1111 1 AN ACT concerning local government.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Counties Code is amended by changing
1515 5 Section 5-1101.3 as follows:
1616 6 (55 ILCS 5/5-1101.3)
1717 7 Sec. 5-1101.3. Additional fees to finance new judicial
1818 8 facilities. The county boards of Kane County, Kankakee County,
1919 9 Kendall County, Tazewell County, and Will County may, by
2020 10 ordinance, impose a judicial facilities fee to be used for the
2121 11 building of new judicial facilities.
2222 12 (a) In setting such fee, the county board, with the
2323 13 concurrence of the Chief Judge of the applicable judicial
2424 14 circuit or the presiding judge of the county in a multi-county
2525 15 judicial circuit, may impose different rates for the various
2626 16 types or categories of civil and criminal cases, not to exceed
2727 17 $30. The fees are to be paid as follows:
2828 18 (1) In civil cases, the fee shall be paid by each party
2929 19 at the time of filing the first pleading, paper, or other
3030 20 appearance; provided that no additional fee shall be
3131 21 required if more than one party is represented in a single
3232 22 pleading, paper, or other appearance.
3333 23 (2) In felony, misdemeanor, local or county ordinance,

6868 1 traffic, and conservation cases, the fee shall be assessed
6969 2 against the defendant upon the entry of a judgment of
7070 3 conviction, an order of supervision, or a sentence of
7171 4 probation without entry of judgment pursuant to Section 10
7272 5 of the Cannabis Control Act, Section 410 of the Illinois
7373 6 Controlled Substances Act, Section 70 of the
7474 7 Methamphetamine Control and Community Protection Act,
7575 8 Section 12-4.3 or subdivision (b)(1) of Section 12-3.05 of
7676 9 the Criminal Code of 1961 or the Criminal Code of 2012,
7777 10 Section 10-102 of the Illinois Alcoholism and Other Drug
7878 11 Dependency Act, or Section 10 of the Steroid Control Act.
7979 12 (3) In local or county ordinance, traffic, and
8080 13 conservation cases, if fines are paid in full without a
8181 14 court appearance, then the fee shall not be imposed or
8282 15 collected.
8383 16 (b) The proceeds of all fees enacted under this Section
8484 17 must be deposited into the county's Judicial Department
8585 18 Facilities Construction Fund and used for the sole purpose of
8686 19 funding in whole or in part the costs associated with building
8787 20 new judicial facilities within the county, which shall be
8888 21 designed and constructed by the county board with the
8989 22 concurrence of the Chief Judge of the applicable judicial
9090 23 circuit or the presiding judge of the county in a multi-county
9191 24 judicial circuit.

9393 26 Section 99. Effective date. This Act takes effect upon
