11	11	1 AN ACT concerning transportation.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Toll Highway Act is amended by changing
15	15	5 Section 19 as follows:

17	17	7 Sec. 19. Toll rates. The Authority shall fix and revise
18	18	8 from time to time, tolls or charges or rates for the privilege
19	19	9 of using each of the toll highways constructed pursuant to
20	20	10 this Act. Such tolls shall be so fixed and adjusted at rates
21	21	11 calculated to provide the lowest reasonable toll rates that
22	22	12 will provide funds sufficient with other revenues of the
23	23	13 Authority to pay, (a) the cost of the construction of a toll
24	24	14 highway authorized by joint resolution of the General Assembly
25	25	15 pursuant to Section 14.1 and the reconstruction, major repairs
26	26	16 or improvements of toll highways, (b) the cost of maintaining,
27	27	17 repairing, regulating and operating the toll highways
28	28	18 including only the necessary expenses of the Authority, and
29	29	19 (c) the principal of all bonds, interest thereon and all
30	30	20 sinking fund requirements and other requirements provided by
31	31	21 resolutions authorizing the issuance of the bonds as they
32	32	22 shall become due. In fixing the toll rates pursuant to this
33	33	23 Section 19 and Section 10(c) of this Act, the Authority shall

68	68	1 take into account the effect of the provisions of this Section
69	69	2 19 permitting the use of the toll highway system without
70	70	3 payment of the covenants of the Authority contained in the
71	71	4 resolutions and trust indentures authorizing the issuance of
72	72	5 bonds of the Authority. No such provision permitting the use
73	73	6 of the toll highway system without payment of tolls after the
74	74	7 date of this amendatory Act of the 95th General Assembly shall
75	75	8 be applied in a manner that impairs the rights of bondholders
76	76	9 pursuant to any resolution or trust indentures authorizing the
77	77	10 issuance of bonds of the Authority. The use and disposition of
78	78	11 any sinking or reserve fund shall be subject to such
79	79	12 regulation as may be provided in the resolution or trust
80	80	13 indenture authorizing the issuance of the bonds. Subject to
81	81	14 the provisions of any resolution or trust indenture
82	82	15 authorizing the issuance of bonds any moneys in any such
83	83	16 sinking fund in excess of an amount equal to one year's
84	84	17 interest on the bonds then outstanding secured by such sinking
85	85	18 fund may be applied to the purchase or redemption of bonds. All
86	86	19 such bonds so redeemed or purchased shall forthwith be
87	87	20 cancelled and shall not again be issued. No person shall be
88	88	21 permitted to use any toll highway without paying the toll
89	89	22 established under this Section except: (i) when on official
90	90	23 Toll Highway Authority business which includes police and
91	91	24 other emergency vehicles; or (ii) for a vehicle displaying a
92	92	25 Purple Heart special registration license plate issued under
93	93	26 Section 3-623 of the Illinois Vehicle Code, on August 7 of each

104	104	1 year, the designated Purple Heart Day. However, any law
105	105	2 enforcement agency vehicle, fire department vehicle, public or
106	106	3 private ambulance service vehicle engaged in the performance
107	107	4 of an emergency service or duty that necessitates the use of
108	108	5 the toll highway system, or other emergency vehicle that is
109	109	6 plainly marked shall not be required to pay a toll to use a
110	110	7 toll highway. A law enforcement, fire protection, or emergency
111	111	8 services officer driving a law enforcement, fire protection,
112	112	9 emergency services agency vehicle, or public or private
113	113	10 ambulance service vehicle engaging in the performance of
114	114	11 emergency services or duties that is not plainly marked must
115	115	12 present an Official Permit Card which the law enforcement,
116	116	13 fire protection, or emergency services officer receives from
117	117	14 his or her law enforcement, fire protection, emergency
118	118	15 services agency, or public or private ambulance service in
119	119	16 order to use a toll highway without paying the toll. A law
120	120	17 enforcement, fire protection, emergency services agency, or
121	121	18 public or private ambulance service engaging in the
122	122	19 performance of emergency services or duties must apply to the
123	123	20 Authority to receive a permit, and the Authority shall adopt
124	124	21 rules for the issuance of a permit, that allows public or
125	125	22 private ambulance service vehicles engaged in the performance
126	126	23 of emergency services or duties that necessitate the use of
127	127	24 the toll highway system and all law enforcement, fire
128	128	25 protection, or emergency services agency vehicles of the law

140	140	1 use any toll highway without paying the toll established under
141	141	2 this Section. The Authority shall maintain in its office a
142	142	3 list of all persons that are authorized to use any toll highway
143	143	4 without charge when on official business of the Authority and
144	144	5 such list shall be open to the public for inspection. In
145	145	6 recognition of the unique role of public transportation in
146	146	7 providing effective transportation in the Authority's service
147	147	8 region, and to give effect to the exemption set forth in
148	148	9 subsection (b) of Section 2.06 of the Regional Transportation
149	149	10 Authority Act, the following vehicles may use any toll highway
150	150	11 without paying the toll: (1) a vehicle owned or operated by the
151	151	12 Suburban Bus Division of the Regional Transportation Authority
152	152	13 that is being used to transport passengers for hire; and (2)
153	153	14 any revenue vehicle that is owned or operated by a Mass Transit
154	154	15 District created under Section 3 of the Local Mass Transit
155	155	16 District Act and running regular scheduled service.
156	156	17 Among other matters, this amendatory Act of 1990 is
157	157	18 intended to clarify and confirm the prior intent of the
158	158	19 General Assembly to allow toll revenues from the toll highway
159	159	20 system to be used to pay a portion of the cost of the
160	160	21 construction of the North-South Toll Highway authorized by
161	161	22 Senate Joint Resolution 122 of the 83rd General Assembly in
162	162	23 1984.
