1111 1 AN ACT concerning corrections.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Unified Code of Corrections is amended by
1515 5 changing Section 3-2.5-15 as follows:
1616 6 (730 ILCS 5/3-2.5-15)
1717 7 Sec. 3-2.5-15. Department of Juvenile Justice; assumption
1818 8 of duties of the Juvenile Division.
1919 9 (a) The The Department of Juvenile Justice shall assume
2020 10 the rights, powers, duties, and responsibilities of the
2121 11 Juvenile Division of the Department of Corrections. Personnel,
2222 12 books, records, property, and unencumbered appropriations
2323 13 pertaining to the Juvenile Division of the Department of
2424 14 Corrections shall be transferred to the Department of Juvenile
2525 15 Justice on the effective date of this amendatory Act of the
2626 16 94th General Assembly. Any rights of employees or the State
2727 17 under the Personnel Code or any other contract or plan shall be
2828 18 unaffected by this transfer.
2929 19 (b) Department of Juvenile Justice personnel who are hired
3030 20 by the Department on or after the effective date of this
3131 21 amendatory Act of the 94th General Assembly and who
3232 22 participate or assist in the rehabilitative and vocational
3333 23 training of delinquent youths, supervise the daily activities

6868 1 involving direct and continuing responsibility for the youth's
6969 2 security, welfare and development, or participate in the
7070 3 personal rehabilitation of delinquent youth by training,
7171 4 supervising, and assisting lower level personnel who perform
7272 5 these duties must be over the age of 21 and have any bachelor's
7373 6 or advanced degree from an accredited college or university.
7474 7 This requirement shall not apply to security, clerical, food
7575 8 service, and maintenance staff that do not have direct and
7676 9 regular contact with youth. The degree requirements specified
7777 10 in this subsection (b) are not required of persons who provide
7878 11 vocational training and who have adequate knowledge in the
7979 12 skill for which they are providing the vocational training.
8080 13 (c) Subsection (b) of this Section does not apply to
8181 14 personnel transferred to the Department of Juvenile Justice on
8282 15 the effective date of this amendatory Act of the 94th General
8383 16 Assembly.
8484 17 (d) The Department shall be under the direction of the
8585 18 Director of Juvenile Justice as provided in this Code.
8686 19 (e) The Director shall organize divisions within the
8787 20 Department and shall assign functions, powers, duties, and
8888 21 personnel as required by law. The Director may create other
8989 22 divisions and may assign other functions, powers, duties, and
9090 23 personnel as may be necessary or desirable to carry out the
9191 24 functions and responsibilities vested by law in the
9292 25 Department. The Director may, with the approval of the Office
9393 26 of the Governor, assign to and share functions, powers,

104104 1 duties, and personnel with other State agencies such that
105105 2 administrative services and administrative facilities are
106106 3 provided by a shared administrative service center. Where
107107 4 possible, shared services which impact youth should be done
108108 5 with child-serving agencies. These administrative services may
109109 6 include, but are not limited to, all of the following
110110 7 functions: budgeting, accounting related functions, auditing,
111111 8 human resources, legal, procurement, training, data collection
112112 9 and analysis, information technology, internal investigations,
113113 10 intelligence, legislative services, emergency response
114114 11 capability, statewide transportation services, and general
115115 12 office support.
116116 13 (f) The Department of Juvenile Justice may enter into
117117 14 intergovernmental cooperation agreements under which minors
118118 15 adjudicated delinquent and committed to the Department of
119119 16 Juvenile Justice may participate in county juvenile impact
120120 17 incarceration programs established under Section 3-6039 of the
121121 18 Counties Code.
122122 19 (g) The Department of Juvenile Justice must comply with
123123 20 the ethnic and racial background data collection procedures
124124 21 provided in Section 4.5 of the Criminal Identification Act.
125125 22 (h) The Department of Juvenile Justice shall implement a
126126 23 wellness program to support health and wellbeing among staff
127127 24 and service providers within the Department of Juvenile
128128 25 Justice environment. The Department of Juvenile Justice shall
129129 26 establish response teams to provide support to employees and

140140 1 staff affected by events that are both duty-related and not
141141 2 duty-related and provide training to response team members.
142142 3 The Department's wellness program shall be accessible to any
143143 4 Department employee or service provider, including contractual
144144 5 employees and approved volunteers. The wellness program may
145145 6 include information sharing, education and activities designed
146146 7 to support health and well-being within the Department's
147147 8 environment. Access to wellness response team support shall be
148148 9 voluntary and remain confidential.
