11 103RD GENERAL ASSEMBLY State of Illinois 2023 and 2024 HB1142 Introduced , by Rep. Blaine Wilhour SYNOPSIS AS INTRODUCED: 105 ILCS 5/2-3.196 new Amends the School Code. Requires the State Board of Education to establish and administer a program in which the State Board shall issue a voucher to the parent or guardian of a student, upon request of the parent or guardian, if: (1) the student was enrolled in a school district for a particular school year; (2) during that school year, the school board decided not to provide an option for full-time, in-person instruction at school as the primary method of instruction to students; and (3) the parent or guardian withdrew the student from enrollment in the district because the school board decided not to provide an option for full-time, in-person instruction. Sets forth provisions concerning the voucher amount and its use. Effective immediately. 1111 1 AN ACT concerning education.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The School Code is amended by adding Section
1515 5 2-3.196 as follows:
1616 6 (105 ILCS 5/2-3.196 new)
1717 7 Sec. 2-3.196. Voucher for substituted educational setting.
1818 8 (a) In this Section, "substituted educational setting"
1919 9 includes, but is not limited to, a nonpublic school or a home
2020 10 school.
2121 11 (b) The State Board of Education shall establish and
2222 12 administer a program in which the State Board shall issue a
2323 13 voucher to the parent or guardian of a student, upon request of
2424 14 the parent or guardian, if all of the following conditions are
2525 15 met:
2626 16 (1) The student was enrolled in a school district for
2727 17 a particular school year.
2828 18 (2) During that school year, the school board decided
2929 19 not to provide an option for full-time, in-person
3030 20 instruction at school as the primary method of instruction
3131 21 to students.
3232 22 (3) The parent or guardian withdrew the student from
3333 23 enrollment in the district because the school board

6868 1 decided not to provide an option for full-time, in-person

7070 3 (c) A voucher issued under this Section shall be in an
7171 4 amount equal to the per pupil amount distributed to the school
7272 5 district for the school year under Section 18-18.15 and
7373 6 Article 14, if the student qualifies for services under
7474 7 Article 14, prorated based on the length of time the student
7575 8 was enrolled in the district during the school year. The
7676 9 voucher shall be used to reimburse the parent or guardian for
7777 10 the costs incurred by the parent or guardian to provide the
7878 11 student with in-person instruction in a substituted
7979 12 educational setting.
8080 13 Section 99. Effective date. This Act takes effect upon
