11	11	1 AN ACT concerning civil law.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Immigrant Tenant Protection Act is amended
15	15	5 by changing Section 10 as follows:
16	16	6 (765 ILCS 755/10)
17	17	7 Sec. 10. Prohibited conduct.
18	18	8 (a) This Section does not prohibit a landlord from
19	19	9 complying with any legal obligation under federal, State, or
20	20	10 local law, including, but not limited to, any legal obligation
21	21	11 under any government program that provides for rent
22	22	12 limitations or rental assistance to a qualified tenant or a
23	23	13 subpoena, warrant, or other court order.
24	24	14 (b) This Section does not prohibit a landlord from
25	25	15 requesting information or documentation necessary to determine
26	26	16 or verify the financial qualifications of a prospective
27	27	17 tenant, so long as the landlord requests the same information
28	28	18 or documentation of all prospective tenants regardless of
29	29	19 immigration or citizenship status, including requesting a
30	30	20 social security number or relevant taxpayer identification
31	31	21 number.
32	32	22 (b-5) This Section does not prohibit a landlord who is
33	33	23 also the tenant's employer from lawfully collecting

70	70	3 (c) This Section does not prohibit a landlord from
71	71	4 delivering to the tenant an oral or written notice regarding
72	72	5 conduct by the tenant that violates, may violate, or has
73	73	6 violated an applicable rental agreement, including the lease
74	74	7 or any rule, regulation, or law.
75	75	8 (d) This Section does not enlarge or diminish a landlord's
76	76	9 right to terminate a tenancy pursuant to existing State or
77	77	10 local law, nor does this Act enlarge or diminish the ability of
78	78	11 a unit of local government to regulate or enforce a
79	79	12 prohibition against a landlord's harassment of a tenant.
80	80	13 (e) Nothing in this Section prevents a landlord from
81	81	14 seeking to collect rent due under the lease agreement.
82	82	15 (f) Except as otherwise provided in this Section, a
83	83	16 landlord shall not:
84	84	17 (1) unless required by law or court order, threaten to
85	85	18 disclose or actually disclose information regarding or
86	86	19 relating to the immigration or citizenship status of a
87	87	20 tenant to any person, entity, or any immigration or law
88	88	21 enforcement agency with the intent of harassing or
89	89	22 intimidating the tenant, retaliating against the tenant
90	90	23 for exercising his or her rights, or influencing the
91	91	24 tenant to surrender possession; or
92	92	25 (2) unless required by law or court order, bring an
93	93	26 action to recover possession of a dwelling unit based

105	105	2 of a tenant; or
106	106	3 (3) demand, request, or collect information regarding
107	107	4 or relating to the immigration or citizenship status of a
108	108	5 tenant or prospective tenant.
109	109	6 (g) Any waiver of a right under this Act by a tenant is
110	110	7 void as a matter of public policy.
