1111 1 AN ACT concerning civil law.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Immigrant Tenant Protection Act is amended
1515 5 by changing Section 10 as follows:

1717 7 Sec. 10. Prohibited conduct.
1818 8 (a) This Section does not prohibit a landlord from
1919 9 complying with any legal obligation under federal, State, or
2020 10 local law, including, but not limited to, any legal obligation
2121 11 under any government program that provides for rent
2222 12 limitations or rental assistance to a qualified tenant or a
2323 13 subpoena, warrant, or other court order.
2424 14 (b) This Section does not prohibit a landlord from
2525 15 requesting information or documentation necessary to determine
2626 16 or verify the financial qualifications of a prospective
2727 17 tenant, so long as the landlord requests the same information
2828 18 or documentation of all prospective tenants regardless of
2929 19 immigration or citizenship status, including requesting a
3030 20 social security number or relevant taxpayer identification
3131 21 number.
3232 22 (b-5) This Section does not prohibit a landlord who is
3333 23 also the tenant's employer from lawfully collecting

7070 3 (c) This Section does not prohibit a landlord from
7171 4 delivering to the tenant an oral or written notice regarding
7272 5 conduct by the tenant that violates, may violate, or has
7373 6 violated an applicable rental agreement, including the lease
7474 7 or any rule, regulation, or law.
7575 8 (d) This Section does not enlarge or diminish a landlord's
7676 9 right to terminate a tenancy pursuant to existing State or
7777 10 local law, nor does this Act enlarge or diminish the ability of
7878 11 a unit of local government to regulate or enforce a
7979 12 prohibition against a landlord's harassment of a tenant.
8080 13 (e) Nothing in this Section prevents a landlord from
8181 14 seeking to collect rent due under the lease agreement.
8282 15 (f) Except as otherwise provided in this Section, a
8383 16 landlord shall not:
8484 17 (1) unless required by law or court order, threaten to
8585 18 disclose or actually disclose information regarding or
8686 19 relating to the immigration or citizenship status of a
8787 20 tenant to any person, entity, or any immigration or law
8888 21 enforcement agency with the intent of harassing or
8989 22 intimidating the tenant, retaliating against the tenant
9090 23 for exercising his or her rights, or influencing the
9191 24 tenant to surrender possession; or
9292 25 (2) unless required by law or court order, bring an
9393 26 action to recover possession of a dwelling unit based

106106 3 (3) demand, request, or collect information regarding

109109 6 (g) Any waiver of a right under this Act by a tenant is
110110 7 void as a matter of public policy.
