1111 1 AN ACT concerning local government.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Counties Code is amended by changing
1515 5 Section 3-10020 as follows:

1717 7 Sec. 3-10020. Vacancy. Removal for cause; other vacancy.
1818 8 If the county treasurer dies or resigns or the office of county
1919 9 treasurer become vacant for any other reason, If any county
2020 10 treasurer shall neglect or refuse to render an account, or
2121 11 make settlement at any time when required by law, or refuse to
2222 12 answer any question regarding the operation of the county
2323 13 treasurer's office propounded to him by the county board, or
2424 14 refuse to provide the county board with any requested
2525 15 information concerning the accounts maintained by the county
2626 16 treasurer's office, provided the requests are for information
2727 17 that the county treasurer is required by law to maintain and in
2828 18 a format already maintained by the county treasurer, or is a
2929 19 defaulter, and in arrears with the county, or is guilty of any
3030 20 other misconduct in his office, the county board may remove
3131 21 him from office, and the presiding officer of the county
3232 22 board, with the advice and consent of the county board, may
3333 23 appoint some suitable person to perform the duties of

6868 1 treasurer until his successor is elected, or appointed and
6969 2 qualified; or if by reason of the death or resignation of the
7070 3 county treasurer, or other cause, the said office shall become
7171 4 vacant, then the vacancy shall be filled as provided in the The
7272 5 Election Code by appointment of some suitable person to
7373 6 perform the duties of treasurer, until a county treasurer is
7474 7 elected or appointed and qualified. Provided, that in case any
7575 8 county treasurer is called into the active military service of
7676 9 the United States, the appointee shall perform and discharge
7777 10 all the duties of the county treasurer in such county during
7878 11 the time such county treasurer is in the active military
7979 12 service of the United States, and such county treasurer so
8080 13 appointed shall possess all the powers and discharge all the
8181 14 duties of a regularly elected county treasurer under the laws
8282 15 of this State, and shall be paid the same compensation as
8383 16 provided by law for the county treasurer of the county,
8484 17 apportioned as to the time of service, and such appointment
8585 18 and all authority thereunder shall cease upon the discharge of
8686 19 said county treasurer from such active military service of the
8787 20 United States; and provided further, that the office of county
8888 21 treasurer shall not be deemed to be vacant during the time the
8989 22 said county treasurer is in the active military service of the
9090 23 United States. The person so appointed, shall give bond and
9191 24 security, as required by law of the county treasurer.
