1212 1 AN ACT concerning government.
1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 5. The Freedom of Information Act is amended by
1616 5 changing Sections 2 and 7 as follows:

1818 7 Sec. 2. Definitions. As used in this Act:
1919 8 (a) "Public body" means all legislative, executive,
2020 9 judicial, administrative, or advisory bodies of the State,
2121 10 state universities and colleges, counties, townships, cities,
2222 11 villages, incorporated towns, school districts and all other
2323 12 municipal corporations, boards, bureaus, committees, or
2424 13 commissions of this State, any subsidiary bodies of any of the
2525 14 foregoing including but not limited to committees and
2626 15 subcommittees thereof, and a School Finance Authority created
2727 16 under Article 1E of the School Code. "Public body" does not
2828 17 include a child death review team or the Illinois Child Death
2929 18 Review Teams Executive Council established under the Child
3030 19 Death Review Team Act, or a regional youth advisory board or
3131 20 the Statewide Youth Advisory Board established under the
3232 21 Department of Children and Family Services Statewide Youth
3333 22 Advisory Board Act.
3434 23 (b) "Person" means any individual, corporation,

7171 1 partnership, firm, organization or association, acting

7373 3 (c) "Public records" means all records, reports, forms,
7474 4 writings, letters, memoranda, books, papers, maps,
7575 5 photographs, microfilms, cards, tapes, recordings, electronic
7676 6 data processing records, electronic communications, recorded
7777 7 information and all other documentary materials pertaining to
7878 8 the transaction of public business, regardless of physical
7979 9 form or characteristics, having been prepared by or for, or
8080 10 having been or being used by, received by, in the possession
8181 11 of, or under the control of any public body.
8282 12 (c-5) "Private information" means unique identifiers,
8383 13 including a person's social security number, driver's license
8484 14 number, employee identification number, biometric identifiers,
8585 15 personal financial information, passwords or other access
8686 16 codes, medical records, home or personal telephone numbers,
8787 17 and personal email addresses. Private information also
8888 18 includes home address and personal license plates, except as
8989 19 otherwise provided by law or when compiled without possibility
9090 20 of attribution to any person.
9191 21 (c-10) "Commercial purpose" means the use of any part of a
9292 22 public record or records, or information derived from public
9393 23 records, in any form for sale, resale, or solicitation or
9494 24 advertisement for sales or services. For purposes of this
9595 25 definition, requests made by news media and non-profit,
9696 26 scientific, or academic organizations shall not be considered

107107 1 to be made for a "commercial purpose" when the principal
108108 2 purpose of the request is (i) to access and disseminate
109109 3 information concerning news and current or passing events,
110110 4 (ii) for articles of opinion or features of interest to the
111111 5 public, or (iii) for the purpose of academic, scientific, or
112112 6 public research or education.
113113 7 (d) "Copying" means the reproduction of any public record
114114 8 by means of any photographic, electronic, mechanical or other
115115 9 process, device or means now known or hereafter developed and
116116 10 available to the public body.
117117 11 (e) "Head of the public body" means the president, mayor,
118118 12 chairman, presiding officer, director, superintendent,
119119 13 manager, supervisor or individual otherwise holding primary
120120 14 executive and administrative authority for the public body, or
121121 15 such person's duly authorized designee.
122122 16 (f) "News media" means a newspaper or other periodical
123123 17 issued at regular intervals whether in print or electronic
124124 18 format, a news service whether in print or electronic format,
125125 19 a radio station, a television station, a television network, a
126126 20 community antenna television service, or a person or
127127 21 corporation engaged in making news reels or other motion
128128 22 picture news for public showing.
129129 23 (g) "Recurrent requester", as used in Section 3.2 of this
130130 24 Act, means a person that, in the 12 months immediately
131131 25 preceding the request, has submitted to the same public body

143143 1 requests for records within a 30-day period, or (iii) a
144144 2 minimum of 7 requests for records within a 7-day period. For
145145 3 purposes of this definition, requests made by news media and
146146 4 non-profit, scientific, or academic organizations shall not be
147147 5 considered in calculating the number of requests made in the
148148 6 time periods in this definition when the principal purpose of
149149 7 the requests is (i) to access and disseminate information
150150 8 concerning news and current or passing events, (ii) for
151151 9 articles of opinion or features of interest to the public, or
152152 10 (iii) for the purpose of academic, scientific, or public
153153 11 research or education.
154154 12 For the purposes of this subsection (g), "request" means a
155155 13 written document (or oral request, if the public body chooses
156156 14 to honor oral requests) that is submitted to a public body via
157157 15 personal delivery, mail, telefax, electronic mail, or other
158158 16 means available to the public body and that identifies the
159159 17 particular public record the requester seeks. One request may
160160 18 identify multiple records to be inspected or copied.
161161 19 (h) "Voluminous request" means a request that: (i)
162162 20 includes more than 5 individual requests for more than 5
163163 21 different categories of records or a combination of individual
164164 22 requests that total requests for more than 5 different
165165 23 categories of records in a period of 20 business days; or (ii)
166166 24 requires the compilation of more than 500 letter or
167167 25 legal-sized pages of public records unless a single requested
168168 26 record exceeds 500 pages. "Single requested record" may

188188 10 For the purposes of this subsection (h), "request" means a
189189 11 written document, or oral request, if the public body chooses
190190 12 to honor oral requests, that is submitted to a public body via
191191 13 personal delivery, mail, telefax, electronic mail, or other
192192 14 means available to the public body and that identifies the
193193 15 particular public record or records the requester seeks. One
194194 16 request may identify multiple individual records to be
195195 17 inspected or copied.
196196 18 (i) "Severance agreement" means a mutual agreement between
197197 19 any public body and its employee for the employee's
198198 20 resignation in exchange for payment by the public body.

214214 1 (1) When a request is made to inspect or copy a public
215215 2 record that contains information that is exempt from
216216 3 disclosure under this Section, but also contains information
217217 4 that is not exempt from disclosure, the public body may elect
218218 5 to redact the information that is exempt. The public body
219219 6 shall make the remaining information available for inspection
220220 7 and copying. Subject to this requirement, the following shall
221221 8 be exempt from inspection and copying:
222222 9 (a) Information specifically prohibited from
223223 10 disclosure by federal or State law or rules and
224224 11 regulations implementing federal or State law.
225225 12 (b) Private information, unless disclosure is required
226226 13 by another provision of this Act, a State or federal law,
227227 14 or a court order.
228228 15 (b-5) Files, documents, and other data or databases
229229 16 maintained by one or more law enforcement agencies and
230230 17 specifically designed to provide information to one or
231231 18 more law enforcement agencies regarding the physical or
232232 19 mental status of one or more individual subjects.
233233 20 (c) Personal information contained within public
234234 21 records, the disclosure of which would constitute a
235235 22 clearly unwarranted invasion of personal privacy, unless
236236 23 the disclosure is consented to in writing by the
237237 24 individual subjects of the information. "Unwarranted
238238 25 invasion of personal privacy" means the disclosure of
239239 26 information that is highly personal or objectionable to a

250250 1 reasonable person and in which the subject's right to
251251 2 privacy outweighs any legitimate public interest in
252252 3 obtaining the information. The disclosure of information
253253 4 that bears on the public duties of public employees and
254254 5 officials shall not be considered an invasion of personal
255255 6 privacy.
256256 7 (d) Records in the possession of any public body
257257 8 created in the course of administrative enforcement
258258 9 proceedings, and any law enforcement or correctional
259259 10 agency for law enforcement purposes, but only to the
260260 11 extent that disclosure would:
261261 12 (i) interfere with pending or actually and
262262 13 reasonably contemplated law enforcement proceedings
263263 14 conducted by any law enforcement or correctional
264264 15 agency that is the recipient of the request;
265265 16 (ii) interfere with active administrative
266266 17 enforcement proceedings conducted by the public body
267267 18 that is the recipient of the request;
268268 19 (iii) create a substantial likelihood that a
269269 20 person will be deprived of a fair trial or an impartial
270270 21 hearing;
271271 22 (iv) unavoidably disclose the identity of a
272272 23 confidential source, confidential information
273273 24 furnished only by the confidential source, or persons
274274 25 who file complaints with or provide information to
275275 26 administrative, investigative, law enforcement, or

286286 1 penal agencies; except that the identities of
287287 2 witnesses to traffic accidents, traffic accident
288288 3 reports, and rescue reports shall be provided by
289289 4 agencies of local government, except when disclosure
290290 5 would interfere with an active criminal investigation
291291 6 conducted by the agency that is the recipient of the
292292 7 request;
293293 8 (v) disclose unique or specialized investigative
294294 9 techniques other than those generally used and known
295295 10 or disclose internal documents of correctional
296296 11 agencies related to detection, observation, or
297297 12 investigation of incidents of crime or misconduct, and
298298 13 disclosure would result in demonstrable harm to the
299299 14 agency or public body that is the recipient of the
300300 15 request;
301301 16 (vi) endanger the life or physical safety of law
302302 17 enforcement personnel or any other person; or
303303 18 (vii) obstruct an ongoing criminal investigation
304304 19 by the agency that is the recipient of the request.
305305 20 (d-5) A law enforcement record created for law
306306 21 enforcement purposes and contained in a shared electronic
307307 22 record management system if the law enforcement agency
308308 23 that is the recipient of the request did not create the
309309 24 record, did not participate in or have a role in any of the
310310 25 events which are the subject of the record, and only has

374374 17 may be relevant to a requester's current or potential case
375375 18 or claim.
376376 19 (e-10) Law enforcement records of other persons
377377 20 requested by a person committed to the Department of
378378 21 Corrections, Department of Human Services Division of
379379 22 Mental Health, or a county jail, including, but not
380380 23 limited to, arrest and booking records, mug shots, and
381381 24 crime scene photographs, except as these records may be
382382 25 relevant to the requester's current or potential case or

394394 1 (f) Preliminary drafts, notes, recommendations,
395395 2 memoranda, and other records in which opinions are
396396 3 expressed, or policies or actions are formulated, except
397397 4 that a specific record or relevant portion of a record
398398 5 shall not be exempt when the record is publicly cited and
399399 6 identified by the head of the public body. The exemption
400400 7 provided in this paragraph (f) extends to all those
401401 8 records of officers and agencies of the General Assembly
402402 9 that pertain to the preparation of legislative documents.
403403 10 (g) Trade secrets and commercial or financial
404404 11 information obtained from a person or business where the
405405 12 trade secrets or commercial or financial information are
406406 13 furnished under a claim that they are proprietary,
407407 14 privileged, or confidential, and that disclosure of the
408408 15 trade secrets or commercial or financial information would
409409 16 cause competitive harm to the person or business, and only
410410 17 insofar as the claim directly applies to the records
411411 18 requested.
412412 19 The information included under this exemption includes
413413 20 all trade secrets and commercial or financial information
414414 21 obtained by a public body, including a public pension
415415 22 fund, from a private equity fund or a privately held
416416 23 company within the investment portfolio of a private
417417 24 equity fund as a result of either investing or evaluating
418418 25 a potential investment of public funds in a private equity
419419 26 fund. The exemption contained in this item does not apply

430430 1 to the aggregate financial performance information of a
431431 2 private equity fund, nor to the identity of the fund's
432432 3 managers or general partners. The exemption contained in
433433 4 this item does not apply to the identity of a privately
434434 5 held company within the investment portfolio of a private
435435 6 equity fund, unless the disclosure of the identity of a
436436 7 privately held company may cause competitive harm.
437437 8 Nothing contained in this paragraph (g) shall be
438438 9 construed to prevent a person or business from consenting
439439 10 to disclosure.
440440 11 (h) Proposals and bids for any contract, grant, or
441441 12 agreement, including information which if it were
442442 13 disclosed would frustrate procurement or give an advantage
443443 14 to any person proposing to enter into a contractor
444444 15 agreement with the body, until an award or final selection
445445 16 is made. Information prepared by or for the body in
446446 17 preparation of a bid solicitation shall be exempt until an
447447 18 award or final selection is made.
448448 19 (i) Valuable formulae, computer geographic systems,
449449 20 designs, drawings, and research data obtained or produced
450450 21 by any public body when disclosure could reasonably be
451451 22 expected to produce private gain or public loss. The
452452 23 exemption for "computer geographic systems" provided in
453453 24 this paragraph (i) does not extend to requests made by
454454 25 news media as defined in Section 2 of this Act when the
455455 26 requested information is not otherwise exempt and the only

467467 2 information regarding the health, safety, welfare, or
468468 3 legal rights of the general public.
469469 4 (j) The following information pertaining to
470470 5 educational matters:
471471 6 (i) test questions, scoring keys, and other
472472 7 examination data used to administer an academic
473473 8 examination;
474474 9 (ii) information received by a primary or
475475 10 secondary school, college, or university under its
476476 11 procedures for the evaluation of faculty members by
477477 12 their academic peers;
478478 13 (iii) information concerning a school or
479479 14 university's adjudication of student disciplinary
480480 15 cases, but only to the extent that disclosure would
481481 16 unavoidably reveal the identity of the student; and
482482 17 (iv) course materials or research materials used
483483 18 by faculty members.
484484 19 (k) Architects' plans, engineers' technical
485485 20 submissions, and other construction related technical
486486 21 documents for projects not constructed or developed in
487487 22 whole or in part with public funds and the same for
488488 23 projects constructed or developed with public funds,

759759 6 Sec. 7. Exemptions.
760760 7 (1) When a request is made to inspect or copy a public
761761 8 record that contains information that is exempt from
762762 9 disclosure under this Section, but also contains information
763763 10 that is not exempt from disclosure, the public body may elect
764764 11 to redact the information that is exempt. The public body
765765 12 shall make the remaining information available for inspection
766766 13 and copying. Subject to this requirement, the following shall
767767 14 be exempt from inspection and copying:
768768 15 (a) Information specifically prohibited from
769769 16 disclosure by federal or State law or rules and
770770 17 regulations implementing federal or State law.
771771 18 (b) Private information, unless disclosure is required
772772 19 by another provision of this Act, a State or federal law,
773773 20 or a court order.
774774 21 (b-5) Files, documents, and other data or databases
775775 22 maintained by one or more law enforcement agencies and
776776 23 specifically designed to provide information to one or
777777 24 more law enforcement agencies regarding the physical or
778778 25 mental status of one or more individual subjects.

790790 2 records, the disclosure of which would constitute a
791791 3 clearly unwarranted invasion of personal privacy, unless
792792 4 the disclosure is consented to in writing by the
793793 5 individual subjects of the information. "Unwarranted
794794 6 invasion of personal privacy" means the disclosure of
795795 7 information that is highly personal or objectionable to a
796796 8 reasonable person and in which the subject's right to
797797 9 privacy outweighs any legitimate public interest in
798798 10 obtaining the information. The disclosure of information
799799 11 that bears on the public duties of public employees and
800800 12 officials shall not be considered an invasion of personal
801801 13 privacy.
802802 14 (d) Records in the possession of any public body
803803 15 created in the course of administrative enforcement
804804 16 proceedings, and any law enforcement or correctional
805805 17 agency for law enforcement purposes, but only to the
806806 18 extent that disclosure would:
807807 19 (i) interfere with pending or actually and
808808 20 reasonably contemplated law enforcement proceedings
809809 21 conducted by any law enforcement or correctional
810810 22 agency that is the recipient of the request;
811811 23 (ii) interfere with active administrative
812812 24 enforcement proceedings conducted by the public body
813813 25 that is the recipient of the request;

837837 13 conducted by the agency that is the recipient of the

839839 15 (v) disclose unique or specialized investigative
840840 16 techniques other than those generally used and known
841841 17 or disclose internal documents of correctional
842842 18 agencies related to detection, observation, or
843843 19 investigation of incidents of crime or misconduct, and
844844 20 disclosure would result in demonstrable harm to the
845845 21 agency or public body that is the recipient of the
846846 22 request;
847847 23 (vi) endanger the life or physical safety of law
848848 24 enforcement personnel or any other person; or
849849 25 (vii) obstruct an ongoing criminal investigation
850850 26 by the agency that is the recipient of the request.

943943 11 that a specific record or relevant portion of a record
944944 12 shall not be exempt when the record is publicly cited and
945945 13 identified by the head of the public body. The exemption
946946 14 provided in this paragraph (f) extends to all those
947947 15 records of officers and agencies of the General Assembly
948948 16 that pertain to the preparation of legislative documents
949949 17 and to all those records that pertain to the preparation
950950 18 of judicial opinions and orders.
951951 19 (g) Trade secrets and commercial or financial
952952 20 information obtained from a person or business where the
953953 21 trade secrets or commercial or financial information are
954954 22 furnished under a claim that they are proprietary,
955955 23 privileged, or confidential, and that disclosure of the
956956 24 trade secrets or commercial or financial information would
957957 25 cause competitive harm to the person or business, and only
958958 26 insofar as the claim directly applies to the records
