11 103RD GENERAL ASSEMBLY State of Illinois 2023 and 2024 HB2420 Introduced , by Rep. Jeff Keicher SYNOPSIS AS INTRODUCED: 30 ILCS 105/5.990 new415 ILCS 10/3.2 new Amends the Local Solid Waste Disposal Act. Provides that the Department of Transportation shall set and charge assessment fees for a hauler for each time one of the hauler's vehicles deposits solid waste or municipal waste into a landfill in Illinois. Provides that the Department shall set separate assessment fees for different regions of the State based on the population of the region and the average fees haulers charge for their services within a region. Provides that the fees must be deposited into the Waste Cleanup Assessment Fund and may be expended to provide grants or payments to counties and municipalities in Illinois within a 50-mile radius of a landfill for cleaning up solid waste or municipal waste that falls from a hauler's vehicle. Provides that the Department shall adopt rules to implement the assessment fee provisions. Amends the State Finance Act to make a conforming change. 1212 1 AN ACT concerning environmental safety.
1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 5. The State Finance Act is amended by adding
1616 5 Section 5.990 as follows:

1818 7 Sec. 5.990. The Waste Cleanup Assessment Fund.
1919 8 Section 10. The Local Solid Waste Disposal Act is amended
2020 9 by adding Section 3.2 as follows:

2222 11 Sec. 3.2. Waste cleanup assessment fee.
2323 12 (a) As used in this Section, "hauler" has the meaning
2424 13 given to that term in Section 5 of the Solid Waste Hauling and
2525 14 Recycling Program Act.
2626 15 (b) The Department of Transportation shall set and charge
2727 16 assessment fees for a hauler for each time one of the hauler's
2828 17 vehicles deposits solid waste or municipal waste into a
2929 18 landfill in Illinois. The Department shall set separate
3030 19 assessment fees for different regions of the State based on
3131 20 the population of the region and the average fees haulers
3232 21 charge for their services within a region.

6969 1 (c) The fees must be deposited into the Waste Cleanup
7070 2 Assessment Fund, a special fund that is created in the State
7171 3 treasury and, as directed by the Secretary of the Department
7272 4 of Transportation, may be expended to provide grants or
7373 5 payments to counties and municipalities in Illinois within a
7474 6 50-mile radius of a landfill for cleaning up solid waste or
7575 7 municipal waste that falls from a hauler's vehicle.
7676 8 (d) Only one assessment fee may be charged per hauler
7777 9 vehicle for each time that vehicle deposits solid waste or
7878 10 municipal waste into a landfill.
7979 11 (e) The Department of Transportation shall adopt rules to
