11	11	1 AN ACT concerning agriculture.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Illinois Commercial Feed Act of 1961 is
15	15	5 amended by changing Section 8 as follows:
16	16	6 (505 ILCS 30/8) (from Ch. 56 1/2, par. 66.8)
17	17	7 Sec. 8. Misbranding. A commercial feed or customer-formula
18	18	8 feed is misbranded:
19	19	9 (a) If its labeling is false or misleading in any
20	20	10 particular.
21	21	11 (b) If it is distributed under the name of another
22	22	12 commercial feed.
23	23	13 (c) If it is not labeled as required in Section 5 of this
24	24	14 Act and in regulations prescribed under this Act.
25	25	15 (d) If it purports to be or is represented as a commercial
26	26	16 feed, or if it purports to contain or is represented as
27	27	17 containing a feed ingredient, unless the feed ingredient
28	28	18 conforms to the definition of identity, if any, prescribed by
29	29	19 the Association of American Feed Control Officials, as adopted
30	30	20 in Section 10 of this Act.
31	31	21 (e) If any word, statement or other information required
32	32	22 by or under authority of this Act to appear on the label or
33	33	23 labeling is not prominently placed thereon with such

69	69	2 designs or devices in the labeling) and in such terms as to
70	70	3 render it likely to be read and understood by the ordinary
71	71	4 individual under customary conditions of purchase and use.
72	72	5 (f) In the case of commercial feed that is pet food or
73	73	6 specialty pet food, if the label fails to disclose whether the
74	74	7 pet food contains a major food allergen. As used in this Act,
75	75	8 "major food allergen" has the meaning provided in Section 3.07
76	76	9 of the Food Handling Regulation Enforcement Act.
