12	12	1 AN ACT concerning elections.
13	13	2 Be it enacted by the People of the State of Illinois,
14	14	3 represented in the General Assembly:
15	15	4 Section 5. The Election Code is amended by changing
16	16	5 Section 19-3 and by adding Section 1A-70 as follows:
17	17	6 (10 ILCS 5/1A-70 new)
18	18	7 Sec. 1A-70. Ballot tracking system.
19	19	8 (a) As used in this Section:
20	20	9 "Change in the status" means:
21	21	10 (1) when a trackable ballot is mailed to a voter;
22	22	11 (2) when an election official receives a voted
23	23	12 trackable ballot; and
24	24	13 (3) when a voted trackable ballot is counted.
25	25	14 "Trackable ballot" means a ballot that is:
26	26	15 (1) mailed to a voter in accordance with Article 19;
27	27	16 and
28	28	17 (2) deposited in the mail by a voter in accordance
29	29	18 with Article 19 or deposited in a ballot box by a voter in
30	30	19 accordance with Article 15.
31	31	20 "Voter registration database" means the statewide database
32	32	21 established under Section 1A-45, or any successor statewide
33	33	22 voter registration database established by the State Board of
34	34	23 Elections, the Secretary of State, or both.

71	71	1 (b) The State Board of Elections must develop and maintain
72	72	2 a statewide or locally-based system to track and confirm when
73	73	3 there is a change in the status of a trackable ballot.
74	74	4 (c) The ballot tracking system shall be operational on or
75	75	5 before January 1, 2024.
76	76	6 (d) Beginning January 1, 2024, if a voter elects to
77	77	7 receive electronic notifications regarding the status of the
78	78	8 voter's trackable ballot, the ballot tracking system shall,
79	79	9 when there is a change in the status of the voter's trackable
80	80	10 ballot:
81	81	11 (1) send a text message notification to the voter if
82	82	12 the voter's information in the voter registration database
83	83	13 includes a mobile telephone number;
84	84	14 (2) send an email notification to the voter if the
85	85	15 voter's information in the voter registration database
86	86	16 includes an email address; and
87	87	17 (3) send a notification by another electronic means
88	88	18 allowed by the State Board of Elections.

91	91	21 (a) The application for a vote by mail ballot for a single

214	214	1 (c) However, if application is made for a primary election
215	215	2 ballot, such application shall require the applicant to
216	216	3 designate the name of the political party with which the
217	217	4 applicant is affiliated. The election authority shall allow
218	218	5 any voter on permanent vote by mail status to change his or her
219	219	6 party affiliation for a primary election ballot by a method
220	220	7 and deadline published and selected by the election authority.
221	221	8 (d) If application is made electronically, the applicant
222	222	9 shall mark the box associated with the above described
223	223	10 statement included as part of the online application
224	224	11 certifying that the statements set forth in the application
225	225	12 under subsection (a) or (b) are true and correct, and a
226	226	13 signature is not required.
227	227	14 (e) Any person may produce, reproduce, distribute, or
228	228	15 return to an election authority an application under this
229	229	16 Section. If applications are sent to a post office box
230	230	17 controlled by any individual or organization that is not an
231	231	18 election authority, those applications shall (i) include a
232	232	19 valid and current phone number for the individual or
233	233	20 organization controlling the post office box and (ii) be
234	234	21 turned over to the appropriate election authority within 7
235	235	22 days of receipt or, if received within 2 weeks of the election
236	236	23 in which an applicant intends to vote, within 2 days of
237	237	24 receipt. Failure to turn over the applications in compliance
238	238	25 with this paragraph shall constitute a violation of this Code
239	239	26 and shall be punishable as a petty offense with a fine of $100

250	250	1 per application. Removing, tampering with, or otherwise
251	251	2 knowingly making the postmark on the application unreadable by
252	252	3 the election authority shall establish a rebuttable
253	253	4 presumption of a violation of this paragraph. Upon receipt,
254	254	5 the appropriate election authority shall accept and promptly
255	255	6 process any application under this Section submitted in a form
256	256	7 substantially similar to that required by this Section,
257	257	8 including any substantially similar production or reproduction
258	258	9 generated by the applicant.
259	259	10 (f) An election authority may combine the applications in
260	260	11 subsections (a) and (b) onto one form, but the distinction
261	261	12 between the applications must be clear and the form must
262	262	13 provide check boxes for an applicant to indicate whether he or
263	263	14 she is applying for a single election vote by mail ballot or
264	264	15 for permanent vote by mail status.
265	265	16 (g) Beginning January 1, 2024, the applications under
266	266	17 subsections (a) and (b), or an application under subsection
267	267	18 (f), shall also include the following provision:
268	268	19 "If you have provided a mobile phone number or email
269	269	20 address, you can receive notifications by text message or
270	270	21 email regarding the status of a ballot that is mailed to you
271	271	22 and that you deposit in the mail or in a ballot drop box by
272	272	23 indicating the mobile phone number or email address here:
273	273	24 (insert mobile phone number/email address). By providing your
274	274	25 mobile phone number or email address, you are giving consent
275	275	26 to receive text messages or emails concerning your ballot
