1111 1 AN ACT concerning local government.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Illinois Municipal Code is amended by
1515 5 adding Section 11-1-15 as follows:
1616 6 (65 ILCS 5/11-1-15 new)
1717 7 Sec. 11-1-15. Automated camera enforcement system data
1818 8 sharing.
1919 9 (a) As used in this Section:
2020 10 "Automated railroad grade crossing enforcement system" has
2121 11 the meaning given to that term in Section 11-1201.1 of the
2222 12 Illinois Vehicle Code.
2323 13 "Automated speed enforcement system" has the meaning given
2424 14 to that term in Section 11-208.8 of the Illinois Vehicle Code.
2525 15 "Automated traffic law enforcement system" has the
2626 16 meanings given to that term in Sections 11-208.6 and 11-208.9
2727 17 of the Illinois Vehicle Code.
2828 18 (b) A municipality that uses an automated railroad grade
2929 19 crossing enforcement system, automated speed enforcement
3030 20 system, or automated traffic law enforcement system must share
3131 21 any data collected by the system or systems with the Illinois
3232 22 State Police or a municipal law enforcement agency upon the
3333 23 request of the Illinois State Police or municipal law

6969 2 (c) A municipality may not enter into, modify, or extend a
7070 3 contract that would prohibit the release of information under
7171 4 subsection (b).
7272 5 (d) A home rule municipality may not regulate an automated
7373 6 railroad grade crossing enforcement system, automated speed
7474 7 enforcement system, or automated traffic law enforcement
7575 8 system in a manner inconsistent with this Section. This
7676 9 Section is a limitation under subsection (i) of Section 6 of
7777 10 Article VII of the Illinois Constitution on the concurrent
7878 11 exercise by home rule units of powers and functions exercised
7979 12 by the State.
