1414 1 AN ACT concerning transportation.
1515 2 Be it enacted by the People of the State of Illinois,
1616 3 represented in the General Assembly:
1717 4 Section 5. The Illinois Vehicle Code is amended by
1818 5 changing Sections 15-103, 15-107, 15-116, and 15-316 as

2121 8 Sec. 15-103. Height of vehicles. Except as provided in
2222 9 Section 15-316, the The height of a vehicle from the under side
2323 10 of the tire to the top of the vehicle, inclusive of load, shall
2424 11 not exceed 13 feet, 6 inches on any highway in the State.
2525 12 A person convicted of violating this Section is subject to
2626 13 the penalty provided in paragraph (b) of Section 15-113.

2929 16 Sec. 15-107. Length of vehicles.
3030 17 (a) The maximum length of a single vehicle on any highway
3131 18 of this State may not exceed 42 feet except the following:

3333 20 (2) Charter or regulated route buses may be up to 45
3434 21 feet in length, not including energy absorbing bumpers.

9292 17 (5) Recreational vehicles consisting of 3 vehicles,
9393 18 provided the following:
9494 19 (A) The total overall dimension does not exceed 60
9595 20 feet.
9696 21 (B) The towing vehicle is a properly registered
9797 22 vehicle capable of towing another vehicle using a
9898 23 fifth-wheel type assembly.
9999 24 (C) The second vehicle in the combination of
100100 25 vehicles is a recreational vehicle that is towed by a

113113 2 regardless of weight.
114114 3 (D) The third vehicle must be the lightest of the 3
115115 4 vehicles and be a trailer or semitrailer designed or
116116 5 used for transporting a boat, all-terrain vehicle,
117117 6 personal watercraft, or motorcycle.
118118 7 (E) The towed vehicles may be only for the use of
119119 8 the operator of the towing vehicle.
120120 9 (F) All vehicles must be properly equipped with
121121 10 operating brakes and safety equipment required by this
122122 11 Code, except the additional brake requirement in
123123 12 subdivision (C) of this subparagraph (5).
124124 13 (6) A tow truck in combination with a disabled vehicle
125125 14 or combination of disabled vehicles, provided the towing
126126 15 vehicle:
127127 16 (A) Is specifically designed as a tow truck having
128128 17 a gross vehicle weight rating of at least 18,000
129129 18 pounds and equipped with air brakes, provided that air
130130 19 brakes are required only if the towing vehicle is
131131 20 towing a vehicle, semitrailer, or tractor-trailer
132132 21 combination that is equipped with air brakes. For the
133133 22 purpose of this subsection, gross vehicle weight
134134 23 rating, or GVWR, means the value specified by the
135135 24 manufacturer as the loaded weight of the tow truck.
136136 25 (B) Is equipped with flashing, rotating, or
137137 26 oscillating amber lights, visible for at least 500

149149 2 (C) Is capable of utilizing the lighting and
150150 3 braking systems of the disabled vehicle or combination
151151 4 of vehicles.
152152 5 (D) Does not engage a tow exceeding 50 highway
153153 6 miles from the initial point of wreck or disablement
154154 7 to a place of repair. Any additional movement of the
155155 8 vehicles may occur only upon issuance of authorization
156156 9 for that movement under the provisions of Sections
157157 10 15-301 through 15-318 of this Code.
158158 11 The Department may by rule or regulation prescribe
159159 12 additional requirements regarding length limitations for a
160160 13 tow truck towing another vehicle.
161161 14 For purposes of this Section, a tow-dolly that merely
162162 15 serves as substitute wheels for another legally licensed
163163 16 vehicle is considered part of the licensed vehicle and not
164164 17 a separate vehicle.
165165 18 (7) Commercial vehicles consisting of 3 vehicles,
166166 19 provided the following:
167167 20 (A) The total overall dimension does not exceed 65
168168 21 feet.
169169 22 (B) The towing vehicle is a properly registered
170170 23 vehicle capable of towing another vehicle using a
171171 24 fifth-wheel type assembly or a goose-neck hitch ball.
172172 25 (C) The third vehicle must be the lightest of the 3
173173 26 vehicles and be a trailer or semitrailer.

184184 1 (D) All vehicles must be properly equipped with
185185 2 operating brakes and safety equipment required by this

187187 4 (E) The combination of vehicles must be operated
188188 5 by a person who holds a commercial driver's license
189189 6 (CDL).
190190 7 (F) The combination of vehicles must be en route
191191 8 to a location where new or used trailers are sold by an
192192 9 Illinois or out-of-state licensed new or used trailer
193193 10 dealer.
194194 11 (c-1) A combination of 3 vehicles is allowed access to any
195195 12 State designated highway if:
196196 13 (1) the length of neither towed vehicle exceeds 28.5
197197 14 feet;
198198 15 (2) the overall wheel base of the combination of
199199 16 vehicles does not exceed 62 feet; and
200200 17 (3) the combination of vehicles is en route to a
201201 18 location where new or used trailers are sold by an
202202 19 Illinois or out-of-state licensed new or used trailer
203203 20 dealer.
204204 21 (c-2) A combination of 3 vehicles is allowed access from
205205 22 any State designated highway onto any county, township, or
206206 23 municipal highway for a distance of 5 highway miles for the
207207 24 purpose of delivery or collection of one or both of the towed
208208 25 vehicles if:
209209 26 (1) the length of neither towed vehicle exceeds 28.5

221221 2 (2) the combination of vehicles does not exceed 40,000
222222 3 pounds in gross weight and 8 feet 6 inches in width;
223223 4 (3) there is no sign prohibiting that access;
224224 5 (4) the route is not being used as a thoroughfare
225225 6 between State designated highways; and
226226 7 (5) the combination of vehicles is en route to a
227227 8 location where new or used trailers are sold by an
228228 9 Illinois or out-of-state licensed new or used trailer
229229 10 dealer.
230230 11 (d) On Class I highways there are no overall length
231231 12 limitations on motor vehicles operating in combinations
232232 13 provided:
233233 14 (1) The length of a semitrailer, unladen or with load,
234234 15 in combination with a truck tractor may not exceed 53
235235 16 feet.
236236 17 (2) The distance between the kingpin and the center of
237237 18 the rear axle of a semitrailer longer than 48 feet, in
238238 19 combination with a truck tractor, may not exceed 45 feet 6
239239 20 inches. The limit contained in this paragraph (2) shall
240240 21 not apply to trailers or semi-trailers used for the
241241 22 transport of livestock as defined by Section 18b-101.
242242 23 (3) The length of a semitrailer or trailer, unladen or
243243 24 with load, operated in a truck tractor-semitrailer-trailer
244244 25 or truck tractor semitrailer-semitrailer combination, may
245245 26 not exceed 28 feet 6 inches.

256256 1 (4) Maxi-cube combinations, as defined in Chapter 1,

258258 3 (5) Combinations of vehicles specifically designed to

264264 9 (6) Stinger-steered semitrailer vehicles specifically

266266 11 automobile transporters, as defined in Chapter 1, may not
267267 12 exceed 80 feet overall dimension. The length limitation is
268268 13 inclusive of front and rear bumpers but exclusive of the
269269 14 overhang of the transported vehicles, as provided in
270270 15 paragraph (i) of this Section.
271271 16 (7) A truck in transit transporting 3 trucks coupled
272272 17 together by the triple saddlemount method may not exceed
273273 18 97 feet overall dimension.
274274 19 (8) A towaway trailer transporter combination may not
275275 20 exceed 82 feet overall dimension.
276276 21 Vehicles operating during daylight hours when transporting
277277 22 poles, pipes, machinery, or other objects of a structural
278278 23 nature that cannot readily be dismantled or disassembled are
279279 24 exempt from length limitations, provided that no object may
280280 25 exceed 80 feet in length and the overall dimension of the
281281 26 vehicle including the load may not exceed 100 feet. This

292292 1 exemption does not apply to operation on a Saturday, Sunday,
293293 2 or legal holiday. Legal holidays referred to in this Section
294294 3 are the days on which the following traditional holidays are
295295 4 celebrated: New Year's Day; Memorial Day; Independence Day;
296296 5 Labor Day; Thanksgiving Day; and Christmas Day.
297297 6 Vehicles and loads operated by a public utility while en
298298 7 route to make emergency repairs to public service facilities
299299 8 or properties are exempt from length limitations, provided
300300 9 that during night operations every vehicle and its load must
301301 10 be equipped with a sufficient number of clearance lamps on
302302 11 both sides and marker lamps on the extreme ends of any
303303 12 projecting load to clearly mark the dimensions of the load.
304304 13 A tow truck in combination with a disabled vehicle or
305305 14 combination of disabled vehicles, as provided in paragraph (6)
306306 15 of subsection (c) of this Section, is exempt from length
307307 16 limitations.
308308 17 The length limitations described in this paragraph (d)
309309 18 shall be exclusive of safety and energy conservation devices,
310310 19 such as bumpers, refrigeration units or air compressors and
311311 20 other devices, that the Department may interpret as necessary
312312 21 for safe and efficient operation; except that no device
313313 22 excluded under this paragraph shall have by its design or use
314314 23 the capability to carry cargo.
315315 24 Section 5-35 of the Illinois Administrative Procedure Act
316316 25 relating to procedures for rulemaking shall not apply to the
317317 26 designation of highways under this paragraph (d).

456456 21 (1) A truck tractor in combination with a semitrailer
457457 22 may not exceed 65 feet overall dimension. An agency or
458458 23 instrumentality of the State of Illinois or any unit of
459459 24 local government shall not be required to widen or
460460 25 otherwise alter a non-designated highway constructed

488488 17 poles, pipe, machinery, or other objects of a structural
489489 18 nature that cannot readily be dismantled or disassembled,
490490 19 provided the overall length of vehicle and load may not
491491 20 exceed 100 feet and no object exceeding 80 feet in length
492492 21 may be transported unless a permit has been obtained as
493493 22 authorized in Section 15-301. As used in this Section,
494494 23 "legal holiday" means any of the following days: New
495495 24 Year's Day; Memorial Day; Independence Day; Labor Day;
496496 25 Thanksgiving Day; and Christmas Day.
497497 26 (2) Vehicles and loads operated by a public utility

511511 4 number of clearance lamps on both sides and marker lamps

513513 6 mark the dimensions of the load.
514514 7 (3) A tow truck in combination with a disabled vehicle
515515 8 or combination of disabled vehicles, as provided in
516516 9 paragraph (6) of subsection (c) of this Section, is exempt
517517 10 from length limitations.
518518 11 The towing vehicle, however, may tow any disabled vehicle
519519 12 from the initial point of wreck or disablement to a point where
520520 13 repairs are actually to occur. This movement shall be valid
521521 14 only on State routes. The tower must abide by posted bridge
522522 15 weight limits.
523523 16 All other combinations not listed in this subsection (f)
524524 17 may not exceed 60 feet overall dimension.
525525 18 (h) The load upon any vehicle operated alone, or the load
526526 19 upon the front vehicle of a combination of vehicles, shall not
527527 20 extend more than 3 feet beyond the front wheels of the vehicle
528528 21 or the front bumper of the vehicle if it is equipped with a
529529 22 front bumper. The provisions of this subsection (h) shall not
530530 23 apply to any vehicle or combination of vehicles specifically
531531 24 designed for the collection and transportation of waste,
532532 25 garbage, or recyclable materials during the vehicle's

545545 2 not in excess of 15 miles per hour during the vehicle's
546546 3 operation and in the course of collecting garbage, waste, or
547547 4 recyclable materials. However, in no instance shall the load
548548 5 extend more than 7 feet beyond the front wheels of the vehicle
549549 6 or the front bumper of the vehicle if it is equipped with a
550550 7 front bumper.
551551 8 (i) The load upon the front vehicle of an automobile
552552 9 transporter or a stinger-steered vehicle specifically designed
553553 10 to transport motor vehicles shall not extend more than 4 feet
554554 11 beyond the foremost part of the transporting vehicle and the
555555 12 load upon the rear transporting vehicle shall not extend more
556556 13 than 6 feet beyond the rear of the bed or body of the vehicle.
557557 14 This paragraph shall only be applicable upon highways
558558 15 designated in paragraphs (d) and (e) of this Section.
559559 16 (j) Articulated vehicles comprised of 2 sections, neither
560560 17 of which exceeds a length of 42 feet, designed for the carrying
561561 18 of more than 10 persons, may be up to 60 feet in length, not
562562 19 including energy absorbing bumpers, provided that the vehicles
563563 20 are:
564564 21 1. operated by or for any public body or motor carrier
565565 22 authorized by law to provide public transportation
566566 23 services; or
567567 24 2. operated in local public transportation service by
568568 25 any other person and the municipality in which the service
569569 26 is to be provided approved the operation of the vehicle.

588588 9 (a) The Department of Transportation shall maintain and

590590 11 streets and highways as defined in Chapter 1 of this Code.

592592 13 listing of all local streets or highways that have been
593593 14 designated Class II by local agencies.
594594 15 (c) Local agencies shall be responsible for reporting to
595595 16 the Department all streets and highways under their
596596 17 jurisdiction designated Class II. Local agencies shall also
597597 18 provide to the Department reference contact names and
598598 19 telephone numbers.
599599 20 (d) The Department shall also maintain and provide an
600600 21 official map of the Designated State Truck Route System that
601601 22 includes State and local streets and highways that have been
602602 23 designated Class I or Class II.

637637 23 (b) The local authority enacting any such ordinance or
638638 24 resolution shall erect or cause to be erected and maintained

655655 6 the designation shall be reported to the Department.
656656 7 (c) Local authorities with respect to highways under their
657657 8 jurisdiction may also, by ordinance or resolution, prohibit
658658 9 the operation of trucks or other commercial vehicles, or may
659659 10 impose limitations as the weight, height, or length thereof,
660660 11 on designated highways, which prohibitions and limitations
661661 12 shall be marked designated by appropriate signs placed on such
662662 13 highways.

664664 15 (c-5) Highway commissioners, with respect to roads under
665665 16 their authority, may not permanently post a road or portion
666666 17 thereof at a reduced weight limit unless the decision to do so

669669 20 (d) The Department shall likewise have authority as
670670 21 hereinbefore granted to local authorities to determine by
671671 22 resolution and to impose restrictions as to the weight,

689689 4 (e) When any vehicle is operated in violation of this
690690 5 Section, the owner or driver of the vehicle shall be deemed
691691 6 guilty of a violation and either the owner or the driver of the
692692 7 vehicle may be prosecuted for the violation. Any person, firm,
693693 8 or corporation convicted of violating this Section shall be
694694 9 fined $50 for any weight exceeding the posted limit up to the
695695 10 axle or gross weight limit allowed a vehicle as provided for in
696696 11 subsections (a) or (b) of Section 15-111 and $75 per every 500
697697 12 pounds or fraction thereof for any weight exceeding that which
698698 13 is provided for in subsections (a) or (b) of Section 15-111.
699699 14 (f) A municipality is authorized to enforce a county
700700 15 weight limit ordinance applying to county highways within its
701701 16 corporate limits and is entitled to the proceeds of any fines
702702 17 collected from the enforcement.
703703 18 (g) An ordinance or resolution enacted by a county or
704704 19 township pursuant to subsection (a) of this Section shall not
705705 20 apply to cargo tank vehicles with two or three permanent axles
706706 21 when delivering propane for emergency heating purposes if the
707707 22 cargo tank is loaded at no more than 50 percent capacity, the
708708 23 gross vehicle weight of the vehicle does not exceed 32,000
709709 24 pounds, and the driver of the cargo tank vehicle notifies the
710710 25 appropriate agency or agencies with jurisdiction over the
711711 26 highway before driving the vehicle on the highway pursuant to

723723 2 gauge on the cargo tank which indicates the amount of propane
724724 3 as a percent of capacity of the cargo tank. The cargo tank must
725725 4 have the capacity displayed on the cargo tank, or
726726 5 documentation of the capacity of the cargo tank must be
727727 6 available in the vehicle. For the purposes of this subsection,
728728 7 propane weighs 4.2 pounds per gallon. This subsection does not
729729 8 apply to municipalities. Nothing in this subsection shall
730730 9 allow cargo tank vehicles to cross bridges with posted weight
731731 10 restrictions if the vehicle exceeds the posted weight limit.
