4-AN ACT concerning public employee benefits.
5-Be it enacted by the People of the State of Illinois,
6-represented in the General Assembly:
7-Section 5. The Illinois Pension Code is amended by
8-changing Section 11-196 and by adding Section 12-162.5 as
9-follows:
10-(40 ILCS 5/11-196) (from Ch. 108 1/2, par. 11-196)
11-Sec. 11-196. To subpoena witnesses and compel the
12-production of records. To issue subpoenas to compel the
13-attendance of witnesses to testify before it and to compel the
14-production of documents and records upon any matter concerning
15-the Fund, including, but not limited to, in conjunction with:
16-fund and allow witness fees not in excess of $6 per day.
17-(1) a disability claim;
18-(2) an administrative review proceeding;
19-(3) an attempt to obtain information to assist in the
20-collection of sums due to the Fund;
21-(4) obtaining any and all personal identifying
22-information necessary for the administration of benefits;
23-(5) the determination of the death of a benefit
24-recipient or a potential benefit recipient; or
25-(6) a felony forfeiture investigation.
26-The fees of witnesses for attendance and travel shall be

35-The Board may apply to any circuit court in the State for an
36-order requiring compliance with a subpoena issued under this
37-Section. Subpoenas issued under this Section shall be subject
38-to applicable provisions of the Code of Civil Procedure. The
39-president or other members of the board may administer oaths
40-to witnesses.
