4-AN ACT concerning safety.
5-Be it enacted by the People of the State of Illinois,
6-represented in the General Assembly:
7-Section 5. The Radiation Protection Act of 1990 is amended
8-by changing Section 6 as follows:
9-(420 ILCS 40/6) (from Ch. 111 1/2, par. 210-6)
10-(Section scheduled to be repealed on January 1, 2027)
11-Sec. 6. Accreditation of administrators of radiation;
12-Limited scope accreditation; Rules and regulations; Education.
13-(a) The Agency shall promulgate such rules and regulations
14-as are necessary to establish accreditation standards and
15-procedures, including a minimum course of education and
16-continuing education requirements in the administration of
17-radiation to human beings, which are appropriate to the
18-classification of accreditation and which are to be met by all
19-physician assistants, advanced practice registered nurses,
20-nurses, technicians, or other assistants who administer
21-radiation to human beings under the supervision of a person
22-licensed under the Medical Practice Act of 1987. Such rules
23-and regulations may provide for different classes of
24-accreditation based on evidence of national certification,
25-clinical experience or community hardship as conditions of
26-initial and continuing accreditation. The rules and

4+2 Be it enacted by the People of the State of Illinois,

12+10 (a) The Agency shall promulgate such rules and regulations

34-standards in regard to the protection of the health and safety
35-of the general public.
36-(b) The rules and regulations shall also provide that
37-persons who have been accredited by the Agency, in accordance
38-with the Radiation Protection Act, without passing an
39-examination, will remain accredited as provided in Section 43
40-of this Act and that those persons may be accredited, without
41-passing an examination, to use other equipment, procedures, or
42-supervision within the original category of accreditation if
43-the Agency receives written assurances from a person licensed
44-under the Medical Practice Act of 1987, that the person
45-accredited has the necessary skill and qualifications for such
46-additional equipment procedures or supervision. The Agency
47-shall, in accordance with subsection (c) of this Section,
48-provide for the accreditation of nurses, technicians, or other
49-assistants, unless exempted elsewhere in this Act, to perform
50-a limited scope of diagnostic radiography procedures of the
51-chest, the extremities, skull and sinuses, or the spine, while
52-under the supervision of a person licensed under the Medical
53-Practice Act of 1987.
54-(c) The rules or regulations promulgated by the Agency
55-pursuant to subsection (a) shall establish standards and
56-procedures for accrediting persons to perform a limited scope
57-of diagnostic radiography procedures. The rules or regulations
58-shall specify that an individual seeking accreditation for

34+1 regulations of the Agency shall be consistent with national

37+4 (b) The rules and regulations shall also provide that

55+22 (c) The rules or regulations promulgated by the Agency
56+23 pursuant to subsection (a) shall establish standards and
57+24 procedures for accrediting persons to perform a limited scope
58+25 of diagnostic radiography procedures. The rules or regulations
59+26 shall specify that an individual seeking accreditation for

61-limited diagnostic radiography shall not apply ionizing
62-radiation to human beings until the individual has passed an
63-Agency-approved examination and is accredited by the Agency.
64-The rules or regulations shall require persons seeking limited
65-scope accreditation to register with the Agency as a
66-"student-in-training," and declare those procedures in which
67-the student will be receiving training. The
68-student-in-training registration shall be valid for a period
69-of 16 months, during which the time the student may, under the
70-supervision of a person licensed under the Medical Practice
71-Act of 1987, perform the diagnostic radiography procedures
72-listed on the student's registration. The student-in-training
73-registration shall be nonrenewable.
74-For an individual Upon expiration of the 16 month training
75-period, the student shall be prohibited from performing
76-diagnostic radiography procedures unless accredited by the
77-Agency to perform such procedures. In order to be accredited
78-to perform a limited scope of diagnostic radiography
79-procedures, he or she an individual must pass an examination
80-approved offered by the Agency. The examination shall be
81-consistent with national standards in regard to protection of
82-public health and safety. The examination shall consist of a
83-standardized component covering general principles applicable
84-to diagnostic radiography procedures and a clinical component
85-specific to the types of procedures for which accreditation is
86-being sought. The Agency may assess a reasonable fee for such

89-examinations to cover any the costs incurred by the Agency in
90-conjunction with offering the examinations.
91-(d) The Agency shall by rule or regulation exempt from
92-accreditation physician assistants, advanced practice
93-registered nurses, nurses, technicians, or other assistants
94-who administer radiation to human beings under supervision of
95-a person licensed to practice under the Medical Practice Act
96-of 1987 when the services are performed on employees of a
97-business at a medical facility owned and operated by the
98-business. Such exemption shall only apply to the equipment,
99-procedures and supervision specific to the medical facility
100-owned and operated by the business.
