11	11	1 AN ACT concerning local government.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Counties Code is amended by changing
15	15	5 Section 3-10020 as follows:

17	17	7 Sec. 3-10020. Vacancy. Removal for cause; other vacancy.
18	18	8 If the county treasurer dies or resigns or the office of county
19	19	9 treasurer become vacant for any other reason, If any county
20	20	10 treasurer shall neglect or refuse to render an account, or
21	21	11 make settlement at any time when required by law, or refuse to
22	22	12 answer any question regarding the operation of the county
23	23	13 treasurer's office propounded to him by the county board, or
24	24	14 refuse to provide the county board with any requested
25	25	15 information concerning the accounts maintained by the county
26	26	16 treasurer's office, provided the requests are for information
27	27	17 that the county treasurer is required by law to maintain and in
28	28	18 a format already maintained by the county treasurer, or is a
29	29	19 defaulter, and in arrears with the county, or is guilty of any
30	30	20 other misconduct in his office, the county board may remove
31	31	21 him from office, and the presiding officer of the county
32	32	22 board, with the advice and consent of the county board, may
33	33	23 appoint some suitable person to perform the duties of

68	68	1 treasurer until his successor is elected, or appointed and
69	69	2 qualified; or if by reason of the death or resignation of the
70	70	3 county treasurer, or other cause, the said office shall become
71	71	4 vacant, then the vacancy shall be filled as provided in the The
72	72	5 Election Code by appointment of some suitable person to
73	73	6 perform the duties of treasurer, until a county treasurer is
74	74	7 elected or appointed and qualified. Provided, that in case any
75	75	8 county treasurer is called into the active military service of
76	76	9 the United States, the appointee shall perform and discharge
77	77	10 all the duties of the county treasurer in such county during
78	78	11 the time such county treasurer is in the active military
79	79	12 service of the United States, and such county treasurer so
80	80	13 appointed shall possess all the powers and discharge all the
81	81	14 duties of a regularly elected county treasurer under the laws
82	82	15 of this State, and shall be paid the same compensation as
83	83	16 provided by law for the county treasurer of the county,
84	84	17 apportioned as to the time of service, and such appointment
85	85	18 and all authority thereunder shall cease upon the discharge of
86	86	19 said county treasurer from such active military service of the
87	87	20 United States; and provided further, that the office of county
88	88	21 treasurer shall not be deemed to be vacant during the time the
89	89	22 said county treasurer is in the active military service of the
90	90	23 United States. The person so appointed, shall give bond and
91	91	24 security, as required by law of the county treasurer.
