17 | 17 | | 7 Sec. 5-1101.3. Additional fees to finance new judicial |

18 | 18 | | 8 facilities. The county boards of Kane County, Kankakee County, |

19 | 19 | | 9 Kendall County, Tazewell County, and Will County may, by |

20 | 20 | | 10 ordinance, impose a judicial facilities fee to be used for the |

21 | 21 | | 11 building of new judicial facilities. |

22 | 22 | | 12 (a) In setting such fee, the county board, with the |
---|
23 | 23 | | 13 concurrence of the Chief Judge of the applicable judicial |
---|
24 | 24 | | 14 circuit or the presiding judge of the county in a multi-county |
---|
25 | 25 | | 15 judicial circuit, may impose different rates for the various |
---|
26 | 26 | | 16 types or categories of civil and criminal cases, not to exceed |
---|
27 | 27 | | 17 $30. The fees are to be paid as follows: |

28 | 28 | | 18 (1) In civil cases, the fee shall be paid by each party |
---|
29 | 29 | | 19 at the time of filing the first pleading, paper, or other |
---|
30 | 30 | | 20 appearance; provided that no additional fee shall be |
---|

78 | 78 | | 11 Dependency Act, or Section 10 of the Steroid Control Act. |

79 | 79 | | 12 (3) In local or county ordinance, traffic, and |
---|
80 | 80 | | 13 conservation cases, if fines are paid in full without a |
---|
81 | 81 | | 14 court appearance, then the fee shall not be imposed or |
---|
82 | 82 | | 15 collected. |
---|
83 | 83 | | 16 (b) The proceeds of all fees enacted under this Section |
---|
84 | 84 | | 17 must be deposited into the county's Judicial Department |
---|
85 | 85 | | 18 Facilities Construction Fund and used for the sole purpose of |
---|
86 | 86 | | 19 funding in whole or in part the costs associated with building |
---|
87 | 87 | | 20 new judicial facilities within the county, which shall be |
---|
88 | 88 | | 21 designed and constructed by the county board with the |
---|
89 | 89 | | 22 concurrence of the Chief Judge of the applicable judicial |
---|
90 | 90 | | 23 circuit or the presiding judge of the county in a multi-county |
---|
