1111 1 AN ACT concerning agriculture.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Illinois Commercial Feed Act of 1961 is
1515 5 amended by changing Section 8 as follows:
1616 6 (505 ILCS 30/8) (from Ch. 56 1/2, par. 66.8)
1717 7 Sec. 8. Misbranding. A commercial feed or customer-formula
1818 8 feed is misbranded:
1919 9 (a) If its labeling is false or misleading in any
2020 10 particular.
2121 11 (b) If it is distributed under the name of another
2222 12 commercial feed.
2323 13 (c) If it is not labeled as required in Section 5 of this
2424 14 Act and in regulations prescribed under this Act.
2525 15 (d) If it purports to be or is represented as a commercial
2626 16 feed, or if it purports to contain or is represented as
2727 17 containing a feed ingredient, unless the feed ingredient
2828 18 conforms to the definition of identity, if any, prescribed by
2929 19 the Association of American Feed Control Officials, as adopted
3030 20 in Section 10 of this Act.
3131 21 (e) If any word, statement or other information required
3232 22 by or under authority of this Act to appear on the label or
3333 23 labeling is not prominently placed thereon with such

6868 1 conspicuousness (as compared with other words, statements,
6969 2 designs or devices in the labeling) and in such terms as to
7070 3 render it likely to be read and understood by the ordinary
7171 4 individual under customary conditions of purchase and use.
7272 5 (f) In the case of commercial feed that is pet food or
7373 6 specialty pet food, if the label fails to disclose whether the
7474 7 pet food contains a major food allergen. As used in this Act,
7575 8 "major food allergen" has the meaning provided in Section 3.07
7676 9 of the Food Handling Regulation Enforcement Act.
