311 1 AN ACT concerning safety.
412 2 Be it enacted by the People of the State of Illinois,
513 3 represented in the General Assembly:
614 4 Section 5. The Illinois Solid Waste Management Act is
715 5 amended by changing Section 3 as follows:

917 7 Sec. 3. State agency materials recycling program.
1018 8 (a) All State agencies and local governments shall
1119 9 consider whether compost products can be used in the land
1220 10 maintenance activity project when soliciting and reviewing
1321 11 bids for land maintenance activity projects. If compost
1422 12 products can be used in the project, the State agency or local
1523 13 government must use compost products unless the compost
1624 14 products: responsible for the maintenance of public lands in
1725 15 the State shall, to the maximum extent feasible, use compost
1826 16 materials in all land maintenance activities which are to be
1927 17 paid with public funds.
2028 18 (1) are not available within a reasonable period of
2129 19 time;
2230 20 (2) do not comply with existing purchasing standards;
2331 21 or
2432 22 (3) do not comply with federal or State health and

34-1 Beginning January 1, 2024, the Department of
35-2 Transportation shall report each year to the General Assembly:
36-3 (i) the volume of compost used in State highway
37-4 construction projects;
38-5 (ii) the status of compost and compost-based products
39-6 used in State highway construction projects; and
40-7 (iii) recommendations to maximize the use of compost
41-8 as a recycled material in State highway construction
42-9 projects.
43-10 State agencies and local governments are encouraged to
44-11 give priority to purchasing compost products from companies
45-12 that produce compost products locally, are certified by a
46-13 nationally recognized organization, and produce compost
47-14 products that are derived from municipal solid waste compost
48-15 programs.
49-16 (a-5) All State agencies responsible for the maintenance
50-17 of public lands in the State shall review its procurement
51-18 specifications and policies to determine (1) if incorporating
52-19 compost materials will help reduce stormwater run-off and
53-20 increase infiltration of moisture in land maintenance
54-21 activities and (2) the current recycled content usage and
55-22 potential for additional recycled content usage by the Agency
56-23 in land maintenance activities and report to the General
57-24 Assembly by December 15, 2015.
58-25 (b) The Department of Central Management Services, in
59-26 coordination with the Agency, shall implement waste reduction

70-1 programs, including source separation and collection, for
71-2 office wastepaper, corrugated containers, newsprint and mixed
72-3 paper, in all State buildings as appropriate and feasible.
73-4 Such waste reduction programs shall be designed to achieve
74-5 waste reductions of at least 25% of all such waste by December
75-6 31, 1995, and at least 50% of all such waste by December 31,
76-7 2000. Any source separation and collection program shall
77-8 include, at a minimum, procedures for collecting and storing
78-9 recyclable materials, bins or containers for storing
79-10 materials, and contractual or other arrangements with buyers
80-11 of recyclable materials. If market conditions so warrant, the
81-12 Department of Central Management Services, in coordination
82-13 with the Agency, may modify programs developed pursuant to
83-14 this Section.
84-15 The Department of Commerce and Community Affairs (now
85-16 Department of Commerce and Economic Opportunity) shall conduct
86-17 waste categorization studies of all State facilities for
87-18 calendar years 1991, 1995 and 2000. Such studies shall be
88-19 designed to assist the Department of Central Management
89-20 Services to achieve the waste reduction goals established in
90-21 this subsection.
91-22 (c) Each State agency shall, upon consultation with the
92-23 Agency, periodically review its procurement procedures and
93-24 specifications related to the purchase of products or
94-25 supplies. Such procedures and specifications shall be modified
95-26 as necessary to require the procuring agency to seek out

106-1 products and supplies that contain recycled materials, and to
107-2 ensure that purchased products or supplies are reusable,
108-3 durable or made from recycled materials whenever economically
109-4 and practically feasible. In choosing among products or
110-5 supplies that contain recycled material, consideration shall
111-6 be given to products and supplies with the highest recycled
112-7 material content that is consistent with the effective and
113-8 efficient use of the product or supply.
114-9 (d) Wherever economically and practically feasible, the
115-10 Department of Central Management Services shall procure
116-11 recycled paper and paper products as follows:
117-12 (1) Beginning July 1, 1989, at least 10% of the total
118-13 dollar value of paper and paper products purchased by the
119-14 Department of Central Management Services shall be
120-15 recycled paper and paper products.
121-16 (2) Beginning July 1, 1992, at least 25% of the total
122-17 dollar value of paper and paper products purchased by the
123-18 Department of Central Management Services shall be
124-19 recycled paper and paper products.
125-20 (3) Beginning July 1, 1996, at least 40% of the total
126-21 dollar value of paper and paper products purchased by the
127-22 Department of Central Management Services shall be
128-23 recycled paper and paper products.
129-24 (4) Beginning July 1, 2000, at least 50% of the total
130-25 dollar value of paper and paper products purchased by the
131-26 Department of Central Management Services shall be

143-2 (e) Paper and paper products purchased from private
144-3 vendors pursuant to printing contracts are not considered
145-4 paper products for the purposes of subsection (d). However,
146-5 the Department of Central Management Services shall report to
147-6 the General Assembly on an annual basis the total dollar value
148-7 of printing contracts awarded to private sector vendors that
149-8 included the use of recycled paper.
150-9 (f)(1) Wherever economically and practically feasible,
151-10 the recycled paper and paper products referred to in
152-11 subsection (d) shall contain postconsumer or recovered
153-12 paper materials as specified by paper category in this
154-13 subsection:
155-14 (i) Recycled high grade printing and writing paper
156-15 shall contain at least 50% recovered paper material.
157-16 Such recovered paper material, until July 1, 1994,
158-17 shall consist of at least 20% deinked stock or
159-18 postconsumer material; and beginning July 1, 1994,
160-19 shall consist of at least 25% deinked stock or
161-20 postconsumer material; and beginning July 1, 1996,
162-21 shall consist of at least 30% deinked stock or
163-22 postconsumer material; and beginning July 1, 1998,
164-23 shall consist of at least 40% deinked stock or
165-24 postconsumer material; and beginning July 1, 2000,
166-25 shall consist of at least 50% deinked stock or
167-26 postconsumer material.

178-1 (ii) Recycled tissue products, until July 1, 1994,

194-17 (iv) Recycled unbleached packaging, until July 1,
195-18 1994, shall contain at least 35% postconsumer
196-19 material; and beginning July 1, 1994, shall contain at
197-20 least 40% postconsumer material; and beginning July 1,
198-21 1996, shall contain at least 45% postconsumer
199-22 material; and beginning July 1, 1998, shall contain at
200-23 least 50% postconsumer material; and beginning July 1,
201-24 2000, shall contain at least 55% postconsumer

146+7 (2) Beginning July 1, 1992, at least 25% of the total
147+8 dollar value of paper and paper products purchased by the
148+9 Department of Central Management Services shall be
149+10 recycled paper and paper products.
150+11 (3) Beginning July 1, 1996, at least 40% of the total
151+12 dollar value of paper and paper products purchased by the
152+13 Department of Central Management Services shall be
153+14 recycled paper and paper products.
154+15 (4) Beginning July 1, 2000, at least 50% of the total
155+16 dollar value of paper and paper products purchased by the
156+17 Department of Central Management Services shall be
157+18 recycled paper and paper products.
158+19 (e) Paper and paper products purchased from private
159+20 vendors pursuant to printing contracts are not considered
160+21 paper products for the purposes of subsection (d). However,
161+22 the Department of Central Management Services shall report to
162+23 the General Assembly on an annual basis the total dollar value

215-2 beginning July 1, 1994, shall contain at least 85%
216-3 postconsumer material; and beginning July 1, 1996,
217-4 shall contain at least 90% postconsumer material; and
218-5 beginning July 1, 1998, shall contain at least 95%
219-6 postconsumer material.
220-7 (2) For the purposes of this Section, "postconsumer
221-8 material" includes:
222-9 (i) paper, paperboard, and fibrous wastes from
223-10 retail stores, office buildings, homes, and so forth,
224-11 after the waste has passed through its end usage as a
225-12 consumer item, including used corrugated boxes, old
226-13 newspapers, mixed waste paper, tabulating cards, and
227-14 used cordage; and
228-15 (ii) all paper, paperboard, and fibrous wastes
229-16 that are diverted or separated from the municipal
230-17 solid waste stream.
231-18 (3) For the purposes of this Section, "recovered paper
232-19 material" includes:
233-20 (i) postconsumer material;
234-21 (ii) dry paper and paperboard waste generated
235-22 after completion of the papermaking process (that is,
236-23 those manufacturing operations up to and including the
237-24 cutting and trimming of the paper machine reel into
238-25 smaller rolls or rough sheets), including envelope
239-26 cuttings, bindery trimmings, and other paper and

176+1 the recycled paper and paper products referred to in
177+2 subsection (d) shall contain postconsumer or recovered

250-1 paperboard waste resulting from printing, cutting,
251-2 forming, and other converting operations, or from bag,
252-3 box and carton manufacturing, and butt rolls, mill
253-4 wrappers, and rejected unused stock; and
254-5 (iii) finished paper and paperboard from obsolete
255-6 inventories of paper and paperboard manufacturers,
256-7 merchants, wholesalers, dealers, printers, converters,
257-8 or others.
258-9 (g) The Department of Central Management Services may
259-10 adopt regulations to carry out the provisions and purposes of
260-11 this Section.
261-12 (h) Every State agency shall, in its procurement
262-13 documents, specify that, whenever economically and practically
263-14 feasible, a product to be procured must consist, wholly or in
264-15 part, of recycled materials, or be recyclable or reusable in
265-16 whole or in part. When applicable, if state guidelines are not
266-17 already prescribed, State agencies shall follow USEPA
267-18 guidelines for federal procurement.
268-19 (i) All State agencies shall cooperate with the Department
269-20 of Central Management Services in carrying out this Section.
270-21 The Department of Central Management Services may enter into
271-22 cooperative purchasing agreements with other governmental
272-23 units in order to obtain volume discounts, or for other
273-24 reasons in accordance with the Governmental Joint Purchasing
274-25 Act, or in accordance with the Intergovernmental Cooperation
275-26 Act if governmental units of other states or the federal

212+1 shall contain at least 40% postconsumer material; and

232+21 shall contain at least 90% postconsumer material; and
233+22 beginning July 1, 1998, shall contain at least 95%

235+24 (2) For the purposes of this Section, "postconsumer

287-2 (j) The Department of Central Management Services shall
288-3 submit an annual report to the General Assembly concerning its
289-4 implementation of the State's collection and recycled paper
290-5 procurement programs. This report shall include a description
291-6 of the actions that the Department of Central Management
292-7 Services has taken in the previous fiscal year to implement
293-8 this Section. This report shall be submitted on or before
294-9 November 1 of each year.
295-10 (k) The Department of Central Management Services, in
296-11 cooperation with all other appropriate departments and
297-12 agencies of the State, shall institute whenever economically
298-13 and practically feasible the use of re-refined motor oil in
299-14 all State-owned motor vehicles and the use of remanufactured
300-15 and retread tires whenever such use is practical, beginning no
301-16 later than July 1, 1992.
302-17 (l) (Blank).
303-18 (m) The Department of Central Management Services, in
304-19 coordination with the Department of Commerce and Community
305-20 Affairs (now Department of Commerce and Economic Opportunity),
306-21 has implemented an aluminum can recycling program in all State
307-22 buildings within 270 days of the effective date of this
308-23 amendatory Act of 1997. The program provides for (1) the
309-24 collection and storage of used aluminum cans in bins or other
310-25 appropriate containers made reasonably available to occupants
311-26 and visitors of State buildings and (2) the sale of used

251+4 newspapers, mixed waste paper, tabulating cards, and
252+5 used cordage; and
253+6 (ii) all paper, paperboard, and fibrous wastes
254+7 that are diverted or separated from the municipal
255+8 solid waste stream.
256+9 (3) For the purposes of this Section, "recovered paper
257+10 material" includes:
258+11 (i) postconsumer material;
259+12 (ii) dry paper and paperboard waste generated
260+13 after completion of the papermaking process (that is,
261+14 those manufacturing operations up to and including the
262+15 cutting and trimming of the paper machine reel into
263+16 smaller rolls or rough sheets), including envelope
264+17 cuttings, bindery trimmings, and other paper and
265+18 paperboard waste resulting from printing, cutting,
266+19 forming, and other converting operations, or from bag,
267+20 box and carton manufacturing, and butt rolls, mill
268+21 wrappers, and rejected unused stock; and
269+22 (iii) finished paper and paperboard from obsolete
270+23 inventories of paper and paperboard manufacturers,
271+24 merchants, wholesalers, dealers, printers, converters,
272+25 or others.

286+3 (h) Every State agency shall, in its procurement
287+4 documents, specify that, whenever economically and practically
288+5 feasible, a product to be procured must consist, wholly or in
289+6 part, of recycled materials, or be recyclable or reusable in
290+7 whole or in part. When applicable, if state guidelines are not
291+8 already prescribed, State agencies shall follow USEPA
292+9 guidelines for federal procurement.
293+10 (i) All State agencies shall cooperate with the Department
294+11 of Central Management Services in carrying out this Section.
295+12 The Department of Central Management Services may enter into
296+13 cooperative purchasing agreements with other governmental
297+14 units in order to obtain volume discounts, or for other
298+15 reasons in accordance with the Governmental Joint Purchasing
299+16 Act, or in accordance with the Intergovernmental Cooperation
300+17 Act if governmental units of other states or the federal
301+18 government are involved.
302+19 (j) The Department of Central Management Services shall
