3	14		1 AN ACT concerning transportation.
4	15		2 Be it enacted by the People of the State of Illinois,
5	16		3 represented in the General Assembly:
6	17		4 Section 5. The Freedom of Information Act is amended by
7	18		5 changing Section 7.5 as follows:
8	19		6 (5 ILCS 140/7.5)
9	20		7 Sec. 7.5. Statutory exemptions. To the extent provided for
10	21		8 by the statutes referenced below, the following shall be
11	22		9 exempt from inspection and copying:
12	23		10 (a) All information determined to be confidential
13	24		11 under Section 4002 of the Technology Advancement and
14	25		12 Development Act.
15	26		13 (b) Library circulation and order records identifying
16	27		14 library users with specific materials under the Library
17	28		15 Records Confidentiality Act.
18	29		16 (c) Applications, related documents, and medical
19	30		17 records received by the Experimental Organ Transplantation
20	31		18 Procedures Board and any and all documents or other
21	32		19 records prepared by the Experimental Organ Transplantation
22	33		20 Procedures Board or its staff relating to applications it
23	34		21 has received.

400	443		11 (b) Images from the cameras may be extracted by any
401	444		12 authorized user and used by any municipal police department,
402	445		13 county sheriff's office, State Police officer, or other law
403	446		14 enforcement agency with jurisdiction in the investigation of
404	447		15 any offenses involving vehicular hijacking, aggravated
405	448		16 vehicular hijacking, terrorism, motor vehicle theft, or any
406	449		17 forcible felony, including, but not limited to, offenses
407	450		18 involving the use of a firearm; to detect expressway hazards
408	451		19 and highway conditions; and to facilitate highway safety and
409	452		20 incident management. Images from the cameras shall not be used
410	453		21 to enforce petty offenses or offenses not listed in this
411	454		22 subsection, unless use of the images pertains to expressway or
412	455		23 highway safety or hazards. Images from the cameras may be used
413	456		24 by any law enforcement agency conducting an active law
414	457		25 enforcement investigation. All images from the cameras shall
415	458		26 be deleted within 120 days, unless the images are relevant to

435	478		10 (1) the cost of installation of cameras by county;
436	479		11 (2) the cost of ongoing maintenance of the camera
437	480		12 systems per county, including electrical costs and data
438	481		13 transfer costs;
439	482		14 (3) the number of inquiries where the investigation
440	483		15 involved the criminal offenses outlined in subsection (b);
441	484		16 and
442	485		17 (4) the number of incidents in which law enforcement
443	486		18 searched the stored data for the criminal offenses
444	487		19 outlined in subsection (b).
445	488		20 (c) Subject to appropriation, any funds needed to conduct
446	489		21 the program for use on the expressways or State highway system
447	490		22 under the jurisdiction of the Department of Transportation
448	491		23 shall be taken from the Road Fund and shall be included in
449	492		24 requests for qualification processes. Any funds needed to
450	493		25 conduct the program for use on expressways under the
451	494		26 jurisdiction of the Illinois State Toll Highway Authority
