1111 1 AN ACT concerning criminal law.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Criminal Code of 2012 is amended by
1515 5 changing Section 33-1 as follows:
1616 6 (720 ILCS 5/33-1) (from Ch. 38, par. 33-1)
1717 7 Sec. 33-1. Bribery. A person commits bribery when:
1818 8 (a) With intent to influence the performance of any
1919 9 act related to the employment or function of any public
2020 10 officer, public employee, elector of President and
2121 11 Vice-President of the United States, juror or witness, he
2222 12 or she promises or tenders to that person any property or
2323 13 personal advantage which he or she is not authorized by
2424 14 law to accept; or
2525 15 (b) With intent to influence the performance of any
2626 16 act related to the employment or function of any public
2727 17 officer, public employee, elector of President and
2828 18 Vice-President of the United States, juror or witness, he
2929 19 or she promises or tenders to one whom he or she believes
3030 20 to be a public officer, public employee, elector of

6969 2 would not be authorized by law to accept; or
7070 3 (c) With intent to cause any person to influence the
7171 4 performance of any act related to the employment or
7272 5 function of any public officer, public employee, elector
7373 6 of President and Vice-President of the United States,
7474 7 juror or witness, he or she promises or tenders to that
7575 8 person any property or personal advantage which he or she
7676 9 is not authorized by law to accept; or
7777 10 (d) He or she receives, retains or agrees to accept
7878 11 any property or personal advantage which he or she is not
7979 12 authorized by law to accept knowing that the property or
8080 13 personal advantage was promised or tendered with intent to
8181 14 cause him or her to influence the performance of any act
8282 15 related to the employment or function of any public
8383 16 officer, public employee, elector of President and
8484 17 Vice-President of the United States, juror or witness; or
8585 18 (e) He or she solicits, receives, retains, or agrees
8686 19 to accept any property or personal advantage pursuant to
8787 20 an understanding that he or she shall improperly influence
8888 21 or attempt to influence the performance of any act related
8989 22 to the employment or function of any public officer,
9090 23 public employee, elector of President and Vice-President
9191 24 of the United States, juror or witness.
9292 25 As used in this Section, "tenders" means any delivery or
9393 26 proffer made with the requisite intent.
