall provide a tax form to each
179179 3 individual who has received wage insurance benefits for the
180180 4 individual's use in paying federal income tax on the benefits
181181 5 and shall advise an individual filing a new claim for wage
182182 6 insurance benefits, at the time of filing the claim, that:
183183 7 (1) benefits are subject to federal income tax;
184184 8 (2) requirements exist pertaining to estimated tax
185185 9 payments;
186186 10 (3) the individual may elect to have federal income
187187 11 tax deducted and withheld from the individual's payment of
188188 12 benefits at the amount specified in the federal Internal
189189 13 Revenue Code; and
190190 14 (4) the individual is permitted to change a previously
191191 15 elected withholding status.
192192 16 Amounts deducted and withheld from benefits must remain in
193193 17 the Wage Insurance Fund until transferred to the federal
194194 18 taxing authority as a payment of income tax.
195195 19 The Director shall follow all procedures specified by the
196196 20 federal Internal Revenue Service pertaining to the deducting
197197 21 and withholding of income tax.
198198 22 Section 35. Recovery of erroneous payments.
199199 23 (a) If an individual receives any wage insurance benefits
200200 24 under Section 30 to which the employee is not entitled:
201201 25 (1) the individual is liable to the Department for the

212212 1 amount of benefits received; and
213213 2 (2) the amount of benefits received may be deducted by
214214 3 the Department from any future benefits otherwise payable
215215 4 to the individual under Section 30.
216216 5 (b) If the Department decides that an individual has been
217217 6 paid wage insurance benefits to which the individual is not
218218 7 entitled because of an error, and that the individual is not
219219 8 subject to disqualification under Section 20, the amounts
220220 9 received in error may be recovered by the Department only by
221221 10 deductions from benefits otherwise payable to the employee
222222 11 under Section 30 during the 52 weeks following the date on
223223 12 which the order establishing the amount of the erroneous
224224 13 payment becomes final. If amounts determined to be recoverable
225225 14 have not been paid within that time, the liability shall be
226226 15 canceled by the Department and charged against the Wage
227227 16 Insurance Fund.
228228 17 (c) Except as provided in subsection (d), if benefits
229229 18 determined to be recoverable under this Section have not been
230230 19 paid within 3 years after the date that the order of the
231231 20 Department establishing the liability of the individual
232232 21 becomes final, and no payments have been received on the
233233 22 liability for at least 3 months, the liability shall be
234234 23 canceled by the Department and charged against the Wage
235235 24 Insurance Fund.
236236 25 (d) Any amount due under this Section may be collected by
237237 26 the Department in a civil action against the individual

249249 2 (e) Interest on any benefits recoverable under this
250250 3 Section shall be paid and collected at the same time repayment
251251 4 of benefits is made by the individual. Interest on an amount
252252 5 recoverable under this Section accrues at the rate specified
253253 6 in Section 2-1303 of the Code of Civil Procedure, beginning on
254254 7 the first day of the month following 60 days after entry of the
255255 8 order establishing the amount recoverable.
256256 9 (f) Any amount collected under this Section by the
257257 10 Department shall be paid into the Wage Insurance Fund.
258258 11 Section 40. Hearings. A person aggrieved by a decision of
259259 12 the Department under this Act may request a hearing. The
260260 13 Department shall adopt rules governing hearings and the
261261 14 issuance of final orders under this Act in accordance with the
262262 15 provisions of the Illinois Administrative Procedure Act. All
263263 16 final administrative decisions of the Department under this
264264 17 Act are subject to judicial review under the Administrative
265265 18 Review Law.
266266 19 Section 45. Civil penalty.
267267 20 (a) The Department may assess a civil penalty not to
268268 21 exceed $5,000 against an employer that:
269269 22 (1) fails to pay when due the taxes imposed under
270270 23 Section 25; or
271271 24 (2) fails to comply with this Act or any rules adopted

283283 2 requirements necessary to carry out the purposes of this
284284 3 Act.
285285 4 (b) All civil penalties collected under this Section shall
286286 5 be applied first toward reimbursement of the costs incurred in
287287 6 investigating violations, conducting hearings, and assessing
288288 7 and collecting penalties. All remaining amounts shall be paid
289289 8 into the Wage Insurance Fund.
290290 9 Section 50. Unpaid tax.
291291 10 (a) If an employer defaults with respect to any tax
292292 11 payment required to be made by the employer tax under Section
293293 12 25, a person described in subsection (b) of this Section who,
294294 13 as an officer, member, partner, or employee, is under a duty to
295295 14 perform the actions required by employers under this Act shall
296296 15 be personally liable for amounts due under Section 25. More
297297 16 than one person may be jointly and severally liable under this
298298 17 Section.
299299 18 (b) This Section applies only to a person who is one or
300300 19 more of the following:
301301 20 (1) An officer or employee of a corporation.
302302 21 (2) A member or an employee of a limited liability
303303 22 corporation.
304304 23 (3) A partner in or an employee of a limited liability
305305 24 partnership.
306306 25 (c) If the Director determines that an amount is due under

318318 2 to the person liable under this Section mailed to the person's
319319 3 last-known address of record with the Director.
320320 4 Section 55. Wage Insurance Fund. The Wage Insurance Fund
321321 5 is created as a special fund in the State treasury. All moneys
322322 6 received under this Act shall be deposited into the Fund. This
323323 7 Section constitutes a continuing appropriation from the Fund
324324 8 of all amounts necessary for the purposes authorized by this
325325 9 Act. Any interest earned on moneys in the Wage Insurance Fund
326326 10 shall be deposited into the Fund.
327327 11 Section 60. Rules. The Department may adopt any rules
328328 12 necessary to implement this Act.
329329 13 Section 65. Commencement date.
330330 14 (a) Employers shall first withhold taxes from employees'
331331 15 earnings for quarters worked beginning January 1, 2024.
332332 16 (b) Individuals may first file claims for wage insurance
333333 17 benefits under this Act on or after June 1, 2024.
334334 18 Section 70. Authority to contract. The Department may
335335 19 contract or enter into interagency agreements with other State
336336 20 agencies for the initial administration of the Wage Insurance

398398 16 local emergency energy plan ordinance that is adopted
399399 17 under Section 11-21.5-5 of the Illinois Municipal Code.
400400 18 (j) Information and data concerning the distribution
401401 19 of surcharge moneys collected and remitted by carriers
402402 20 under the Emergency Telephone System Act.
403403 21 (k) Law enforcement officer identification information
404404 22 or driver identification information compiled by a law
405405 23 enforcement agency or the Department of Transportation
406406 24 under Section 11-212 of the Illinois Vehicle Code.
407407 25 (l) Records and information provided to a residential
408408 26 health care facility resident sexual assault and death

425425 7 (n) Defense budgets and petitions for certification of
426426 8 compensation and expenses for court appointed trial

428428 10 Capital Crimes Litigation Act. This subsection (n) shall
429429 11 apply until the conclusion of the trial of the case, even
430430 12 if the prosecution chooses not to pursue the death penalty

432432 14 (o) Information that is prohibited from being
433433 15 disclosed under Section 4 of the Illinois Health and
434434 16 Hazardous Substances Registry Act.
435435 17 (p) Security portions of system safety program plans,
436436 18 investigation reports, surveys, schedules, lists, data, or
437437 19 information compiled, collected, or prepared by or for the
438438 20 Department of Transportation under Sections 2705-300 and
439439 21 2705-616 of the Department of Transportation Law of the
440440 22 Civil Administrative Code of Illinois, the Regional
441441 23 Transportation Authority under Section 2.11 of the
442442 24 Regional Transportation Authority Act, or the St. Clair
443443 25 County Transit District under the Bi-State Transit Safety
