The Illinois Vehicle Code is amended by 5 changing Section 11-305 and by adding Section 1-158.2 as 6 follows: 7 (625 ILCS 5/1-158.2 new) 8 Sec. 1-158.2. Pedestrian hybrid beacon. A traffic-control 9 device used to warn and control traffic, at locations that are 10 otherwise without a traffic-control signal, to assist 11 pedestrians in crossing a street or highway at a marked 12 crosswalk. 13 (625 ILCS 5/11-305) (from Ch. 95 1/2, par. 11-305) 14 Sec. 11-305. Obedience to and required traffic-control 15 devices. 16 (a) The driver of any vehicle shall obey the instructions 17 of any official traffic-control device applicable thereto 18 placed or held in accordance with the provisions of this Act, 19 unless otherwise directed by a police officer, subject to the 20 exceptions granted the driver of an authorized emergency 21 vehicle in this Act. 22 (b) It is unlawful for any person to leave the roadway and HB2464 Enrolled LRB103 26400 MXP 52763 b HB2464 Enrolled- 2 -LRB103 26400 MXP 52763 b HB2464 Enrolled - 2 - LRB103 26400 MXP 52763 b HB2464 Enrolled - 2 - LRB103 26400 MXP 52763 b 1 travel across private property to avoid an official traffic 2 control device. 3 (c) No provision of this Act for which official 4 traffic-control devices are required shall be enforced against 5 an alleged violator if at the time and place of the alleged 6 violation an official device is not in proper position and 7 sufficiently legible to be seen by an ordinarily observant 8 person. Whenever a particular section does not state that 9 official traffic-control devices are required, such section 10 shall be effective even though no devices are erected or in 11 place. 12 (d) Whenever any official traffic-control device is placed 13 or held in position approximately conforming to the 14 requirements of this Act and purports to conform to the lawful 15 requirements pertaining to such device, such device shall be 16 presumed to have been so placed or held by the official act or 17 direction of lawful authority, and comply with the 18 requirements of this Act, unless the contrary shall be 19 established by competent evidence. 20 (e) The driver of a vehicle approaching a traffic control 21 signal on which no signal light facing such vehicle is 22 illuminated shall stop before entering the intersection in 23 accordance with rules applicable in making a stop at a stop 24 sign.
