1414 1 AN ACT concerning civil law.
1515 2 Be it enacted by the People of the State of Illinois,
1616 3 represented in the General Assembly:
1717 4 Section 5. The Common Interest Community Association Act
1818 5 is amended by adding Section 1-71 as follows:
1919 6 (765 ILCS 160/1-71 new)
2020 7 Sec. 1-71. Possession of firearm or firearm ammunition.
2121 8 (a) Unless possession of a firearm or firearm ammunition
2222 9 within a common interest community is prohibited by State or
2323 10 federal law, a unit owner, a tenant or guest of a unit owner,
2424 11 or a guest of a tenant of a unit owner shall not be prohibited
2525 12 from lawfully possessing, carrying, transporting, or storing a
2626 13 firearm, any part of a firearm, or firearm ammunition in:
2727 14 (1) the unit of the unit owner;
2828 15 (2) a vehicle located in a parking area provided for
2929 16 the unit owner or guest of the unit owner by the
3030 17 association; or
3131 18 (3) within a common area, as necessary to:
3232 19 (A) enter or exit the condominium property;
3333 20 (B) enter or exit the unit of the unit owner; or
3434 21 (C) enter or exit a vehicle within the common
3535 22 interest community or located in a parking area

8585 9 (a) Unless possession of a firearm or firearm ammunition
8686 10 on condominium property is prohibited by State or federal law,
8787 11 a unit owner, a tenant or guest of a unit owner, or a guest of
8888 12 a tenant of a unit owner shall not be prohibited from lawfully
8989 13 possessing, carrying, transporting, or storing a firearm, any
9090 14 part of a firearm, or firearm ammunition in:
9191 15 (1) the unit of a unit owner;
9292 16 (2) a vehicle located in a parking area provided for
9393 17 the unit owner or guest of the unit owner by the
9494 18 association; or
9595 19 (3) within a common area, as necessary to:
9696 20 (A) enter or exit the condominium property;
9797 21 (B) enter or exit the unit of a unit owner; or
9898 22 (C) enter or exit a vehicle on the condominium
9999 23 property or located in a parking area provided for the

124124 14 (1) the dwelling unit of the tenant;
125125 15 (2) a vehicle located in a parking area provided for
126126 16 the tenant or guest of the tenant by the landlord; or
127127 17 (3) another location controlled by the landlord, as
128128 18 necessary to:
129129 19 (A) enter or exit the dwelling unit of the tenant;
130130 20 (B) enter or exit the leased premises; or
131131 21 (C) enter or exit a vehicle on the leased premises
132132 22 or located in a parking area provided for the tenant or
133133 23 guest of the tenant by the landlord.

144144 1 Section 20. The Mobile Home Landlord and Tenant Rights Act
145145 2 is amended by adding Section 12b as follows:

147147 4 Sec. 12b. Possession of firearm or firearm ammunition.
148148 5 Unless possession of a firearm or firearm ammunition within a
149149 6 mobile home park or manufactured home community of a park
150150 7 owner is prohibited by State or federal law, a park owner shall
151151 8 not prohibit a tenant or a guest of a tenant from lawfully
152152 9 possessing, carrying, transporting, or storing a firearm, any
153153 10 part of a firearm, or firearm ammunition in:
154154 11 (1) the mobile home unit of the tenant;
155155 12 (2) a vehicle located in a parking area provided for
156156 13 the tenant or guest of the tenant by the park owner; or
157157 14 (3) another location controlled by the park owner, as
158158 15 necessary to:
159159 16 (A) enter or exit the mobile home unit of the
160160 17 tenant;
161161 18 (B) enter or exit the leased premises; or
162162 19 (C) enter or exit a vehicle on the leased premises
163163 20 or located in a parking area provided for the tenant or
164164 21 guest of the tenant by the park owner.
165165 22 Section 99. Effective date. This Act takes effect upon
166166 23 becoming law.
