3	11		1 AN ACT concerning animals.
4	12		2 Be it enacted by the People of the State of Illinois,
5	13		3 represented in the General Assembly:
6	14		4 Section 5. The Humane Care for Animals Act is amended by
7	15		5 adding Section 3.10 as follows:

9	17		7 Sec. 3.10. Cat declawing.
10	18		8 (a) As used in this Section:
11	19		9 "Declawing" means an onychectomy or any other surgical
12	20		10 procedure to amputate or modify a portion of a cat's paw in
13	21		11 order to remove the cat's claws. This term does not include the
14	22		12 trimming of nonviable claw husk or placing nonpermanent nail
15	23		13 caps.
16	24		14 "Tendonectomy" means a procedure in which the tendons to a
17	25		15 cat's limbs, paws, or toes are cut or modified so that the
18	26		16 normal functioning of the claws is impaired.
19	27		17 "Therapeutic purpose" means a medically necessary
20	28		18 procedure to address an existing or recurring infection,
21	29		19 disease, injury, or abnormal condition in the claws, nail bed,
22	30		20 or toe bone, which jeopardizes the cat's health. "Therapeutic
23	31		21 purpose" does not include a procedure performed for a cosmetic
24	32		22 or aesthetic purpose or to make the cat more convenient to keep
25	33		23 or handle.

34		-	1 (b) Except as otherwise provided in subsection (c), a
35		-	2 person shall not perform surgical claw removal, declawing, or
36		-	3 a tendonectomy on any cat or otherwise alter a cat's toes,

39		-	6 (c) Surgical claw removal, declawing, or a tendonectomy on
40		-	7 any cat or otherwise altering a cat's toes, claws, or paws to
41		-	8 prevent or impair the normal function of the cat's toes,
42		-	9 claws, or paws may only be performed by a veterinarian
43		-	10 licensed under the Veterinary Medicine and Surgery Practice
44		-	11 Act of 2004 for therapeutic purposes for the cat.

	72	+	5 (c) This Section does not apply to a person who performs a
	73	+	6 procedure solely for a therapeutic purpose.
