Provides that any person appointed to fill a vacancy in the United States Senate shall be affiliated with the same political party as the person vacating the office if the person vacating the office was elected as a member of an established political party that is still in existence at the time of appointment. Provides that the appointee shall establish his or her political party affiliation by his or her record of voting in party primary elections or by holding or having held an office in a political party organization before appointment. 1111 1 AN ACT concerning elections.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Election Code is amended by changing
1515 5 Section 25-8 as follows:
1616 6 (10 ILCS 5/25-8) (from Ch. 46, par. 25-8)
1717 7 Sec. 25-8. (a) When a vacancy shall occur in the office of
1818 8 United States Senator from this state, the Governor shall make
1919 9 temporary appointment to fill such vacancy until the next
2020 10 election of representatives in Congress, at which time such
2121 11 vacancy shall be filled by election, and the senator so
2222 12 elected shall take office as soon thereafter as he shall
2323 13 receive his certificate of election.
2424 14 (b) Any person appointed to fill a vacancy under this
2525 15 Section shall be affiliated with the same political party as
2626 16 the person vacating the office if the person vacating the
2727 17 office was elected as a member of an established political
2828 18 party, as defined by Section 10-2, that is still in existence
2929 19 at the time of appointment. The appointee shall establish his
3030 20 or her political party affiliation by his or her record of
3131 21 voting in party primary elections or by holding or having held
3232 22 an office in a political party organization before
3333 23 appointment.
