9595 1 Sec. 43-10. Application.
9696 2 (a) When applying for a cannabis delivery organization
9797 3 license, the applicant shall submit the following in such form
9898 4 as the Department may direct:
9999 5 (1) a nonrefundable application fee of $500 or, after
100100 6 January 1, 2024, another amount as set by rule by the
101101 7 Department, to be deposited into the Cannabis Regulation
102102 8 Fund;
103103 9 (2) the legal name of the cannabis delivery
104104 10 organization;
105105 11 (3) the proposed physical address of the cannabis
106106 12 delivery organization, if one is proposed;
107107 13 (4) the name, address, social security number, and
108108 14 date of birth of each principal officer and board member
109109 15 of the cannabis delivery organization;
110110 16 (5) the details of any administrative or judicial
111111 17 proceeding in which any of the principal officers or board
112112 18 members of the cannabis delivery organization (i) pled
113113 19 guilty, were convicted, fined, or had a registration or
114114 20 license suspended or revoked or (ii) managed or served on
115115 21 the board of a business or nonprofit organization that
116116 22 pled guilty, was convicted, fined, or had a registration
117117 23 or license suspended or revoked;
118118 24 (6) verification from the Illinois State Police that
119119 25 all background checks of the prospective principal
120120 26 officers, board members, and agents of the cannabis

131131 1 delivery organization have been conducted;
132132 2 (7) a copy of the current local zoning ordinance or
133133 3 permit and verification that the proposed cannabis
134134 4 delivery organization is in compliance with the local
135135 5 zoning rules and distance limitations established by the
136136 6 local jurisdiction, if the cannabis delivery organization
137137 7 has a business address;
138138 8 (8) proposed employment practices, in which the
139139 9 applicant must demonstrate a plan of action to inform,
140140 10 hire, and educate minorities, women, veterans, and persons
141141 11 with disabilities, engage in fair labor practices, and
142142 12 provide worker protections;
143143 13 (9) whether an applicant can demonstrate experience in
144144 14 or business practices that promote economic empowerment in
145145 15 Disproportionately Impacted Areas;
146146 16 (10) the identity of every person having a financial
147147 17 or voting interest of 5% or more in the cannabis delivery
148148 18 organization with respect to which the license is sought,
149149 19 whether a trust, corporation, partnership, limited
150150 20 liability company, or sole proprietorship, including the
151151 21 name and address of each person; and
152152 22 (11) any other information required by rule.
153153 23 (b) Applicants must submit all required information,
154154 24 including the information required in Section 43-35, to the
155155 25 Department. Failure by an applicant to submit all required
156156 26 information may result in the application being disqualified.

167167 1 (c) Each principal officer and board member of an
168168 2 applicant shall be at least 21 years of age.
169169 3 (d) If the Department receives an application with missing
170170 4 information, the Department may issue a deficiency notice to
171171 5 the applicant. The applicant shall have 10 calendar days from
172172 6 the date of the deficiency notice to resubmit the incomplete
173173 7 information. Applications that are still incomplete after this
174174 8 opportunity to cure will not be scored and will be
175175 9 disqualified.

177177 11 Sec. 43-15. Issuing licenses.
178178 12 (a) The Department shall, by rule, develop a system to
179179 13 score cannabis delivery applications to administratively rank
180180 14 applications based on the clarity, organization, and quality
181181 15 of the applicant's responses to required information.
182182 16 Applicants shall be awarded points based on the following
183183 17 categories:
184184 18 (1) suitability of employee training plan;
185185 19 (2) security and recordkeeping plan;
186186 20 (3) business plan;
187187 21 (4) labor and employment practices, which shall
188188 22 constitute no less than 2% of total available points;
189189 23 (5) environmental plan that demonstrates an
190190 24 environmental plan of action to minimize the carbon

202202 1 the cannabis delivery organization;
203203 2 (6) the applicant is 51% or more owned and controlled
204204 3 by an individual or individuals who have been an Illinois
205205 4 resident for the past 5 years as proved by tax records or 2
206206 5 of the following:
207207 6 (A) a signed lease agreement that includes the
208208 7 applicant's name;
209209 8 (B) a property deed that includes the applicant's
210210 9 name;
211211 10 (C) school records;
212212 11 (D) a voter registration card;
213213 12 (E) an Illinois driver's license, an Illinois
214214 13 Identification Card, or an Illinois Person with a
215215 14 Disability Identification Card;
216216 15 (F) a paycheck stub;
217217 16 (G) a utility bill; or
218218 17 (H) any other proof of residency or other
219219 18 information necessary to establish residence as
220220 19 provided by rule;
221221 20 (7) a diversity plan that includes a narrative of not
222222 21 more than 2,500 words that establishes a goal of diversity
223223 22 in ownership, management, employment, and contracting to
224224 23 ensure that diverse participants and groups are afforded
225225 24 equality of opportunity; and
226226 25 (8) any other criteria the Department may, by rule,

238238 1 (b) Applicants must qualify as a social equity applicant
239239 2 in order to be awarded a cannabis delivery organization
240240 3 license.
241241 4 (c) Should an applicant be awarded a cannabis delivery
242242 5 organization license, the information and plans that the
243243 6 applicant provided in its application, including any plans
244244 7 submitted for the acquiring of bonus points, shall be a
245245 8 mandatory condition of the permit. Any variation from or
246246 9 failure to perform such plans may result in discipline,
247247 10 including the revocation or nonrenewal of a license.
248248 11 (d) If an applicant is awarded a cannabis delivery
249249 12 organization license, the applicant shall pay a prorated fee
250250 13 of $500 prior to receiving the license, to be deposited into
251251 14 the Cannabis Regulation Fund. The Department may, by rule,
252252 15 adjust the fee in this Section after January 1, 2024.

254254 17 Sec. 43-20. Denial of application. An application for a
255255 18 cannabis delivery organization license shall be denied if any
256256 19 of the following conditions are met:
257257 20 (1) the applicant failed to submit the materials
258258 21 required by this Article;
259259 22 (2) the applicant would not be in compliance with
260260 23 local zoning rules or permit requirements;
261261 24 (3) one or more of the prospective principal officers
262262 25 or board members causes a violation of Section 43-25;

273273 1 (4) one or more of the principal officers or board
274274 2 members is under 21 years of age;
275275 3 (5) the person has submitted an application for a
276276 4 license under this Article that contains false
277277 5 information; or
278278 6 (6) the licensee, principal officer, board member, or
279279 7 person having a financial or voting interest of 5% or
280280 8 greater in the licensee is delinquent in filing any
281281 9 required tax returns or paying any amounts owed to the
282282 10 State of Illinois.

284284 12 Sec. 43-25. Cannabis delivery organization requirements;
285285 13 prohibitions.
286286 14 (a) The operating documents of a cannabis delivery
287287 15 organization shall include procedures for the oversight of the
288288 16 organization, an inventory monitoring system including a
289289 17 physical inventory recorded weekly, accurate recordkeeping,
290290 18 and a staffing plan.
291291 19 (b) All cannabis delivered by a cannabis delivery
292292 20 organization must be entered into a data collection system and
293293 21 placed into a cannabis container for transport.
294294 22 (c) Cannabis delivery organizations are subject to random
295295 23 inspections by the Department, the Department of Public
296296 24 Health, and the Illinois State Police.
297297 25 (d) A cannabis delivery organization agent shall notify

308308 1 local law enforcement, the Illinois State Police, and the
309309 2 Department of Agriculture within 24 hours after the discovery
310310 3 of any loss or theft. Notification shall be made by phone, in
311311 4 person, or by written or electronic communication.
312312 5 (e) No person under the age of 21 years shall be in a
313313 6 vehicle transporting cannabis goods.
314314 7 (f) No person or individual who is not a cannabis delivery
315315 8 organization agent shall be in a vehicle while transporting
316316 9 cannabis goods.
317317 10 (g) A cannabis delivery organization agent must keep his
318318 11 or her identification card visible at all times when on the
319319 12 property of a cannabis business establishment and during the
320320 13 transportation of cannabis when acting under his or her duties
321321 14 as a cannabis delivery organization agent. During these times,
322322 15 the cannabis delivery organization agent must also provide the
323323 16 identification card upon request of any law enforcement
324324 17 officer engaged in his or her official duties.
325325 18 (h) A copy of the cannabis delivery organization's
326326 19 registration and a manifest for the delivery shall be present
327327 20 in any vehicle transporting cannabis.
328328 21 (i) Cannabis shall be transported so it is not visible or
329329 22 recognizable from outside the vehicle.
330330 23 (j) A vehicle transporting cannabis must not bear any
331331 24 markings to indicate the vehicle contains cannabis or bear the
332332 25 name or logo of the cannabis business establishment.

345345 2 (l) The Department may, by rule, impose any other
346346 3 requirements or prohibitions on the transportation of
347347 4 cannabis.

349349 6 Sec. 43-27. Procurement of cannabis products. A cannabis
350350 7 delivery organization may obtain cannabis products from any
351351 8 cannabis business organization licensed in the State.

354354 11 (a) The Department shall:
355355 12 (1) establish, by rule, the information required in an
356356 13 initial application or renewal application for an agent
357357 14 identification card submitted under this Article and the

359359 16 renewal application;
360360 17 (2) verify the information contained in an initial
361361 18 application or renewal application for an agent
362362 19 identification card submitted under this Article and
363363 20 approve or deny an application within 30 days of receiving
364364 21 a completed initial application or renewal application and
365365 22 all supporting documentation required by rule;
366366 23 (3) issue an agent identification card to a qualifying
367367 24 agent within 15 business days of approving the initial

379379 2 (4) enter the license number of the cannabis delivery
380380 3 organization where the agent works; and
381381 4 (5) allow for an electronic initial application and
382382 5 renewal application process and provide a confirmation by
383383 6 electronic or other methods that an application has been
384384 7 submitted; the Department may, by rule, require
385385 8 prospective agents to file their applications by
386386 9 electronic means and provide notices to the agents by
387387 10 electronic means.
388388 11 (b) An agent must keep his or her identification card
389389 12 visible at all times when on the property of a cannabis
390390 13 business establishment, including the cannabis delivery
391391 14 organization for which he or she is an agent.
392392 15 (c) The agent identification cards shall contain the
393393 16 following:
394394 17 (1) the name of the cardholder;
395395 18 (2) the date of issuance and expiration date of the
396396 19 identification card;
397397 20 (3) a random 10-digit alphanumeric identification
398398 21 number containing at least 4 numbers and at least 4
399399 22 letters that are unique to the holder;
400400 23 (4) a photograph of the cardholder; and
401401 24 (5) the legal name of the cannabis delivery
402402 25 organization employing the agent.

416416 3 (e) Any agent identification card lost by a cannabis

421421 8 required tax returns or paying any amounts owed to the State of

424424 11 Sec. 43-35. Cannabis delivery organization background
425425 12 checks.
426426 13 (a) Through the Illinois State Police, the Department
427427 14 shall conduct a background check of the prospective principal
428428 15 officers, board members, and agents of a cannabis delivery
429429 16 organization applying for a license or identification card
430430 17 under this Article. The Illinois State Police shall charge a
431431 18 fee set by rule for conducting the criminal history record
432432 19 check, which shall be deposited into the State Police Services
433433 20 Fund and shall not exceed the actual cost of the record check.
434434 21 In order to carry out this provision, each cannabis delivery
435435 22 organization's prospective principal officer, board member, or
436436 23 agent shall submit a full set of fingerprints to the Illinois
437437 24 State Police for the purpose of obtaining a State and federal
438438 25 criminal records check. These fingerprints shall be checked

450450 2 extent allowed by law, filed in the Illinois State Police and
451451 3 Federal Bureau of Investigation criminal history records
452452 4 databases. The Illinois State Police shall furnish, following
453453 5 positive identification, all conviction information to the
454454 6 Department.
455455 7 (b) When applying for the initial license or
456456 8 identification card, the background checks for all prospective
457457 9 principal officers, board members, and agents shall be
458458 10 completed before submitting the application to the Department.

460460 12 Sec. 43-40. Renewal of cannabis delivery organization
461461 13 licenses and agent identification cards.
462462 14 (a) Licenses and identification cards issued under this
463463 15 Article shall be renewed annually. A cannabis delivery
464464 16 organization shall receive written or electronic notice 90
465465 17 days before the expiration of its current license that the
466466 18 license will expire. The Department shall grant a renewal
467467 19 within 45 days of submission of a renewal application if:
468468 20 (1) the cannabis delivery organization submits a
469469 21 renewal application and the required nonrefundable renewal
470470 22 fee of $500, or after January 1, 2024, another amount set
471471 23 by rule by the Department, to be deposited into the
472472 24 Cannabis Regulation Fund;
473473 25 (2) the Department has not suspended or revoked the

485485 2 violating this Act or rules adopted under this Act;
486486 3 (3) the cannabis delivery organization has continued
487487 4 to operate in accordance with all plans submitted as part
488488 5 of its application and approved by the Department or any
489489 6 amendments thereto that have been approved by the
490490 7 Department; and
491491 8 (4) the cannabis delivery organization has submitted
492492 9 an agent, employee, contracting, and subcontracting
493493 10 diversity report as required by the Department.
494494 11 (b) If a cannabis delivery organization fails to renew its
495495 12 license before expiration, it shall cease operations until its
496496 13 license is renewed.
497497 14 (c) If a cannabis delivery organization agent fails to
498498 15 renew his or her identification card before its expiration, he
499499 16 or she shall cease to work as an agent of the cannabis delivery
500500 17 organization until his or her identification card is renewed.
501501 18 (d) Any cannabis delivery organization that continues to
502502 19 operate, or any cannabis delivery organization agent who
503503 20 continues to work as an agent, after the applicable license or
504504 21 identification card has expired without renewal is subject to
505505 22 the penalties provided under Section 45-5.
506506 23 (e) The Department shall not renew a license or an agent
507507 24 identification card if the applicant is delinquent in filing
508508 25 any required tax returns or paying any amounts owed to the
509509 26 State of Illinois.
