311 1 AN ACT concerning civil law.
412 2 Be it enacted by the People of the State of Illinois,
513 3 represented in the General Assembly:
614 4 Section 5. The Gender Violence Act is amended by changing
715 5 Section 5 as follows:

9-7 Sec. 5. Definitions. In this Act:
10-8 "Employee" has the meaning provided in Section 2-101 of
11-9 the Illinois Human Rights Act.
12-10 "Employer" has the meaning provided in Section 2-101 of
13-11 the Illinois Human Rights Act.
14-12 "Gender-related violence", which is a form of sex
15-13 discrimination, means the following:
16-14 (1) One or more acts of violence or physical
17-15 aggression satisfying the elements of battery under the
18-16 laws of Illinois that are committed, at least in part, on
19-17 the basis of a person's sex, whether or not those acts have
20-18 resulted in criminal charges, prosecution, or conviction.
21-19 (2) A physical intrusion or physical invasion of a
22-20 sexual nature under coercive conditions satisfying the
23-21 elements of battery under the laws of Illinois, whether or
24-22 not the act or acts resulted in criminal charges,
25-23 prosecution, or conviction.
17+7 Sec. 5. Definition. In this Act, "gender-related
18+8 violence", which is a form of sex discrimination, means the
19+9 following:
20+10 (1) One or more acts of violence or physical
21+11 aggression satisfying the elements of battery under the
22+12 laws of Illinois that are committed, at least in part, on
23+13 the basis of a person's sex, whether or not those acts have
24+14 resulted in criminal charges, prosecution, or conviction.
25+15 (2) A physical intrusion or physical invasion of a
26+16 sexual nature under coercive conditions satisfying the
27+17 elements of battery under the laws of Illinois, whether or
28+18 not the act or acts resulted in criminal charges,
29+19 prosecution, or conviction.
30+20 (2.1) Contact between a sexual organ from which a
31+21 condom has been removed and the intimate part of another
32+22 who did not verbally consent to the condom being removed.
33+23 (2.2) Contact between an intimate part of the person

34-1 (2.1) Sexual contact between a sexual organ of one
35-2 person and the intimate part of another person if, before
36-3 sexual contact, both persons understood and agreed that a
37-4 sexually protective device would be used, and the
38-5 defendant removed the sexually protective device without
39-6 consent of the plaintiff, and they engaged or continued to
40-7 engage in sexual contact after removal.
41-8 (2.2) Sexual contact between a sexual organ of one
42-9 person and the intimate part of another person if, before
43-10 sexual contact, both persons understood and agreed that a
44-11 sexually protective device would be used, and they engaged
45-12 or continued to engage in sexual contact after the
46-13 defendant knew or became aware that the sexually
47-14 protective device had been unintentionally removed but did
48-15 not obtain consent from the plaintiff to engage or
49-16 continue engaging in sexual contact without the use of a
50-17 sexually protective device.
51-18 (2.5) Domestic violence, as defined in the Victims'
52-19 Economic Security and Safety Act.
53-20 (3) A threat of an act described in item (1), (2), or
54-21 (2.5) causing a realistic apprehension that the originator
55-22 of the threat will commit the act.
56-23 "Sexually protective device" means an internal or external
57-24 condom, spermicide, diaphragm, cervical cap, contraceptive
58-25 sponge, dental dam, or any other physical barrier device
59-26 intended to prevent pregnancy or sexually transmitted
