1414 1 AN ACT concerning education.
1515 2 Be it enacted by the People of the State of Illinois,
1616 3 represented in the General Assembly:
1717 4 Section 5. The School Code is amended by changing Sections
1818 5 10-22.24b and 34-18 as follows:

2020 7 Sec. 10-22.24b. School counseling services. School
2121 8 counseling services in public schools may be provided by
2222 9 school counselors as defined in Section 10-22.24a of this Code
2323 10 or by individuals who hold a Professional Educator License
2424 11 with a school support personnel endorsement in the area of
2525 12 school counseling under Section 21B-25 of this Code.
2626 13 School counseling services may include, but are not
2727 14 limited to:
2828 15 (1) designing and delivering a comprehensive school
2929 16 counseling program that promotes student achievement and
3030 17 wellness;
3131 18 (2) incorporating the common core language into the
3232 19 school counselor's work and role;
3333 20 (3) school counselors working as culturally skilled
3434 21 professionals who act sensitively to promote social
3535 22 justice and equity in a pluralistic society;

137137 23 (19) using culturally sensitive culturally-sensitive
138138 24 skills in working with all students to promote wellness;
139139 25 (20) addressing the needs of undocumented students in

387387 21 Nothing in this Section prohibits other qualified
388388 22 professionals, including other endorsed school support
389389 23 personnel, from providing the services listed in this Section.

403403 2 Sec. 34-18. Powers of the board. The board shall exercise
404404 3 general supervision and jurisdiction over the public education
405405 4 and the public school system of the city, and, except as
406406 5 otherwise provided by this Article, shall have power:
407407 6 1. To make suitable provision for the establishment
408408 7 and maintenance throughout the year or for such portion
409409 8 thereof as it may direct, not less than 9 months and in
410410 9 compliance with Section 10-19.05, of schools of all grades
411411 10 and kinds, including normal schools, high schools, night
412412 11 schools, schools for defectives and delinquents, parental
413413 12 and truant schools, schools for the blind, the deaf, and
414414 13 persons with physical disabilities, schools or classes in
415415 14 manual training, constructural and vocational teaching,
416416 15 domestic arts, and physical culture, vocation and
417417 16 extension schools and lecture courses, and all other
418418 17 educational courses and facilities, including
419419 18 establishing, equipping, maintaining and operating
420420 19 playgrounds and recreational programs, when such programs
421421 20 are conducted in, adjacent to, or connected with any
422422 21 public school under the general supervision and
423423 22 jurisdiction of the board; provided that the calendar for
424424 23 the school term and any changes must be submitted to and
425425 24 approved by the State Board of Education before the
426426 25 calendar or changes may take effect, and provided that in
427427 26 allocating funds from year to year for the operation of

438438 1 all attendance centers within the district, the board
439439 2 shall ensure that supplemental general State aid or
440440 3 supplemental grant funds are allocated and applied in
441441 4 accordance with Section 18-8, 18-8.05, or 18-8.15. To
442442 5 admit to such schools without charge foreign exchange
443443 6 students who are participants in an organized exchange
444444 7 student program which is authorized by the board. The
445445 8 board shall permit all students to enroll in
446446 9 apprenticeship programs in trade schools operated by the
447447 10 board, whether those programs are union-sponsored or not.
448448 11 No student shall be refused admission into or be excluded
449449 12 from any course of instruction offered in the common
450450 13 schools by reason of that student's sex. No student shall
451451 14 be denied equal access to physical education and
452452 15 interscholastic athletic programs supported from school
453453 16 district funds or denied participation in comparable
454454 17 physical education and athletic programs solely by reason
455455 18 of the student's sex. Equal access to programs supported
456456 19 from school district funds and comparable programs will be
457457 20 defined in rules promulgated by the State Board of
458458 21 Education in consultation with the Illinois High School
459459 22 Association. Notwithstanding any other provision of this
460460 23 Article, neither the board of education nor any local
461461 24 school council or other school official shall recommend
462462 25 that children with disabilities be placed into regular

474474 1 disabilities are provided with supplementary services to
475475 2 assist them so that they benefit from the regular
476476 3 classroom instruction and are included on the teacher's
477477 4 regular education class register;
478478 5 2. To furnish lunches to pupils, to make a reasonable
479479 6 charge therefor, and to use school funds for the payment
480480 7 of such expenses as the board may determine are necessary
481481 8 in conducting the school lunch program;
482482 9 3. To co-operate with the circuit court;
483483 10 4. To make arrangements with the public or
484484 11 quasi-public libraries and museums for the use of their
485485 12 facilities by teachers and pupils of the public schools;
486486 13 5. To employ dentists and prescribe their duties for
487487 14 the purpose of treating the pupils in the schools, but
488488 15 accepting such treatment shall be optional with parents or
489489 16 guardians;
490490 17 6. To grant the use of assembly halls and classrooms
491491 18 when not otherwise needed, including light, heat, and
492492 19 attendants, for free public lectures, concerts, and other
493493 20 educational and social interests, free of charge, under
494494 21 such provisions and control as the principal of the
495495 22 affected attendance center may prescribe;
496496 23 7. To apportion the pupils to the several schools;
497497 24 provided that no pupil shall be excluded from or
498498 25 segregated in any such school on account of his color,

516516 7 creation, alteration or revision of attendance areas shall
517517 8 be open to the public. Nothing herein shall limit the
518518 9 board's authority to establish multi-area attendance
519519 10 centers or other student assignment systems for
520520 11 desegregation purposes or otherwise, and to apportion the
521521 12 pupils to the several schools. Furthermore, beginning in
522522 13 school year 1994-95, pursuant to a board plan adopted by
523523 14 October 1, 1993, the board shall offer, commencing on a
524524 15 phased-in basis, the opportunity for families within the
525525 16 school district to apply for enrollment of their children
526526 17 in any attendance center within the school district which
527527 18 does not have selective admission requirements approved by
528528 19 the board. The appropriate geographical area in which such
529529 20 open enrollment may be exercised shall be determined by

593593 12 extracurricular activities. The board may further utilize
594594 13 volunteer nonlicensed personnel or employ nonlicensed

597597 16 educator license, directly engaged in teaching subject
598598 17 matter or conducting activities; provided that the teacher
599599 18 shall be continuously aware of the nonlicensed persons'
600600 19 activities and shall be able to control or modify them.
601601 20 The general superintendent shall determine qualifications
602602 21 of such personnel and shall prescribe rules for
603603 22 determining the duties and activities to be assigned to
604604 23 such personnel;
605605 24 10.5. To utilize volunteer personnel from a regional
606606 25 School Crisis Assistance Team (S.C.A.T.), created as part
607607 26 of the Safe to Learn Program established pursuant to

632632 15 school district; and to maintain and operate not to exceed
633633 16 one school radio transmitting station and provide programs
634634 17 for educational purposes;
635635 18 12. To offer, if deemed appropriate, outdoor education
636636 19 courses, including field trips within the State of
637637 20 Illinois, or adjacent states, and to use school
638638 21 educational funds for the expense of the said outdoor
639639 22 educational programs, whether within the school district
640640 23 or not;
641641 24 13. During that period of the calendar year not
642642 25 embraced within the regular school term, to provide and

695695 6 15. To contract with the corporate authorities of any
696696 7 municipality or the county board of any county, as the
697697 8 case may be, to provide for the regulation of traffic in
698698 9 parking areas of property used for school purposes, in
699699 10 such manner as is provided by Section 11-209 of the
700700 11 Illinois Vehicle Code;
701701 12 16. (a) To provide, on an equal basis, access to a high
702702 13 school campus and student directory information to the
703703 14 official recruiting representatives of the armed forces of
704704 15 Illinois and the United States for the purposes of
705705 16 informing students of the educational and career
706706 17 opportunities available in the military if the board has
707707 18 provided such access to persons or groups whose purpose is
708708 19 to acquaint students with educational or occupational
709709 20 opportunities available to them. The board is not required
710710 21 to give greater notice regarding the right of access to
711711 22 recruiting representatives than is given to other persons
712712 23 and groups. In this paragraph 16, "directory information"
713713 24 means a high school student's name, address, and telephone
714714 25 number.

728728 3 student is a transfer student, by another time set by the
729729 4 high school) that indicates that the student or his or her
730730 5 parent or guardian does not want the student's directory
731731 6 information to be provided to official recruiting
732732 7 representatives under subsection (a) of this Section, the
733733 8 high school may not provide access to the student's
734734 9 directory information to these recruiting representatives.
735735 10 The high school shall notify its students and their
736736 11 parents or guardians of the provisions of this subsection
737737 12 (b).
738738 13 (c) A high school may require official recruiting
739739 14 representatives of the armed forces of Illinois and the
740740 15 United States to pay a fee for copying and mailing a
741741 16 student's directory information in an amount that is not
742742 17 more than the actual costs incurred by the high school.
743743 18 (d) Information received by an official recruiting
744744 19 representative under this Section may be used only to
745745 20 provide information to students concerning educational and
746746 21 career opportunities available in the military and may not
747747 22 be released to a person who is not involved in recruiting
748748 23 students for the armed forces of Illinois or the United
749749 24 States;
750750 25 17. (a) To sell or market any computer program
751751 26 developed by an employee of the school district, provided

766766 5 computer program shall be entitled to share in the
767767 6 proceeds of such sale or marketing of the computer
768768 7 program. The distribution of such proceeds between the
769769 8 employee and the school district shall be as agreed upon
770770 9 by the employee and the school district, except that
771771 10 neither the employee nor the school district may receive
772772 11 more than 90% of such proceeds. The negotiation for an
773773 12 employee who is represented by an exclusive bargaining
774774 13 representative may be conducted by such bargaining
775775 14 representative at the employee's request.
776776 15 (b) For the purpose of this paragraph 17:
777777 16 (1) "Computer" means an internally programmed,
778778 17 general purpose digital device capable of
779779 18 automatically accepting data, processing data and
780780 19 supplying the results of the operation.
781781 20 (2) "Computer program" means a series of coded
782782 21 instructions or statements in a form acceptable to a
783783 22 computer, which causes the computer to process data in
784784 23 order to achieve a certain result.
785785 24 (3) "Proceeds" means profits derived from the
786786 25 marketing or sale of a product after deducting the
787787 26 expenses of developing and marketing such product;

802802 5 withhold from the compensation of that employee any dues,
803803 6 payments, or contributions payable by such employee to any
804804 7 labor organization as defined in the Illinois Educational
805805 8 Labor Relations Act. Under such arrangement, an amount
806806 9 shall be withheld from each regular payroll period which
807807 10 is equal to the pro rata share of the annual dues plus any
808808 11 payments or contributions, and the board shall transmit
809809 12 such withholdings to the specified labor organization
810810 13 within 10 working days from the time of the withholding;
811811 14 19a. Upon receipt of notice from the comptroller of a
812812 15 municipality with a population of 500,000 or more, a
813813 16 county with a population of 3,000,000 or more, the Cook
814814 17 County Forest Preserve District, the Chicago Park
815815 18 District, the Metropolitan Water Reclamation District, the
816816 19 Chicago Transit Authority, or a housing authority of a
817817 20 municipality with a population of 500,000 or more that a
818818 21 debt is due and owing the municipality, the county, the
819819 22 Cook County Forest Preserve District, the Chicago Park
820820 23 District, the Metropolitan Water Reclamation District, the
821821 24 Chicago Transit Authority, or the housing authority by an
822822 25 employee of the Chicago Board of Education, to withhold,

844844 11 District, the Chicago Park District, the Metropolitan
845845 12 Water Reclamation District, the Chicago Transit Authority,
846846 13 or the housing authority shall certify that (i) the
847847 14 employee has been afforded an opportunity for a hearing to
848848 15 dispute the debt that is due and owing the municipality,
849849 16 the county, the Cook County Forest Preserve District, the
850850 17 Chicago Park District, the Metropolitan Water Reclamation
851851 18 District, the Chicago Transit Authority, or the housing
852852 19 authority and (ii) the employee has received notice of a
853853 20 wage deduction order and has been afforded an opportunity
854854 21 for a hearing to object to the order. For purposes of this
855855 22 paragraph, "net amount" means that part of the salary or
856856 23 wage payment remaining after the deduction of any amounts
857857 24 required by law to be deducted and "debt due and owing"
858858 25 means (i) a specified sum of money owed to the

886886 17 maintain a record of such time. Each counselor shall meet
887887 18 with the counselor's assigned students at least once each

889889 20 21. To make available to students vocational and
