314 1 AN ACT concerning transportation.
415 2 Be it enacted by the People of the State of Illinois,

617 4 Section 5. The Freedom of Information Act is amended by

400443 11 (b) Images from the cameras may be extracted by any
401444 12 authorized user and used by any municipal police department,
402445 13 county sheriff's office, State Police officer, or other law
403446 14 enforcement agency with jurisdiction in the investigation of
404447 15 any offenses involving vehicular hijacking, aggravated
405448 16 vehicular hijacking, terrorism, motor vehicle theft, or any
406449 17 forcible felony, including, but not limited to, offenses
407450 18 involving the use of a firearm; to detect expressway hazards
408451 19 and highway conditions; and to facilitate highway safety and
409452 20 incident management. Images from the cameras shall not be used
410453 21 to enforce petty offenses or offenses not listed in this
411454 22 subsection, unless use of the images pertains to expressway or
412455 23 highway safety or hazards. Images from the cameras may be used
413456 24 by any law enforcement agency conducting an active law
414457 25 enforcement investigation. All images from the cameras shall
415458 26 be deleted within 120 days, unless the images are relevant to

427470 2 shall not be used to monitor individuals or groups in a
428471 3 discriminatory manner contrary to applicable State or federal

430473 5 (b-5) By June 30th of each year, the Illinois State
431474 6 Police, the Illinois Department of Transportation, and the
432475 7 Illinois State Toll Highway Authority shall issue a joint
433476 8 report to the General Assembly detailing the program
434477 9 operations, including, but not limited to:
435478 10 (1) the cost of installation of cameras by county;
436479 11 (2) the cost of ongoing maintenance of the camera
437480 12 systems per county, including electrical costs and data
438481 13 transfer costs;
439482 14 (3) the number of inquiries where the investigation
440483 15 involved the criminal offenses outlined in subsection (b);
441484 16 and
442485 17 (4) the number of incidents in which law enforcement
443486 18 searched the stored data for the criminal offenses
444487 19 outlined in subsection (b).
445488 20 (c) Subject to appropriation, any funds needed to conduct
446489 21 the program for use on the expressways or State highway system
447490 22 under the jurisdiction of the Department of Transportation
448491 23 shall be taken from the Road Fund and shall be included in
449492 24 requests for qualification processes. Any funds needed to
450493 25 conduct the program for use on expressways under the
451494 26 jurisdiction of the Illinois State Toll Highway Authority
